    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

You could have avoided all of this. You opened a Pandoras box by going on the BOI, not me. My concern, was not to avoid a settlement with you, but a negotiated settlement. I dont need to steal or liee about anything. I am financially capapble of meeting my obligatons. The animal died, and you are correct. No photos were taken.. My fault. As I should have. But when I spoke to Billy, he specifically indicated that the guarantee period had elapsed and that you would want payment in full.. IN my thinking there was no need to hold on to the animal from that point... I did have it in the freezer up to that time...

Sometimes these things do happen and I try to mitigate my losses. Its done every day where animals are concerned with deductions, and arguments over what was received and what was not.

You prefer to opt out of a settlement. Fine. But I dont think it was necessarqy to bring the post to the BOI 2 months after the incident , and providing emails that could have worked itself out to a favorable conclusion. I did respond, and that was a door opening to some dialogue where maybe we could have reached a settlement. Instead here we are after 12 pages of posts.

You win. I cannot fight or answer every posting, nor do I have to. all you would have had to do was meet me half way and the problem would have been resolved.

If this is in reference to Jerry, I did not realize that his wife was ill. I'm genuinely sorry to hear this.
When life hurts us or ours, we have choices. I've seen this community respond when there is a need. There is an outpouring of help, from, at times, contributions, to well wishes, to thoughtful suggestions. For someone who genuinely needs help, I think many of us would do what we could. In my own fields of nursing and law, I've offered guidance from time to time when I have been asked, and I know of others who have opened their hearts to those in need.

We make choices in our lives. When times are tough and we are down and out, sometimes there is suffering and discouragement, but sometimes we can be strengthened and encouraged by our ties to the community.
But if one makes the wrong choices and preys on the very people who could offer strength, everyone loses.
Sometimes, in weakness, we all slip, and make the wrong choices. People are human, they make mistakes. There isn't one of us here who has not, at some point in our lives, done something we later regretted.

From the accounts here, Ben pulled Jerry over at a convention and asked about financial difficulties. At that moment, there was the possibility of redemption. Ben, kudos to you, even with all your other difficulties, you found it within yourself at that moment to try to work this out. Jerry apparently made his choice, and from reports given, declined to work with you.

Jerry, I don't understand why you made the choices you made. You've hurt Ben, you've hurt yourself.
Jerry, if it is true that your wife is ill, I offer my hopes that she gets better soon.

I know this is your thread Ben, but what about my frogs too?! I havent gotten pics of deceased animals either. I see a pattern of what Jerry does, and I expect more people to come out and tell their story.
 
would also like to add---that Jerry was asked directly in one of our first interaction via email that I posted if he had a necropsy(FIRST 3 POSTS ON THIS THREAD). So quite obvious I wanted to know a cause of death. At this point he still had the body supposedly on his own timeline by his own admission. We were already well at disagreeing about this transaction, so he thinks its okay to THEN throw out the body? GIVE ME A BREAK JERRY--PLEASE--you are making yourself look so bad.
On another note.
Has anyone heard of any monkey tail skinks being sold during the timeframe in question? Its not like a lot of monkey tail skinks get sold in the united states in a couple months. We probably get more then most into inventory and still only get a handful a year. I know the other two people we sold the other 2 from that group to(which are doing perfectly fine I might add). SO again--get the word out--would honestly like to know what happened to the skink. Jerry---Did you bury it in your back yard? Was quite a large animal to just throw in the trash. Maybe we could go dig it up.

If you had simply paid what you owed (which you admit that you incurred) you could have been the one to settle this all quite simply. Instead, you chose to be a debtor and refuse to pay. Amazing that I have to say this to a 68 year old man. But you're just not getting it. It's that simple.
 
its simple--Jerry likes to come at people this hard and sound smart and threaten legal actions because they back down. Its called a bully. Been doing it for years I can see now. I was going to post this up before my midnight madness sale event. No differently then I had posted it. Got too busy. I had been poked A LOT that week and realized that I forgot to put that post up about my transaction with Jerry so I went to the boi and what do I find at the top-- him BULLYING this poor girl who was in the right, and I got to writing my post.
 
Why on Earth would Ben want to avoid this Jerry? Not one person reading this has said they think Ben might be wrong. As a matter of fact of the forty people that have posted on this thread only you have tried to discredit him or cast the blame his way. THIRTY NINE PEOPLE think you are wrong and acting like a scumbag.

