Hey Darin,

Not a problem....probably just as much my fault for not being clear! Besides me deal and now Jims deal with the breeding size/not breeding size animal another recent deal has come to light. From what I understand Tim sold a male northern to a very prominant breeder. He got a cage together and when approached Tim for the animal he came to find out that Tim sold it to someone else. When he asked what he was suppose to do with the cage he bought for this animal he was told he would have to put something else in it. The breeder did not pay in advance for the animal but he still got shafted. But there is just some more proof that something was going on and thats why I had to pay for the animal in full before receiving her. Another guy that didn't have to pay up front...hmmmmmmm.

Yes Jim did get an emerald from Tim that would be 'breeding size' this year. I think at 700grams Jim you have about two years to go before she will safely be big enough! Was the purchase price based on her being breedable this year?

Yes I strongly told Tim more than once that I was only buying the animal for breeding purpose this coming season and he asssuered me it would be big enough.

I have the e-mails to prove it.

I now have to find another one because this one will not be ready.

Truly Sad.

I was staying out of this thread with great hopes that Tim would do the right thing.

but in the end we get the following FACTS.

He asked for money up front on this animal....But did not ask for any money up front on the others..... hhhhhmmmm fishy.

He makes sure you understand that if shipped UPS he takes NO RESPONSIBILITY.....not too fishy happens all the time.

Then You get an animal that the experts and the vets say was sick / is sick for a very very long time. And is quite obvious it was injected with fluids.

Then he blames it on the shipping company (UPS must have opened the box and shot the animal up with the fluids.....common practice with UPS I guess)

And now he gets a lawyer because HE decided to sell you a VERY VERY sick animal.....nice move Tim

Then he sells a "breedable" female to someone....and it can't breed for another 1-2 years......nice one tim


With the aforementioned FACTS. It is my belief and opinion that NO ONE should do business with him.

TELL THAT TO THE CRUMMY LAWYER WHO IS STUPID ENOUGH TO TAKE YOUR LOSING CASE!!!!

I hate to say it.....and I also promised someone I would not say his name in a negative light.....but here goes.

you never sease to amaze me in your words! On the flip side, I cannot agree with you more.

On another point, I really wonder what kind of lawyer would take a case that has PROOF posted on a world wide forum for everyone to see that states knowledgable and VET opinions (after tests as well) that Tim sent Matt a snake that was put in this position by no means natural (how is that for run-on sentence...lol).
Whether this lawyer is a reptile "guru" or not, the evidence is STACKED HIGH against Tim. Just seems like Tim hired the same kind of guy that TIm is being...........one who is after someones MONEY!!

I e-mailed Tim about the size of the snake and he offered no solution but to feed it . It will surprise me with weight gain.

I feed her last night and she is a good eater.

1 thing I have noticed is she has a very big head for the size of her body.
I am hoping she does not have parisites. And I need to do a fecal to find out, after she gives me some.

Matt sold this animal to Tim about a year ago and it would have been nice to know what the weight was when Tim recieved it.

Well Matt , the way i look at it,,, if has a lawyer,,, don't let his retainer go to waste, sue him and recover your money. i am sure because of the amount of money it is a felony. and with the evidence you have, it should be an open and shut case.
by the way how is the snake doing..?
i know it would be a pain to sue him, but it is worth the pain to show him that he cannot do people like this and just"walk away from it" for the amount the retainer probably cost him, he could have thrown in a few more dollars, and just done the right thing... kinda funny huh,,?

I do not know what I am going to do. I did make a deal with Tim even though I was not sent what I expected. I will see when I get a fecal sample back. If It is sick then I think that that cost should come of the top. Tim did say it was perfectly healthy.
I do not want my head on the chopping block for a lousy $600

If you had an agreement for a ready to breed animal for $600, and what you got was an animal that won't be ready for a few years, it's obviously not worth $600, parasite free or not...

Anyway, good luck with whatever you decide...

Sorry again Jim! Have her checked for cocci and spiral bacteria for sure and if I were you I would take all the vet bills off the purchase price! It's only right after seeing what he did.

First off I would like thank Matt for saving me the possible heartache and trouble of dealing with this person. I have been saving and pondering for a couple years about buying an ETB but I wanted to make sure I had the perfect set up and all the info I could muster before buying because I don’t have a lot of money being a NURSING student and working fulltime and going to school fulltime to finish my BSn (4 year science degree with nursing emphasis) I wanted to make sure the snake I was getting was going to be perfect so that my inexperience would not be so brutal on it. Have looked at many web sites and since I have seen tims post on this board I decided from his post he must be a good guy so I went to his web site and looked and found a northern female that is still on is his site. I was planning on calling him today to enquire about buying the snake and just by chance I sat down to call and flipped the board open to read little and I see this thread. Thanks to this thread and matt I will won’t be buying from tim.
Here are some points I would like to make

1) I would not discuss any further on this board Matt about this subject unless your lawyer has read your post. While you may think that your ok some off the things said can be used against you when taken out of context layer spins ect…

2) I have used ups many times to ship and receive live animals and I have NEVER had a shipment past 10:30 AM NEVER had a box damaged and NEVER had a DOA

3) It is clear this snake was pumped full of SQ and the vet report while some may not fully understand it states clearly the animal was sick well before shipment (bacterial infections ect.) there is NO doubt this animal was only made worse by shipping it in its condition and its condition upon arrival was NOT from shipping conditions.

4) file suit as you may or may not know a law suit is filled on your credit report in the case of a judgment, but when creditors see that a layer has been pulling your credit reports they will run like wild fire from extending credit.

5) this is a pathetic case of misrepresentation, fraud and I would say animal abuse, I also wonder if tim being a nurse has made his employers aware that he keeps and handles reptiles, this is pretty important if he works in pediatrics where salmonella can be fatal to infants and immune surpassed people, not that he doesn’t take expert care of himself to make sure he is free from bacteria and the like but his employer should have known this fact as it is up to them whether to allow him to work around these patients or not.

6) matt should be refunded EVERY SINGLE PENNY vet, shipping all of it I urge you Matt to file suit

I don’t know either one of these people but if this case was presented to me with the documents I have read here and I was on the jury I would have no doubt in my head about rewarding Matt every single dime he was asking for, as well as pain and suffering time from work what ever he was asking he would get.
