    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

easy way out offer to refund half the money for both your losses and walk away. because either way someone is a liar and we will never know the truth so why argue back and forth who is right or wrong in my op both parties are at fault one way or another.

If not a full refund, something. Its kinda crappy when you pay for something and nothing to show for it. Especially a D.O.A.
 
I don't think I have enough facts in order to come to a conclusion at this time. I would want the screen shot of the phone calls, some of the Lou's previous customers backing up how many heat packs he uses. (Lou there is a thread started asking that ... it is this one)

I will offer my personal experience in regards to shipping a boa recently that arrived a day late because UPS lost it. We packaged it correctly and placed only one heat pack in with the snake because it would be traveling overnight when the temp is lower. We found out it sat the day in Texas, where the temps were in the 80s. We were extremely concerned for the well being of our snake and the possibility that the snake was going to be cooked. However 24 hours later our buyer receives the snake and it was alive.
So Kevin is not the only lucky one there as stated by Lou. We have also experienced a longer delay without the snake being DOA in the last week. I agree something is not adding up as a 4 hour delay should not cause this problem.


It is beginning to sound like it is UPSs fault for not ringing the doorbell or even attempting to deliver the snake. If this can be proven then it is the sellers responsibility to offer a refund and take up the matter with UPS. It sucks Lou but shipping errors by the shipping company is neither the buyers or the sellers fault but unless stated in your TOS that you are not responsible for shipping errors then it becomes your responsibility to make it right. Had our boa arrived DOA we would have offered a full refund or replacement animal, whichever the buyer chose. You can't look at being out the money and the snake in this matter. You have to look at what kind of Customer Service you provide and what makes people to continue to do business with you. Even though it costs us now, it will be made up in the future.

Eddie, My advise to you for all further shipments you are expecting to have them delivered to the hub and pick them up from there. That way you no longer have to worry about the driver doing his job correctly. If it happens once, shame on you. If it happens twice shame on me.

Just my .02 as of right now.

If for no other reason than to save face. Ive had situations where ive sent back money if there was the slightest bit of a chance that I was at fault. If Ive learned anything in the last 10 years, its that my (or anyone elses) reputation is priceless. I would rather lose money than have an unhappy customer. Whether Im right or wrong, or followed the letter of the law or not makes no difference. Ive been the sucker on a few occasions but Im ok with that. TRUST ME, $200ish dollars a small price to pay for peoples trust...
 
I am not trying to get into the middle of this whole thing. I just want to say that i am the one in NY that received a bearded dragon from Eddie last week and there was no heat pack in the box.
 
Healthyreptiles do not die over a four hour delay!,unless shipped with 3 40 hr heat packs!
We have all experienced late calls by the UPS man that were hot or way Cold and delayed but Manageable with proper slow warming or cooling to the Optimal temps that the reps require.I want to ask and forgive me if I missed something but it seems truly the thing that Aided in the Death Was POOR Ventilation,which would cause a Animal to bake to death was their Air holes?
 
I am at work and typing on a phone, bare with me. if u look at the third pic there was one hole on the side, same hole on the opposite side. The box was securely taped on the top no holes on the top no ventilation other then the two holes. Idk if that helps.
 
Alot of us have had some kind of shipping error at one point or another. For something to die because it was 4 hours late just seems like a stretch. Maybe its possible the UPS guy decided to slam the box around some, or leave it in direct sun, or a freakin ghost went in there and killed the snake, I don't get how any buyer would be responsible to eat the money for any product/object purchased that was not received, unless proven to be their fault. And, as stated by someone else, if there is ever a DOA or some type of merchandise that goes missing because of the shipping company, does the buyer ever eat that .......NOPE!

Also, if the seller is claiming that he did not require a signature, then the package should have been left on the first attempt(error by UPS then obviously, and the responsibility lies with the seller).
 
Since nearly everyone agrees that it's pretty much impossible to determine direct fault on the part of either buyer/seller/ups I'd say the best resolution at this point might be a 50% refund. At least then they both lose out equally rather than just one eating the cost.
 
I told him that he had to get the package on the first attempt and his earlier statement in the other thread stating that i implemented the signature required option is false. Its was the drivers option not to leave the package.

I would like to know about this, also for my future reference. Is it UPS's policy that if there is no signature required option checked, that its up to the driver to decide whether or not to leave the box, or are they required to leave the box.
 
I really don't see any way it is the buyer's fault. It has been said by many people before 4 hours doesn't mean life or death with 1 heat pack. I believe that snake was dead 4 hours before it was delivered. I think if it were alive the first time they tried it probably would have been in so bad condition it still would have died. Good luck with everything and Lou I hope you realize you did something wrong and owe this guy a snake. Good luck!

I've actually had this argument with fedex/ups/usps. It is in all of their policies that it is at the driver's discretion on whether or not to leave a package that does not require a signature if no one is there to receive the package.

Every once in a while you'll get stuck with that driver that doesn't like to leave packages on the doorstep, sometimes even if there is a signed note on the door requesting it. But for the most part if you do leave a big note on the door telling them where to leave the package signed and dated, they will leave the package, usually without even bothering to knock because they just assume that means your not home. But that's probably better than dealing with the drivers taking the package back with them just because you didn't make it to the door in 30 seconds to get the package from them.
 
just for the record i did not receive word of the DOA until about 8 hrs after the first delivery attempt. first email bu UPS was at 8:07 am CST and i finally spoke to the buyer, after numerous attempts by ME by text and phone, till 5:39pm.

What does that matter? I would understand if it were 4 days later but whats the difference between 4 hours and 8 hours?
 
UPS's second email was at 1:47pm CST that the 2nd delivery was made signature was by "RIVERA". why would he wait almost 4 hrs to call me and inform me of the DOA. Check his previous thread time. why wait so long to call the shipper.

I don't like that at all. I think the note is a good idea, but I think maybe in Eddie's case the note would not have made a difference if the snake was already cooked.

The worst shipping problem I had was in the middle of summer, the dragon got delayed for a day. On top of that the box was put outside the house the following day in the sun and they never knocked, or rang the bell. The dragon was fine. I'm not saying DOA's don't happen, but I have said from the beginning something didn't make sense.
