    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

I agree that this feuding is silly. Like John I also have issues with Peter but that doesn't mean he should not be treated fairly in a deal.

Peter, while at it, those comments on your blog are childish. I know it's your right to make them, but that last paragraph is out of line and you know it.

Thomas, this thread is not about you and your feud with Peter. Take it elsewhere please. There's a lengthy thread with his name on it here on the BOI. If you have anything to add to it feel free.

but from the sounds of it the guy wasnt or isnt a vendor so much as a guy just trying to get rid of a snake, its a shame he felt the need to apperantly lie about sex but again had inqueries to guarantees of sex been solidified before money exchanged hands this wouldnt be here plain and simple my point is/was you can never ask to many questions before a deal is sealed,,,,,,,,thomas davis

I'll say it once more. No inquiries need be made. Once gender is specified, it is warranted if that information was part of the reason the deal was agreed to.

It is my opinion that anyone who made such a basic error and did not then refund, replace or give a cash difference is not someone who would honor further conversation; so the thread would be here nonetheless.

The guy did not deliver what he sold and then mocked me when I called him on it and he refused to make it right. It is proven in photographs and emails here.

I have written him off as a scumbag to avoid and posted this thread so everyone can know that Melvin Efrece is a lying, dishonest, no-character, piece of garbage and should be avoided.

This is one of the best laid out BOI posts I've seen in a while.

This whole thread just reminds me of how important it can be to buy off of known good guys. And exactly why I never even click on adds that are posted under a first name only.

I do in fact think that the BOI is a crucible:

Scams are exposed, complaints aired, and sometimes arguments get heated.
But there are times there are resolutions and differences of opinions.
I absolutely do not think that just because someone's name is listed on the BOI, that makes them dishonest.

If someone guarantees live arrival only....who is responsible for anything other than that? Wouldn't the buyer need to ask more questions and if he does not ask any questions or require a more detailed guarantee....is he not then responsible for the risk of buying such an animal?

As Jim posted earlier, wouldn't the seller be within his rights not to do anything? He only guaranteed live arrival....and indeed it arrived that way.
Would you Mr. Reid buy animal off the internet in which the seller told you that they do not guarantee anything other than live arrival?

Mike, in any transaction there is an implied warranty that the information on the product that has been presented is correct. In this instance, the locality of the animal is subject to interpretation. There is some phenotypical evidence that the animal is not what it was presented as, however, that evidence is circumstantial and difficult to prove as an absolute. However, the animal was not represented as "probably" or "most likely" a female, it was sold as a 100% definite female. Since it has been categorically proven to be a male, the seller has violated that express warranty.

Any ethical seller would refund without complaint. I strongly suspect that he would lose in small claims court as well in this sort of situation. It is a contract case plain and simple and the seller has breached the contract by selling a male animal as a female.
 
Yes, John...ethically I agree.
But if the seller believed it to be a female but never guaranteed it to be a female...
he is not liable. (My pops old me that, he is an Attorney) Just on good standards the seller should fix the situation. But because he did not guarantee it, he is not liable.
I believe peter stated that the person post the snake to be female ( a belief) but did not write 100% definitely female as you stated.
