So has anyone had any resolution to their issues with him? I got his attention now and now would be a good time to address other people if you want I can mention things.

I have a question to ask also for your opinion on.

I traded $4000 worth of animals for albino het for anery male adult boa and being fighting for 4 months to get papers from him and now that i got his attention magically he says he is sending out paperwork this time after 3 excuses when i have been lucky to reach him on the phone not to mention he doesn't answer emails. He said over the last 4 months that he has been too busy to send out papers on the albino. I can understand being busy but 4 months of excuses, sounds hard to believe.

On the same hand he sent 3 adult female boas ( big regular female, DH for snow so he says, and ghost boa) on breeder loan and now possibly two females are Gravid. What should i do on $4000 albino boa that is now worth $2000 and with having some breeding possibly going on here and if not then he gets back a couple animals wondering about keeping one of the boas to make up the difference or how I should handle it.

Need your advice on things. Thanks for your help and thoughts.

So is the boa not het for anery? High end morphs do go down in price. What did you mean by this statement? Are you getting any babies out of this deal? Which boa do you think is worth keeping?

The DH for snow if it is that would be too much dollar wise, the regular boa is only $300-500 and the ghost is about $2000ish for adult females so we were looking at the ghost even though we don't have a male for her right away. Albino het for anerys or stuff in the snow market is not going down alot and surely a breedable albino het for anery is worth alot and you can actually get adult male albinos for $ 1500-1750 I was just putting what we got the albino for and what the market is usually on adult males. I am just asking for advice on this matter is all.

Matthew.... At this point, you don't have to do a thing but wait.... Right now, you have an Albino that's POSSIBLY het for anery which you paid around $4000 for.... BUT, you've also got about $3000 in COLLATERAL with the other three snakes.... Now, since those three are on breeder loan, I'm ASSUMING that you plan on breeding each of them this year??.... I'm also going to assume that you are going to breed the Albino this year.... Even without the "paperwork" on the Albino.... IF IF IF she pops out some Snows, it's a no-brainer, you just continue with your agreement on the breeder loan.... BUT, if the Albino DOESN'T pop out some Snows, THEN you can make a decision what you want to do.... YOU are in the driver's seat right now, why sweat it??

You guys are far better at deciphering gibberish than I am. I read his two posts three times and have absolutely no idea what the situation is other than that he has not received papers on the male.

Matt

Take a deep breath and then put the situation down in detail so we can give proper advice.

Matt,

If I was in your shoes, I'd keep the females that he loaned until after you verify the paperwork from him. The man has been handing out excuses left and right. Busy or not he seemes to have a lot of time to call other people trying to sell this and that. But when you actually need to get a hold of him, after a deal, he just seems TO busy to answer his phone or emails.

I think you're better off then the rest of us in trying to get him to complete his deals. He has yet to respond to my emails and calls. If you talk to him ask him whats going on with his deal with me.

I remember Mike trying to sell those same females to me. Then I remember the whole story about where he got the DH snow female. Look up Stuart or John McDonald on the BOI and you'll see what I mean.

If you don't mind, when you talk to him ask him about his relationship with Dana Shields. I'm just curious to know if thats his girlfriend or a guy he claims to be his business partner/customer. Good luck with getting things worked out with Mike.

I will surely mention people to him if you guys want me to I am just looking for advice on the situation. One of the things that I forgot is the reason I am asking was because he was asking for the animals back on this matter cause I didn't trust him is how he put it. I am just looking for advice on a potentially very sticky situation and want to know you guys think the right thing to do is. Thank you for all the info so far and advice on this and will keep you guys up to date and if anyone wants me to talk to him let me know and send me an email or call me with details so I have everything straight. 507-474-0172

Hold on everyone. Keeping those other snakes as "collateral" is risky at best even if this guy is a thief. After all, those snakes are sent to you on "loan" and if you keep them he could argue that you also are a thief. Criminal activity does not justify criminal activity. Unless it was part of your agreement you cannot simply choose to keep one or more of his animals.

As much it pains me to say it, and as much as I believe the guy may have ripped you off (and said so in the other thread), that would simply be the wrong thing to do. If we (as a business) are to be considered professional then we must act as professionals.

Here's an analogy from my business. I own and manage rental property. Let's say a tenant goes away to "sleep away camp" for six months and leaves me being owed $1000. When I enter his premises I find $1000 worth of electronics or even cash. Am I allowed to keep it and say we're even? After all, the goods were left in my possession. The simple answer is no, I am not. In fact, I have a responsibility to store it safely for a year and return it to him if and when he asks for it, regardless of what he owes me. Of course this is a slightly different situation, but the concept is the same. Keeping those other animals without a court's approval to do so would be taking the law into your own hands and (sadly) would be illegal.

I would hold off on returning the snakes if they are gravid, or was that the deal? Get the girls pregnant than give them back. If you stress them out too much in the move you may lose the clutches. First think of the health of the snakes and their clutches and follow through full term.

Are you getting any babies out of this?
What was the agreement you made with him over the breeding loan?

Aside from the Albino part of things the deal on the females was a 50/50 split on babies and return females after babies are born. What should i do for the albino if he doesn't prove to be het for anery and then still do a 50/50 split on babies where then he has ripped me off on things???????

Matthew Martin

Before you go counting and splitting babies that haven't been born yet you need to stop and consider what YOU want to do.

This guy seems to have ripped you off. You do have a deal with him on the babies as yet unborn though.

Keep all the snakes until they produce. THEN decide what YOU need to do to be happy with this deal.

Possession is 9/10 of the law. You do have that going for you. Prove out, or not as the case may be, the female in doubt and then take care of that situation once you know if you've been robbed or not.

You're going to have to wait and see, that is if you want all your ducks in a row before you do anything.

After reading the original posts a couple of times, I too am a little sketchy on the details. But I think I have the gist of it. Have to agree with Wes that "possession is 9/10ths of the law", and downplay concerns about setting yourself up for criminal action. Since you were willingly shipped the animals as part of a breeding loan, its a civil matter, and you are in a position to muck things up pretty good, claiming that the breeding project is still ongoing. Should a civil action be initiated against you, it will take far longer to resolve than the time that you need to produce offspring and prove out the animals. You have some leverage now, why give it away without getting satisfaction? In all honesty, $150 on a local attorney might be money well-spent for your own peace-of-mind.

Matthew, I forgot to add one more tidbit of out-house legal advice. An attorney will likely advise you that the last thing you want to do concerning a matter that may come up for civil litigation is post your thoughts anywhere except his or her office, and especially not on the internet and the BOI. You will also probably be advised by the attorney to do your utmost to seek a resolution short of a big pissing contest and court.

I had a breeder loan go south a week ago.. Thank God I have a lawyer (prepaid legal)!!!!!!!!! He is looking at the contract I had with the "breeder/scumbag" right now to see what type of monetary compensation I will be able to get.

Micheal has yet to call, or email me regarding the 150 dollars he owe's me for the DOA female ball python he sent me. The terms where live arrival guarantee. None of the rest matters to me but the 150 he owes me. Ask him about Chris Altizer and the money he owes me if you can. Also, if you would like, please send me a PM with the phone number you contacted him with. Thanks
