    In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Many of you are aware that for several months we have been involved in a legal struggle to defend our Trademark of Lost World Reptiles.
I have been buoyed by the tremendous support the reptile community has given me.
I am happy to announce that we have finally been awarded an injunction against Lost World Pets from using that name.
It will take a little time to fully enforce this injunction but in the end there will be ONLY ONE LOST WORLD in our trade.
They will have 30 days to stop using the name completely or will face a contempt of Federal Court charge.

The folks at Kingsnake will not pull his ads until we mail him a copy of the injunction
so it will still be a few days or weeks before it's over.

Wow, I'm glad I read the whole thread, Iwould have hate to have clumped Gino into the other Lost World. With so many company names out there it is hard to differentiate between names that close. I'm glad you won your injunction Gino!
 
Dear Reptile Community,
I have been given a series of E-Mails from Lost World Pets to a 3rd party.
They are telling folks that there is no injunction and have labeled my post that there was as unprofessional behavior.
I leave it to you all to decide who is being unprofessional.
They have also made the claim that they would gladly have worked with me to avoid this problem but that I immediately hired a lawyer.
In August I sent a friendly E-Mail which I will be happy to provide.
The E-Mail made no demands.
I pointed out to them that some cases of confusion had arisen, particularly with Reptile Magazine and a couple of customers.
I did express concern that instead of telling my customer where to find me they attempted to take advantage of this confusion.
They stated their product was superior and they should buy there. (in the E-Mail to the confused customer)
I waited nearly 2 months after the E-Mail was ignored before I contacted a lawyer.
They were sent a Cease and Desist on October 15th.
Once again they completely ignored the letter.
In fact that week they suddenly doubled their Kingsnake advertisement.
They were served with a summons to Federal District Court on November 21st.
Again they simply ignored the proceedings.
Finally on Jan 18th I was issued a Final Default Judgment and Permanent injunction against them.
They still prefer to pretend none of this happened.
I will provide a copy of the injunction to any person who E-Mails me for it.
All I ask in return is that you post to this thread what you have seen.

They further assert that I do not deserve protection because they claim I operate in Florida and deal mostly in Corns. They claim they do not operate in Florida and deal rarely in Corns.
While it is true I deal heavily in corns I also sell most other colubrids as well.
As for dealing in Florida. We both deal mostly in mail order done over the net.
If you check my posts and theirs we both claim prominently we deliver nationwide.
Even if our business was not in such direct conflict our reputations are.
When someone posts that they received a mite infested snake from Lost World Pets I can simply not take the chance that even 1 person mistakes them for me.
I paid for this Trademark and am deserving of the protection I contracted for.
I work very hard to please my customers and take care of my animals.
Reputation has very real tangible value in this business.
Again, this very forum is a great testament to that fact.

Finally they have been informed by me, an attorney, and now a Federal Judge that they are infringing on my property rights.
Still they feel they have no reason to respect those rights.
They do not even believe that these claims are deserving of a reply.
I ask you who has displayed behavior that is unprofessional?

I call upon you, this community, to decide.

Gino, don't worry about what they think...

Everyone who knows you, or who even knows OF you, knows that you have a great customer satisfaction record and that all of the other vendors who know you also like and respect you. So just follow through with what you know is right, and anyone who is worth your friendship and/or doing business with, will respect you all the more for it.

Hi Everyone,
Just to update as I get a few E-Mails asking for info.
I have had what I hope was a productive conversation with two of the head folks at Lost World Pets. It is my belief that this can very well be resolved peacefully.
I wish to acknowledge publically that they spoke respectfully and I hope now have a better understanding of our situation.
Let's wait a while and give folks a chance to do the right thing.

Gino, Just to let you know I attended a show in Pittsburgh this past Sunday the 22nd and they (lost world reptiles) were still using the name in full force including biz cards and on a large banner above their tables.

I did get quite a few E-Mails from other Vendors and do want to say thanks.
They were within the Grace period then so it's no problem.
I think things are pretty well solved.

Looks like they have a new name now and I wish them all the best in the future.
I'm going to have boxes of stuff from them to go through soon (whatever materials there is) but after that I hope it's all over.

I don't think they'll have a problem with Bay Area Reptiles.
First: Bay Area has not trademarked the name which is the biggest point.
Next: Simply having Bay would not likely cause confusion.
Bay state is a reference to the original colony name of Mass.
Quite diferent from Bay Area. I live in Tampa and Bay Area is quite common.
Lost World combined is a unique phrase. They could very well have called themselves World of Pets or something like that. It was using the specific term Lost World that caused the confusion.
I don't think they will run into trouble.

There is still a company here in Ontario Canada the have 2 stores now and the name is the lost world reptiles and from what I hear the give a lot of bad advice to make a buck