Give me a figure you would be comfortable with to negotiate this to a final conclusion. You can do it privately. But understand we are talking about a settlement here. JERRY
 
Lucille, Its true, I did offer some animals and cash. I have a nice collection and my thinking was that through his retail operaion the herps would more than compensate to put this to bed. The additional cash would be negotiated. That would be that.. When I saw Ben was not interested in those terms, it was at that moment that he wanted to know if there was some finanial problems . That was not the case. The animal died . its not in my closet hiding . Thats an Alice in Wonderland concept. Ben wanted the balance, and I did not want to pay it. I dont about you, but contrary to Bens previous statements, I enjoyed the relationship, never had a problem with anyone,was a frequent visitor to the store. Loved Billys company, and if something caught my fqancy, I would buy with or without money... Never screwed around and always met my obligations. To everyone. Not only Ben.

Incidentally, Snakes at Sunrise or Petaholics or whatever now calls himself, deals with garbage. Bought 6 waxys (imported) lost them all in less then a week.... All I wanted was 6
lousy frogs not for resale . I dont pay for that kind of merchandize. Nor would anyone else. But you see in my case, I am incapable of telling the truth and everything seems to be interpeted as a lie. Contrary to Ben, anything he says, is always the truth.

So now if you read my above post to Ben, lets see how he handles this.... One other point, if I see continued harrasment from Bens peanut gallery, I will without question, reconsider my offering.... I think you are funny. My legal opinion is that Ben is in a position where he may very well recoup $900 plus, and you turned him down when he wanted to deal. I think you've suddenly seen that you can't bully your way out of what you've done to him, and you are desperate to settle.

You husbandry practices can be in question but I am not allowed to post what others seen or said, so I'll wait for them to get back from the show in Chicago and post what they saw at YOUR place and some of YOUR husbandry methods.
I would not doubt for a second if the frogs died in your care. Hence why we still want to get paid for them. We are not responsible for negligence or improper husbandry.You claim your a old timer and know everything, but that is questionable.
You did not contact us, nor speak with me or anyone regarding them.
When confronted in person, you high tailed it out of Ben's shop after saying you would not pay.
You never provided proof of our frogs within OUR guarantee, nor even contacted us about them.
Our guarantee was on our pricelists.
We are Snakes at Sunset for retail sales Jerry. We also have a wholesale division called Petaholiks which you would get pricelists from when we imported regularly. Our mistake was sending you the list as a wholesale customer when you clearly are not.
Do not imply we keep changing names as that is what I interpreted from your post.

Am I reading this right??

You were told by Billy that the guarantee period elapsed, full payment would be expected, so in your thinking, you threw the animal away?

That doesn't even make any sense? Do what?

Do you realize with that statement, you just admitted to knowing that full payment would be expected, and you throwing the animal away, KNOWING THAT, is basically you, yourself, admitting you stole? You throwing the animal away, and not giving it back to the owner, after you took the animal without full payment, is another version of stealing. A legal definition of stealing is worded as:

" the wrongful or willful taking of money or property belonging to someone else with intent to deprive the owner of its use or benefit either temporarily or permanently. "

Time to grow up, be a man, admit fault, humble yourself, and pay Ben. Then, please leave our hobby.

Unbelievable! Even people outside the pet industry know that if you buy a $.97 goldfish at Walmart and the fish dies, you have to provide the body to get your .97 back or a replacement. If you buy a new car and it blows up on the way home you can't tell the dealership "Oh I got rid of it, but would you take this '80 Chevette as partial payment and call it good?"
My opinion is that Ben should have his attorney go for every cent he can possibly get from this guy!

Right now Jerry has no interest in seeing this issue with the skink resolved as long as he doesn't get to take a whack at Ben and his staff with his vindictiveness. It seems to me that Jerry wants nothing more than to see Ben lose everything because of recent events. Disgusting. Pathetic.

In fact, appearances are deceiving. He has read just enough to present worse case scenarios in order to deflect attention from himself. As a professional I can tell you that he is not showing any real, in depth legal knowledge.

In my opinion, he has realized that he may be on the hook for substantial sums, much more than the $900 he owes for the lizard. He is taking his bullying to new heights (and pathetic lows) as he tries to manipulate public opinion against Ben in an effort to escape justice.
