    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

I am glad to say a CHECK arrived today and it is postmarked for Friday. So i will aplogize for saying it was not mailed. I will be cashing it tonorrow and hopefully this will be the end of this mess. As I said before I was very skeptical because I have been waiting months on a MO to arrive. Thanks to all that have helped Rob
 
I have known Jim for a while now and I did not believe he would intentional take advantage of someone. I am glad all worked out. Sometimes S**t happens. But I do think a I am sorry for calling you a thief in indeed in order... too....Plus I do beleive this should of been resolved between the two of them.:no_evil01
 
Just so I am 100% clear on what happened here, and why this thread is here, let me see how close I can come to understanding the events.
First, you send Jim a bird, and are to recieve a bird from a clutch that didn't make it. Until the bird died, there was no mention of monetary compensation because you expected the bird.
Then Jim, who happens to be the busiest person I know,( has more than one job and does herp shows every single weekend in late spring and summer) is blind sided by a demand for 400 dollars. Granted, he should have known that he would have to supply you with compensation, thats a given, but when it comes about at the busiest time of the year for a man who works in construction, and during the breeding/selling herps show season how quickly can he really be expected to compensate? Jim is not the type to overlook a debt, and you have done a terrible disservice to this board by labeling him a thief.
You counted chickens before they hatched, and when the farmer was busy tending to the other animals you wanted him to drop everything to settle up. He did need to settle up, and I think he did so in a reasonable time frame.
Do you happen to have a copy of the contract you wrote up for this transaction? Or was the money thing just made up as you went along?
By the way, how did that filing with the court on the Monday the 5th go?
 
I thought I would ad as well that I have a deal that I am working with Jim, and can vouche as Davey stated that he is one of the busiest people I have ever met or heard of.

I also agree that you should apologize for calling him a liar, instead of waiting to see if you would (as you did) get the check for payment.
 
I just reread the initial post. I guess I missed the contract part. I apologize for that. However, I do still want to see what the contract says about monetary compensation in the event of an unforseen death, and the amount of time in which that sum is to be paid.
 
Thank you Dave. You said what I should of. Jim is ok in my books. I should of come to his defence long ago and for that I am deeply sorry and embarassed.
 
I stayed away so we could watch this unfold. I knew Jim didn't need any help here. He is a stand up guy, and he was ready to go to court. I only added to this because Rob came on and posted the outcome, which we all knew would be in Jims favor anyway.
 
Glad it's over

I am actually glad that this thing worked out...see, it doesn't hurt to wait a couple of extra days, especially with a holiday weekend involved. Hopefully everyone, 2 parties and observers have been able to learn something from this thread and the way it unfolded.

Now, I think that since things got way out of hand and the name calling went a bit far the the previous calls for an online apology (and maybe a phone call to confirm the same) are probably in order. Granted, things didn't happen as quickly as Rob would have liked and maybe even as fast as Jim expected, but it did work out without getting any uglier than it already has.

My suggestion to Rob is to work on the patience/temper thing.

My suggestion to Jim is to use Express Mail (or FedEx) the next time so that a tracking number is available.

First of all he was suposed to have paid for the bird almost 2 1/2 months ago so how long should I have waited ? Second the amount was what I was selling the bird for and traded for instead. Third. If I had made a deal with you on 04/13/04 to have delivery of payment (meaning chick at time) in 2 weeks and it is now 07/06/04 when payment arrives because Iam busy you wouldnt be mad ? When you try to call me I am unreachable ? Then I would answer the phone say ok I will send tomorrow and 4 weeks pass no MO or check and no answer of the phone ? I know when this deal was being worked out I could reach him and he has time to go to reptile shows but not return a phone call or email ? You reach me on the phone and I agree to meet you on my way through town to a reptile show and never call or show up ? You get ahold of me and say I can come to you and pick up payment and I say no I will mail it tomorrow ? I am sorry but I dont see how I could look at this and see him as a stand up guy ? If he is such a good friend to all of you why would you not stand up for him till after payment recieved ? I have recieved emails and messages from other members with similar problems in the past so I know I am not the only person on here with problems. Just the only one who has said so. So if you think it is ok would you like to sell me some GTPs and I can pay you after Christmas ? its the same thing and you know it. Its so easy to say he is a stand up guy AFTER he pays but during this whole thing you have waited to see how it turned out and as for the court I forgot it was the 4th weekend. I thought that this forum was For the reason of finding out who was good and who was a scammer. Now say in 2 months you make a deal with him and never see payment what would you do ? Just go SH*T happens ? NO you would expect payment and would like help getting it. So this also shows that if you want to scam people your friends will help you ? Because all of you who are his friends didnt care that this had happen till. Well what goes around comes around so I hope you enjoy getting screwed because unless its my wife I dont ! I also stated that it was suposed to have been mailed on Tuesday and is marked Friday the DAY AFTER I POSTED WOULD FILE IN COURT not when it was suposed to be mailed. And through the whole deal still no phone call and no email saying it was coming nothing wouldnt even answer his phone how does that look to you ? Thanks Rob Malcom
 
