I am wondering though, if Tim is getting completely out of snakes, which I have heard he is, then what does his reputation in the herp community matter?
I do believe there was intent from the beginning to defraud Matt based on the information that has been posted. Now, do I think I know EVERYTHING about this deal? Not at all. However, based off of what has been posted, it appears to me that Tim was out to pull one over on Matt.
Let's look at it...
1. Tim required that Matt send him the FULL $2500 upfront for the animal. However, he allowed Jim S. to get another snake from him with only a small downpayment. I also think Matt had worked out numerous payment plans with Tim as well, right? To my recollection, Matt is not known for stiffing people, so why the sudden need for his money NOW? Makes me think he wanted to be SURE that animal was payed for in full before Matt saw it and would withhold further payments.
2. Tim was adamant about there being NO guarantees with shipping UPS. Granted, I am no big fan of the overnight carriers myself, but for a $2500 animal, I don't know ANYONE that wouldn't offer SOME kind of guarantee. I also don't know very many people dealing with high end animals like that that aren't using the airlines. Now, granted, Matt could have chosen a different method, but if there were NO other methods offered than a UPS with no guarantees, what else was he supposed to do? Sounds like a set up to me, at least.
3. The animal was injected with subcutaneous fluids to mask severe dehydration and illness. Tim blamed UPS, therefore, voiding what little guarantees there were on the animal. Last I checked, opening packages and then injecting their contents with fluids was not normal operating procedure.
4. Tim later says Matt sent him the snake sick. Tim can't make up his mind.
There is more I could type, but I'm tired. I am sure there was a reason Tim sent Matt that snake. Be it anger or what have you, I believe based on the information that has been posted here that Tim intentionally defrauded Matt.
