    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Mike Clark (serpentboy78)=BAD GUY!

Mike (MJC), I can understand standing your ground the first few days of this whole mess, but as of now, it looks like unfortunently David got scammed on this. I'm sure you didn't mean or know you sent him a snake that you knew was going to die. However, it's time you end it, and just paypal him an amount that he wants OR send his snakes back to him. These kinds of things get pretty nasty, it's normal, but things can still work out if you do the right thing. Sometimes **** does happens, and you've gotta clean it up - do it.
 
David's actually best off NOT giving you the paypal address...

Even ignoring the issue of potential foul play with his paypal account, if he were to accept ANY payment prior to making an official arrangement for the amount and/or schedule of payment it puts the entire thing into muddy legal waters. Not that I think David is going to be taking this to small claims court anytime soon but there it is... Any payment made without an expressed agreement about the amount which was to be offered then turns the entire thing into a debate about what the agreed upon amout was to begin with. If Mike had paypaled over ten bucks, he could then later claim that a full payment was made based on a verbal agreement that never actually existed and it would be his word against David's.

So... Any claim that "an attempt was made" is absolute and utter CRAP and David did the smart thing by asking for clarification prior to allowing any payment to be made.

Good point Seamus...Mike, like I stated on the other thread, just bite the bullet and send David a money order via usps. You may not want to do this, but it will be money well spent if it can salvage your name.

100% would be the best way to go on mike's part...but perhaps these 2 can come to what the terms will be on their own....but..then again...maybe they can't...lol....
 
Something is still gnawing at me.

David was unhappy with the animal. Mike told him to ship it back and eat the cost. David did not feel he should pay for return shipping, nor did he think the animal was healthy enough to make the return trip. Mike was adamant that the snake was healthy, and thin only due to brumation. David agreed to fatten it up. They both agreed that to complete the deal David would send his part of the shipment. David shipped, Mike received, and David's snakes were fine.

Sounds like all is well.

The snake Mike shipped is DEAD. Mike, you've reverted back to saying that the snake should have been returned. NO! You reassured David that the snake might be skinny, but was healthy, and the two of you agreed to complete the deal.

I don't believe you shipped a snake that you knew was not going to make it, especially since you shipped first. I'm not accusing you of being a scammer.

I believe you misjudged the health of that snake.

For that reason, I believe that it would be best for your reputation to negotiate some sort of compensation to David to end this transaction. Mistakes happen, it's how we deal with them that matters.

I realize this is heated between the 2 of you, so it might be best for both of you to stop reading this thread, wait 48 hours, then communicate via email. A week ago, you both thought well enough of one another to trade animals. Take a step back and try to get back to that point.

bottom line, the day you sent that snake, it had 3 day to live. the FACT is that snake died 3 days later.

I guess that means that snake was on it's deathbed, just like david said. YOU WERE WRONG, mike.

and his statement about being a different snake....if i said that you were a completely different person a few months ago with the Dan situation, would i be lying? would i be stating that it was a totally different person that was responsible for shipping a hot via ground service? nope mike, it was you. and perception is key to my statement. You were an honorable vender when you gave that guy his money when a big name vendor confirmed the snake was dead. david has given you proof and you refuse to honor the deal.

Thank You for piecing together in the correct order, a nice succinct, correct condensed version together for us. I too, bow to your superior intellect.
 
I wish that myself and Mike could come to an agreeance for him to reimburse me for the snakes he received. However, it seems he is "standing his ground" and his foolish pride is getting in the way of doing the right thing.

Instead of being a mature, honest individual, he instigates and plays games (per our AIM conversation last night). He says he gave me one chance (one chance for what, exactly-he never said) and I "blew it." Fine, whatever.

I have said several times what I feel would a fair resolution.....take the amount I was asking for the Milksnakes ($150 shipped) and subtract from that the amount he spent to ship me the deathbound Kingsnake. I estimate that to be around $110-120. However, I feel I will never see a bit of that money due to the ethics and morals Mike has exhibited here on this board.
 
I have to say this continues to get more disgusting day by day.

Mike, you sent a sick and dying snake. Whether you knew it or not, take some responsibility. You have already ruined your credibility as a business person and I would think as a person in general. David has offered a reasonable arrangement ($150 minus your original shipping costs). You should seriously consider it and salvage any good reputation that you might still have left.

I really hope this isnt a lost cause. you made good on a deal before, mike...without photographic proof of a dead snake. you have your proof here. you have reports of a snake that appeared to have major health problems. you assured him the snake would be fine. the snake died. you saw pictures.

why would you want this to continue? do you see the numbers of people reading this thread, and the other one? even people that were on your side in the beginning are starting to see that this deal isnt fair to both parties. people who weren't posting before on the david beard thread are reading this one and posting now. these aren't david's friends. i've never heard of most of them. they are people witnessing your attitude as a businessman, and they will remember your name.

please make good on this mike. the amount of common sense you use to make good on this deal will go miles in the eyes of people that may consider doing business with you in the future.

And if you shipped it right after it came out of brumation, it was lethargic anyways. So it would have been hard to tell it was sick. Honestly, I thought the snake looked a little skinny, but not like it was going to die. Maybe it had other complications? A friend of mine had a grey banded kingsnake, that unexpectedly died. For no real reason at all, the thing was 100% healthy. Crap just happens. So mike just send him some money or the snakes. It truely sucks, but you need to look at his situation, he has nothing. He traded you from what he says, 2 healthy milks. Well i'm tired of seeing this, just do what you know you need to do mike. Gooday to all. William H.

I wonder how many people its going to take for Mike to see that what he did was wrong? I have heard nothing from Mike since our AIM conversation 2 nights ago. He has made no attempt to rectify the situation as of this point in time.
 
i'm learning a whole lot about name recognition. when i saw the name "greenpinemuseum", i thought that name looked familiar. when i saw your other post on the other thread about "david beard...send me my snake", you had told mike to not send david anything and let it blow over. it really says a lot to look at this again, think a bit harder about who is actually the one bearing all losses, and speak up. you are yet another one that originally supported mike but have since changed your mind. that says a lot.

going back to name recognition...how many people are seeing the names mike clark, serpentboy78, and www.serpentboy.com and will remember this transaction from reading about it on the boi before deciding to purchase something from him?

william, you're absolutely right about rep. when i see 2 similar snakes for sale, for about the same price, name recognition, customer service, and rep will determine who gets my business. Ask anyone in the business that has a bad rep if they would pay $100 to get that rep cleared...i'd bet many would be willing to. That's such a small price for all the impact something like this causes.

as of right now, there have been a total of 10,540 views (including the david beard thread) of this transaction. that could mean a lot of business, mike. i'll take back everything i've said if you make good on this transaction. it wont change what's happened so far, but the end result is what people will remember.

You wanted everyone’s advice when you posted the first thread. I initially said the snake looked thin but does not warrant saying it was a different snake. I think David cleared up what he meant.

The snake has died and you have proof. You need to resolve this.

Borrow a jackhammer and get rid of those concrete shoes ;) they will only drag you to the bottom. People that seemed to have a strong, solid reputation have disappeared from the herp scene in a matter of days just because of their unwillingness to do the right thing. Don’t let this happen to you too…it’s better late than never!
