Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them.     Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Neil Gubitz - Good guy

Would it be fair to just send the $ instead of taking the chances on the credit as I dont want to get my heart broken on another sick animal or have to worry about loss of more money?
 
Personally, I think you should get your money back plus! You have a medical trail. Even after the warranty, there are medical problems that did not start with you.
I am also not happy with the its "only" 349.00. Hello, hard earned money is hard earned money no matter how you look at it.
BUT this is just my opinion.
 
I had a deal to buy three beardeds from Neil. A day or so before it shipped, he told me that one of them died, and said he would send a check with the animals. He did just that. A couple of weeks later, after both lizards had stopped eating and were losing weight, a fecal showed them to be crammed with coccidia. They hadn't been eating, so there was actually almost no stool in the syringe, but there was enough coccidia in the water that was pulled back out that it was obvious. They both died soon threafter. I didn't bother contacting him about it as it was after the seven day period and there were others who were others at the time who were having a hard time securing their recompense from Neil.

Did you do the fecal yourself or have a vet do it?

It was just before he sent the infamous pm. He did send a check for the one that died before shipping. My vet did the fecal. I don't have the equipment to do it myself.

Only reason I posted was because someone posted about getting some dragons from him and how the deal went well, even though their dragons had problems and one died.
 
Late last night I received an email from a user named Sybella complaining about having received harrassing emails from Neil Gubitz though the email capabilities of this site. She has sent me copies of those emails, and I concur with her assessment of them as being harrassing in nature.

On April 22, 2003, Neil engaged in similar conduct in a thread either by or from Corey Sawyer. After that incident I sent Neil the following email:

You know, Neil, if you continue to harass the users of my site using my message board to do so, you will leave me no choice but to block your access to it completely. Do you want me to post this on the BOI and ask for other instances of such abuse to make a case for doing just that?

What you do via regular email is your own business, but using the email capabilities of my message board puts it squarely within my court to have to do something about it.

Apparently, Neil has decided to put this back into my court so I have to do something about it.

I have done so. For the second and final time, Neil has been banned from this site. The "semi-ban" apparently was not good enough.

Sorry I have to do this, but I could see little else I could do at this point.

Even if somone posts negative things about Neil, he has made the bed here that he has to sleep in.

Maybe this is obvious and my apologies to you if it is, but when a seller gives credit towards a purchase the seller is not taking money out of his pocket. Depending on the margin between how much the seller actually paid for that animal, and how much he is asking for it, he might still be making money when selling you the snake even after giving you "credit". Example a seller buys a snake for $100, and puts it up for sale at $300 plus shipping. If this seller gives you a credit for $100, this seller is still making $100 out of that snake.

Hi Alvaro, Great post. I believe Shy4574 knows this and that is why she is asking for the $$ that I believe Neil owe's her. I don't believe for one minute that she infected her newly purchased snakes with HOOKWORM. She might want to post the vet report even though this may only get her some more "credit"

What he did was out of line (the ugly email) and I don't understand why he did it, either... This was probably Neil's best chance to get back on the board and he blew it big time. I know some of you are relieved. I'm just sad it all happened.

Its clear that you are not going to get any money back from Neil. This is what I would do if I were in your place. I would check out his website. Find out what his cost for shipping to you would be (it should be easy he claims to have it posted) subtract that from the$100.00, find an animal for that amount that interests you, and just tell him to ship that one. That way, you still get an animal and you are not out anything else, plus you use the $100.00 credit.

I just love that way of doing business. I ordered a dozen baby corns (plus some frogs) from a large CA wholesaler shortly after I bought my store. Their guarantee was for live arrival and any refund was done via credit toward the next purchase. Well, two arrived dead and over the course of the next week three more died. He called me the next week to see if I wanted to order anything else, I told him no and explained about the snakes. He asked why I hadn't contacted him right away about the DOAs for the refund, I simply explained to him that after receiving one load of crap from him he was crazy if he thought I would be stupid enough to buy anything else from him. I didn't have the option that I explained to Dawn as they had a $250.00 or something like that minimum purchase. Plus the two DOAs only came to about $25.00. He said they wouldn't do anything about the three that died later.

My point, If you can't send me decent stuff the first time (which I would think they would be extra careful to do) why would I buy more stuff from you.

If Dawn has currently other herps in her collection, there is always the potential of health risks that could eventually lead to additional veterinary bills? She might end paying more than those $100 and/or even loose some animals. It seems that in this case $100 in cash would be more desirable than $100 in credit.

Dawn, given neil's track record I wouldn't take anything from him that I didn't see first and have someone else look at to verify it's in good outward shape if you're inexperianced. Apparently he does go to some shows. Just show up at his table and tell him you want whatever animal looks good and is at or near the credit he gave you. Letting him send you something, judging by the emails that I and many others have gotten, would not be smart. Who knows what you might "accidently" get if he's unhappy with you. Heck from the people's stories that are now surfacing, who knows what you'll get if he IS happy with you.

And if he sends you anything else, and the one he sent you recently, post them here. Some people are REALLY thick skulled and need to be pummeled with the truth before they believe it.

My sentiments exactly. Nothing against Neil-don't know him, never done business with him, and in fact sometimes I think he can be pretty funny. But if I'm unhappy with someone or their product why would I want a credit towards more of the same.

I wanted to say thanks to all of you. You've been great support, help and wise! I still have the male and as of today he is going on 3 days and no regurg yet :) My fingers are still tightly crossed though..
Not sure what i'll do ( with the credit) cuz I do have others I don't want getting sick.. I don't think it's fair that people get S*%#@ by people selling herps that are not well but with this board at least some are saved..

Good points, I can see where some people might send you a load of crap, or a sick animal just to say "try to get me to do what's right will ya, This will teach you)

If you can get to a show he is doing that would be the best thing.