Why should anyone have to post in his defense? Nobody did, and he did this on his own. He made it right, he didn't steal from you, he is still busy,you have your money, you still have a post calling him a thief. Good job, you win.
Since you got the money after Monday, I would still like to see those court papers you filed.
Also still waiting to see the contract that shows the date you were to be paid if the bird died.

There was no date saying when to pay if bird died. Now take a step back and look at what you are saying -it is ok to put someone off for 3months because i cant pay- ? Thank god I no longer have reptiles to sell on here. If you traded me 2 yearling GTPs for a albino ball due to hatch in a month and I didnt send payment for 3 months even after I said I would several times ? Think about it I am glad I am not your customer. and yes I did get my money only after I was suposed to file for court and the court was closed monday.

If you and I had a trade deal, and the animals died or were not produced, I am sorry to say it, but yeah, if you came up with a figure of 400 dollars to cover the loss, and I wasn't prepared for it, you might be waiting 2 1/2 months to be reimbursed. I wish I lived in a magical realm where I could snap my fingers and money appeared, but I live on Earth, have a family, a kid, and bills. All of these things cost money. If we included an insurance clause saying that I would pay 400 should I not produce the animal, I would have ample time to come up with the money before the time to pay came.
 
Ok my turn. I’ll start with look at the letters date again. I was standing there when the postmaster stamped it and it was Thursday. Next I only know 1 person who has responded here. I have never met the others. I did screw up on this deal 3 or 4 times. The 1st time was by trading for something that I didn't have. I knew better but needed the bird because this hen will give me close to 20 babies a year. I figured I would get at least 1 of the 2 eggs hatched but didn’t. Springtime storms here are bad and lots of power outages. It’s not that the birds died it's that the eggs never hatched. Next there are 2 people in Oklahoma that you don't believe and that’s weathermen and postal workers. They never know what’s really happening till it already did. I didn't send certified or anything because I listened to the postmaster who said it should make it over night. My screw up. The next 1 was I was trying to get the next batch of eggs hatched out and just go ahead and trade. Our deal was 2 babies for his male plus $100.00 bux.i would have rather gave up $1000.00 worth of babies then $400.00 cash. But all is good. I now have 3 babies and 2 more will hatch out in the next 5 days so no biggie.as to $250.00 and the bird back. Dream on never an option regardless of what happened. I still believe he received the check on Friday but had already posted so was looking for an excuse and figured the 4th would be a good on to say it was delayed. But it doesn’t really matter to me. it’s over so we can let it die.Other people with this same problem?? There are 2. 1 is in Florida and I’m fixing to send him a pair of emeralds and were through. And will still do business together. The other is in Michigan I believe and it’s technically over 8 bux.i’ll take care of him also just not had a rocket up my azz to get it done.gonna send him a couple of my baby beardies because it has been so long on him. Gonna be tough (impossible) to find anyone I have screwed over and not made more than right. I am the 1 that always comes out with the shaft here. I have hot checks, pics of 13 dead snakes that arrived cooked from 7 heat packs, and people that just flat azzed are not going to pay for there flawless animals they received. Even had the balls to list them for sale here on fauna and when I busted them they said oh yea I’ll pay you for them when I get some cash. And these deals are 6-8 months old. but I have a life so no need to set around and whine and cry about it. just mark it as another lesson learned.

Jim I agree it did take longer than expected and the check didnt arrive till Yesterday around 330pm. Thank you for sending it. I also think lack of comunication is to blame also I was never told there were other birds just eggs waiting to hatch. Have a nice summer. Rob
