Full payment is required in order to reserve any animal. There will be a 20% restocking fee if the buyer decides not to purchase the reserved animal.
I'll say it. You're shady as all hell; and not nearly as slick as you think you are.are you going to say i'm shady again?
Considering that she didn't use your website's checkout system, it's fairly unlikely that your insidious TOS would even come into play, unless you explicitly outlined them to her or directly provided her a link to their location. If you didn't, what you desperately want to perceive as her implied agreement to your terms would likely fall under the category of a "Browsewrap Agreement," which isn't nearly as binding as you'd like. Not that I want to turn this into a legal debate of the intricacies of online implied assent; I'm just demonstrating that you probably wouldn't have a leg to stand on, in the legal sense. Even if your terms themselves were to be found lawful; the degree to which a reasonable person could have been expected to find and read them plays a huge role.so are tos basically never allowed to change?

Be that as it may, I think the TOS aspect is merely tangential. What it boils down to is this - Based on the provided evidence, it'll be very easy for a reasonable person to read these threads and decide that your business model is very unethical and deceptive. Opinions will vary as to whether or not you're entitled to keep someone's money when they back out. Can you do it? Sure. Should you? Well, personally, I'd need a damn good reason to even consider it. A simple flake-out wouldn't be enough for me.
But to come here and whine about her lack of adherence to terms that you, yourself, conveniently "remembered" to change to your own benefit right in the middle of the situation? Wow. That's ballsy. Comically hypocritical; but ballsy.
Indeed, I did. Your powers of observation are truly awe-inspiring.good for you dan! you said "it"![]()
honestly, it is what it is. people are going to take sides and that's life. for nobody's like the dans of this world, their opinions are meaningless bc they don't contribute to society.
i run my business perfectly fine thank you. i've got great support from all of my clients and this lady was bound to happen at some point. can't make everyone happy or make them like me. my clients know me and how i run my business.
i find it amusing that this is a boi and when i started a thread of someone that thinks they are above the policies of a business, this is the reaction that came up. these are the types of people that take their french fries back bc it wasn't salty enough and wants a full refund after they've eaten half of it. way to support these losers.
Yet you come to us "LOSERS" toabout someone not abiding by your TOS, even though you yourself changed your TOS AFTER she bought the animal.
You are digging yourself a damned hole, and if you'd quit, you could get out of it before it fills back in.
Good on you for giving her a full refund, but you're business practices are still lacking. You don't come on and ask for other people in the reptile circuit to back what you're spewing, and then call us losers. But if you think this won't hurt your business, then good for ya.![]()
you should go back to school and take english again. i didn't call YOU a loser.
Yes, I had a red barred ambanja for sale awhile back and he contacted me and asked me to hold him until he was paid for a Cham he had up for sale. He offerered a deposit but I told him I'd hold him anyways. After about a week he told me he was still waiting in payment and I was fine with that. After about another week after I send him an email asking if he was going to buy and he replied with its not what I'm looking for after all. This is ok with me, it's part if the business but I am amazed at his posting a bad guy thread telling other people not to sell to someone for doing basically the same thing he did to me. I marked the animal he had requested sold and also told interested he was sold and after a couple weeks they had found other available chams. Frustrating isn't it sang, just refund all they're and move on like a professional would, not come in to forums crying just because someone barely inconvenienced you. Click on the refund button and move on.
my clients know me and how i run my business.

Unfortunately Patrick knows you all too well.
If you read what you wrote, and the way you wrote it, you called everyone a loser. So I don't need to go back to school to retake English (which should be capitalized, like I did in my sentence if you're going to try to correct me.) You apparently need to go back to school to learn manners though.
Your holier than thou attitude is gaining you great brownie points here. Quit while you're ahead from giving Jen a full refund instead of acting like a total jerk and trying to make it seem like you're in the right. You're not, and neither is she. Get over it!
wow. so you're saying bc you read what i wrote the way you read it, you are saying i called everyone a loser? hhhmmm. i think you're assuming that everyone reads like you. sorry, i don't read like you and i read what i wrote and it read like the way i wrote it and the way it was intended. do you understand that?
Oh I understand perfectly. You're being a jerk and just have to solidify it with everything you type. Thanks for clarifying that for me. You're top notch!![]()
hey ed, didn't you read my post about me backing out of a deal and being burned by the another seller's tos? so you see, i'm not a cry baby like the buyer in question on this thread. i didn't give patrick any cash so i wouldn't be violating his tos.
