One of the reasons I posted this thread was to show what (I have always thought that) the BOI is SUPPOSED TO BE. The initial thread laid out the facts and did not dive into paragraph after paragraph of hurt feelings.

I also did not liberally use commas and other punctuation marks in anapproriate places to make the post hard to read. Think about that Thomas.

The only issue is the gender as far as I see. And again, if it's not guaranteed, then he's technically within his rights.

The animal doesn't show characteristics typically associated with Aru island animals, but since those characteristics are expressed as phenotypical (and behavioral) tendencies rather than absolutes- that one would be a tough argument if the animal sent was the animal pictured. Certainly not ethical to advertise an animal as being locale specific when it's not but very difficult to prove, even if everyone can see what's likely.

Gender though... if it was advertised as being female and it's actually a male then one of two things has happened; an honest mistake which the seller will immediately correct since missexing happens OR the animal was advertised as posessing a characteristic which can be easily proven and, if it doesn't posess that characteristic, it was advertised inaccurately. Intentional misrepresentation of an easily proved characteristic is definitely badguy behavior and a refusal to correct an honest missexing turns it into a deliberate act.

He is not a scumbag because he can't sex a snake properly. He IS a scumbag because he will not make good on a deal AND I believe he lied about having "two local breeders" sex the snake before he sent it to me.

I agree with this statement and because of this and his "I don't care I am out of the snake business" comment is why I labeled him a scumbag.

Even if Peter does think the BOI and this entire website is a joke, at least he had the kahonas to come here after all that has been said and post his experience with a known liar to possibly save anyone else from being duped.

Was the payment through Paypal made from funds that were in your PayPal account or were they drawn from a credit card? if the latter, you still have the option of a chargeback through your CC company. Paypal doesn't approve of that but the important thing is to not let this guy get away with a blatant scam

I thought about that...

About $85 was already in my Paypal account. The balance was drawn immediately from my ECC business checking account.

I guess I could get the balance back ---- BUT the money would be sucked away from Paypal and not Melvin Efrece. That would then put me at odds with Paypal.

I think that Paypal is helping Melvin Efrece to rip me off because they are weak --- HOWEVER; I need the ease of using Paypal more than the $350.

Think about it - if I throw away my 'relationship' with Paypal it will become hard for me to buy anything from anyone in an easy way.

It sucks but that is where it stands. Really I am only angry at this scumbag's blatant disregard for sending me something that was mis-sexed and mis-represented.

He made a mistake and he will not make it right. Simple as that.

To those who say that it is not his fault because SOMEONE ELSE sexed the snake or SOMEONE ELSE sold it to him as an Aru I say --- take responsibility for yourself. Life isn't fair. Don't make someone else suck on it and then wash your hands of responsibility. You ARE responsible. Be a man - don't be a Melvin Efrece.

as i stated earlier the seller sold a mis-sexed snake, i feel he is/was wrong and should offer peter compensation or a refund but obviously he feels it was worth 350.00 whatever the sex definately someone id avoid if i was looking for a properly sexed snake, but then again i would have asked him ahead of time what his guarentees with regard to sex are? internet deals need that extra bit of communication to solidify the deal,there can never be to many questions or pics imho. anytime there is miscommunication things like this will happen its not bad or good simple miscommunication is what i see,,,,,,,,,
