You are NOT trying to say that timmy did NOT inject the snake he sent to Matt with ALL THAT FLUID are you? There is NO doubt that timmy did indeed do that. There is no doubt that Matt paid up front for that animal, and the fact that it was not timmy's usual policy is an issue I won't even touch right now, and that IT DID TEST POSITIVE for the virus it died of.

I think after his little tantrum, after if I recall correctly timmy tried to send bobby to jim's house to TAKE the snake WITHOUT jim's permission, that it was all of 4 or maybe 5 days, possibly less, before jim said here that he was not serious and appologized for his anger and stupid words.

You tend to use partial truths to say things that aren't true. You back up known liars and scammers. You've been caught here and in TRR lying about this issue.

Why can't timmy speak for himself? He has managed to be QUITE creative on other sites, his photo shop skills are classless but he has them. Ahhhhhhh, perhaps he has some photos of you that he has "FIXED" up like the ones he had of Matt and you're just trying to make sure they never get out. Or maybe they weren't "FIXED" at all and you're trying to make sure they don't get out.

I just don't get it. You HAVE to know timmy is bad. Why do you keep trying to make him look like the good guy/victim?

I also did not quote where the original deal stated that Jim was supposed to help finish off his basement as part of the payment. Jim did not do that either

I got sick and tired of Bobby's crap and Tim telling me what to do on this matter and I e-mailed Tim and told Tim that I did not have the snake anymore because Bobby picked it up and then 2 days later told him I still had it and then threatened to stuff it with such a big rat that it would puke every time tim sneezed. I would never do this but told this to tim because I was sick of him and bobby's demands.

That is when Tim said he would not take it back.

I called Tim yesterday and told him I was just going to end it and payfor it after I recieved a e-mail from his 5 dollar lawer here is what he said. You would have to flip the email around this is his responce to my e-mail back to him

Mr. Scharphorn:

I'd be happy to talk with your legal counsel and am obligated to do so now
that you have advised me that you are represented. Please forward this
message to your attorney and ask him/her to contact me. Please also provide
me with your attorney's contact information. Unless you advise that you are
no longer represented by counsel I can not communicate with you further,
other than to serve you with a summons.

Tim will not credit you for return of the snake. As we discussed, you have
now had the snake for more than a month, you have threatened to harm it, you
have repeatedly been dishonest and reneged on your agreements and you have
sick snakes in your collection. Under the circumstances, I don't know a
reputable breeder who would accept the snake back. Tim will not credit a
return of the snake and, in any event, is unavailable on Tuesday to receive
shipments.

Given your stated intent to, once again, go back on your word, I have
advised Tim to move forward with filing a lawsuit against you.

I then e-mailed Tim and asked for a invoice or a bill from Arboreals of the rainforst for the snake in question and Tim e-mailed me back saying that he could not talk to me and everything had to go threw his lawer. so I emailed back telling him that to have his lawer send me a bill and I would hold off on sending payment till I recieved the bill.

here is all the e-mails between me and tim. except for the very first one or two. for some reason all my e-mails from corrallus are gone but lucky enough Tim posted some of them from his side of the fence.

Yes Jim she is in perfect shape. Never a regurge issue, snotty nose or runny poop.

Further more, Bobby Pruett has all legal rights to collect this animal for me and has contacted you on several occasions to do so. Cell phone records will prove that you contacted him as well. Your refusal to comply only serves to further strengthen my case of theft by deception against you.

and be done with it.I wouldn't
worry about Tim's threat's
because he is the one that is misrepresenting the animals that he is sending out.In Matt's case
I would even call it criminal
behavior.For him to threaten to sue you is interesting in itself
because of the way he has acted with Matt.Cowardly fool would describe it better.However Matt
can take care of himself.His case is open and shut.
However you situatiom is a little different, and your deceptive emails are not in your best interest.Bottom line is
if you plan to keep it get it tested and then pay or don't pay
depending on the result.If you don't want it,send it back, and then be done with it.That's why
I recommend testing the snake
either way.Tim's behavior is what makes this necessary, his
willingness to send out sick animals.Test it, and then act
accordingly.Tell Tim honestly
what you plan to do, then do it.
Ignore his threats until it's done,then do what is necessary.
I recommended this course a long time ago, and you still are still goofing around with this.Make a decision, use your head,and do what's right.It's really not that hard!

I'm betting it's a friend posing as a lawyer.

Jim,
Ask Tim's "lawyer" for his office address and phone # so your lawyer can get in touch with him. Is it common practice for a lawyer to carry on conversation with the person being sued over email??? Is Susan Smith his paralegal?

I would get that animal tested ASAP! If the snake comes back positive for the virus that would kill any case that Tim has. The longer you wait to have it tested, the easier it will be for Tim to claim that the animal contracted the virus in your collection.

I am not 100% sure.. but.. I believe if you read back through the posts.. he stopped posting when Matt brought up legal actions. Tim's legal counsel advised him to no longer publically post what information he has on this case Matt decides to still pursue a lawsuit in Ohio. While it is not fun for the discussion here... its does make sense.

I really challenge you to quote (or just give me a page number) of a SINGLE POST BY TIM where he acts like a mature adult and answers the primary questions posed to him, because although this is a hefty thread, I can't recall a single one where he actually acts like an adult, or even acts like a screaming baby answering the question about hte Sub-Q fluids. He never EVER responded to the original questions at ANY point in this thread. I guess that is part of what makes him so .... slimy... and anyone with the eloquence, intelligence, and education that you so obviously possess Scott, who continues to side with him must be one who enjoys, condones, and perhaps even practices such nefarious behaviour as well. I have seen NOTHING that would show Tim in a good light. Heck, even if incontrovertible proof were brought to bear that Matt had a stuffed animal tested for Paramyxo and it came up positive, that would STILL not change my opinion of Tim, because he has already branded himself and there is nothing that will change that.

My opinion anyway.

Is there any update to this matter? You keep adding to it with nothing really to say. Have you filed suit in Tim's state? If you mentioned it earlier, I apologize for missing it, but all I ever see is rehashing of the same old information.

Hey Melissa,

Actually there is really no update to the matter of me getting a refund for the snake I bought from him that subsequently died .

At this point, I have not filed a lawsuit against him in the state of ohio.

In my previous post though I was referring to all of the posting done in the previous 10 days, but I think some have been bothered so much by certain individuals actions they may feel the need to speak out on occasion. That is something that I personally have no control over.
