I had appended this information to the "Good Guy" thread I naively posted about him, but I think it deserves it's own thread now.

I will try to include all necessary details, but please let me know if there is further information that you would like.

After some emailing back and forth, Matt and I sent up a trade for a red proven female mainland chahoua that I had listed on Kingsnake for a sexed pair of younger mainlands. We both shipped out on 7/28/11, as weather was the most favorable for both of us.

I received the chahoua pair from Matt on 7/29/11. They were shipped to a local pet store so my sister who works there could sign for them. I work at a large biotech company, and receiving the package here would be difficult due to the volume of shipments we send and receive on any given day. Recently I have been extremely busy with student loan paperwork and managing to acquire an apartment for this upcoming semester. I put both animals in their cages once I picked them up after work. One had a pretty noticeable underbite, which I didn't remember seeing in the photos he sent me, but took it as my mistake.

In terms of the actual shipping, it went smoothly, except Matt had some trouble finding the tracking number for the pair, and missed FedEx when they delivered the female I sent him. I called them, and they said they would attempt delivering again. He said he had to go pick her up shortly after, I'm not exactly sure what happened, but to my understanding he got her.

Two weeks ago I found out that my student loan wouldn’t get disbursed until mid to late September, but I am required to pay my new off-campus landlord by Sept. 1st. In a desperate attempt to come up with finances to pay out-of-pocket, I listed to pair for sale for an equivalent amount of money to what I had listed the red female. If I hadn't been presented with such circumstances, I would not have listed the pair.

*I will leave out names in this section, so as to protect the third party's privacy*

The "female" was sold, and I shipped her. Arrival was fine, however, the buyer louped "her" upon receipt, and found her to be male. It was my mistake for not double checking the sex on them, so I reimbursed him in full, and paid for shipping both ways. After the gecko returned to me, I sexed it with a loupe, and it is in fact a male.

I was at fault for listing the pair in a desperate attempt to come up with money for housing, however I have since come up with the finances needed for the apartment, as I was able to work out a small early student loan disbursement. That personal issue is unimportant regarding my frustration over this, and it really lies within the ethical handling of this whole situation. Two male geckos were not what I expected in the trade, and the worth of two young males is significantly lower than the female I had listed. I have contacted Matt several times in the past ten days, and have not heard anything back. I have family in Rochester (where he is), and even offered to schedule a time to meet with him locally to avoid return shipping costs. I would like some sort of response from him addressing this, but he has failed to come through, which is disappointing.

I deleted my signature out and reformatted the messages for easier legibility since Yahoo Mail doesn’t really provide a reader-friendly copy and paste format.

If I don't hear from you by the end of the week I feel as though I'm going to have to post something on the BOI. I don't exactly want to put you in that situation, and I'm sure you don't want to be in it either.

At this point, I kind of would like to just reverse the trade, since I'm not sure whether or not you have a female, and two males isn't really worth the female I sent. However, if you do have a female you could replace the one that is in fact a male with, I'd be open to that. I'm sure we can figure something out.

Hi again Matt,

I haven't heard back from you, so I was just wondering if you got my earlier email. The younger gecko appears to definitely be a male, I can send some pictures once I get home of the vent area. I was wondering if there was another female mainland you had that I could switch him for, since I think we both figured this was a male/female pair in the trade. If not, I'd be willing to give you back both of them for the red female I gave you, or a single PI female that you had listed on Kingsnake (if you still have them).

These things happen, especially with chahouas since they're tricky to sex, so I totally understand. Let me know if there's anything else you need from me. To make it easier, I will probably be visiting family out in the Rochester area soon, and could set up a time to meet you to avoid shipping costs.

Ahh I hate FedEx sometimes, they randomly left a package (of geckos) on my front porch one day this week without even ringing the doorbell. Luckily I didn't have to sign. I didn't know you would either. I put insurance on it, so that is probably why. I'm sorry about all the craziness! I could take some for you for sure, male gets dark green with nice dark brown and white spots female has alot of dark brown, black, and red coming in, but I'll get pictures for you

it looks to me like all the pics he sent you of the female hide the underbite...id be extremely upset with this transaction. i really hope he steps up and takes care of this.

Yeah, I noticed this too. Sure does need a resolution Matthew.
Hope you take care of this before it snowballs into something bigger.
 
It seems that there were 12 days between the time in which you received them and noticed they were male. I hope that isn't too long for the original seller to correct things. Either way it is something that should be fixed by the original seller since they were listed as females.
 
I don't know why 12 days passing would nullify the seller's responsibility to properly sex his animals. A guarantee that passes with time is a live arrival or health guarantee. Sex or a 100% het. is timeless.

I've been in a somewhat similar situation with a gecko that was supposed to be female ending up male, and the seller not wanting to answer me. I've since started video taping opening any package I get, checking weights right after opening, and checking the genders.

Do you know of any usernames he uses on different forums? Does he advertise on other forums? Did you notify him of this thread? Maybe that'll will light a fire under his butt and he'll realize this cannot be left ignored. I hope he comes through for you!

From all I can tell, he sells on Kingsnake under the name of "Matthew Palermo". I happened to find him on Facebook, and sent him a message after the last email posted here, but he hasn't replied back. He is a facebook fan of GuyCo Gecko and Supreme Gecko. Unfortunately that's all I have on him, and no phone number either. Besides that, I am unaware of any forums he's on.

I sent him an email regarding this thread, and haven't heard back still either. I'm pretty surprised, since he apparently keeps quite a few chahoua. It would be one thing to disappear keeping leopard geckos, since they have such a broad venue, but Rhacs seem to have a pretty narrow market. I think unless he sells them all on Craigslist, he'll have to turn up somewhere.
 
Hope you get this resolved. If you search for "Mark Palermo chahoua" this post comes up so he might want to start managing his reputation a bit better.

Regardless of the amount of time, he should make this right. With geckos either you know the gender or you don't. And if you're not 100% you shouldn't make definite claims. Also I agree the photos look like he purposefully angled them to avoid showing the under bite. How dirty.

I really hope things go right for you Kai. I know in the next year I plan to get some Chewies. It seems like if you cheat someone in one Rhac species you tend to blow your foot off with all Rhac enthusiasts.
 
Sorry I didn't update sooner, but Matt contacted me on Wednesday, saying that he had been out of town and not checking his email for 3 weeks. He said that he was sorry, and is willing to work out a way to fix this. If you'd like the emails between us, I'd be happy to include them, just let me know.

In short, we agreed on the following deal: I'd keep the sexed male, and I'd send the "female" that turned out to be male back in exchange for the female I sent him. I'd also send $275 and cover shipping for both of us (since I won't be able to make it out to Rochester before school starts).

I'm trying to figure out a time to ship with him, I'm planning on the week of 9/5, as I'll be out of town next week. I haven't heard back from him yet regarding setting a date for shipping.
 
Excellent, I hope it all works our for you and this turns out to be one of those few times that someone REALLY didn't check their email for three weeks
