2. Commencement of Action: In the event legal action is commenced between UPS and the Buyer by either party regardless of cause, Buyer agrees to indemnify and hold harmless the Seller for any and all liability or expenses and to reimburse Seller for any legal costs necessary to defend Seller from any legal action brought against Seller resulting from legal actions between UPS and Buyer.

3. Buyers Assumption of Risk: Buyer accepts the inherent risks associated with shipping live animals or reptiles. Buyer agrees that neither UPS nor Seller guarantees the live arrival of animals or reptiles delivered via UPS. Buyer agrees to indemnify and hold harmless the Seller for any and all liability and to reimburse Seller for any legal costs necessary to defend Seller from any legal action brought against Seller resulting from a failure to successfully receive or deliver live animals or reptiles as a direct result of the Buyer utilizing the Services for transportation.

4. Buyer’s Additional Release of Liability. Buyer voluntarily and knowingly assumes all risks associated with the use of the Services and agrees to indemnify and hold harmless the Seller for any and all liability or expenses and to reimburse Seller for any legal costs necessary to defend Seller from any legal action brought against Seller for any of the following situations:

a. Damage to Buyer’s parcels resulting from the use of the Services for shipping;

b. Financial loss due to any errors or omissions regarding credit card or payment transactions

c. Financial loss due to Buyer’s or Seller’s cancellation or non-compliance with UPS terms and conditions, and;

d. Legal or other actions resulting from, or taken by, Buyer, Seller, or UPS in relation to Buyer’s purchase of The Package.

5. Buyer’s Waiver of Right to Sue: Buyer agrees to not bring suit in law or in equity against Seller, any of its officers, directors, stockholders, employees, agents, affiliates, or any other person or entity on grounds, including but not limited to, libel, slander, invasion of privacy, personal injury, death, negligence, UPS error, property damage or attorney’s fees which may occur at any location or as a result of their purchase of The Package. Buyer agrees that this release shall be binding upon Buyer, Buyer’s heirs, next of kin, executor(s) and personal representative(s).

From their live-animal shipping waiver. This does not, in fact, say that the shipping of snakes is permitted. It states that the operational rules of UPS must be followed. Currently, UPS does not allow the shipping of snakes.

So, unless something specifically says otherwise, no snakes should be shipped.

I would say it appears this company is in competition with SYR, and does not have an agreement significantly different from SYR's.

Feel free to correct me if I'm wrong.

Wow wow what? They're saying they are not liable if UPS screws something up. How is that wow? That's sane and reasonable. lol.
UPS is responsible for UPS's screwups...not the seller (Reptiles Express).
 
That is copy from our standard TOS not our "Non-Venomous snake agreement" with UPS. We do have this agreement and it is supplied to our approved customers.
 
Nothing has changed from UPS's policies about shipping LIVE animals. OUR UPS waiver just adds the ability to ship a non-venomous snake under our account. UPS has never guaranteed live arrival of any animal shipped and that goes for all reptiles and non-venomous snakes. This is a portion of the approval letter UPS has given us to ship non-venomous snakes. This is part of the information we provide to our approved customers:

"We have reviewed your request for UPS to reconsider our policy prohibiting acceptance of any kind of snake (venomous or non-venomous) for transportation. Upon completion of our review it seems appropriate that UPS can transport non-venomous snakes, provide specific restrictions and conditions are met.
Restrictions: First and foremost, UPS will only accept non-venomous snakes. Venomous snakes must not be offered for transportation at any time. Second, any snake listed on the U.S. Fish and Wildlife Service website as a “Threatened or Endangered Species” is prohibited by UPS and must not be offered for transportation. Finally, live non-venomous snakes must be offered for transportation via UPS Next Day Air Service only. Unless Saturday Delivery is specifically requested, live non-venomous snakes may only be shipped Monday thru Thursday.
Conditions: You must comply with some basic principles of humane care and safety in preparing and packaging live non-venomous snakes for shipment. UPS is not liable for perishable items including live snakes and does not provide temperature-controlled distribution. Packaging must be designed to provide a primary and secondary means of containment. Each snake must be placed is a fabric or burlap type bag of sufficient material strength to ensure the snake cannot tear or otherwise compromise the integrity of the bag. The bag must be sealed or closed in such a fashion as to prevent the bag from opening during transport. Each bag (or multiple bags) must be placed in a box constructed of double wall corrugated of sufficient strength and size to accommodate the size and weight of the snake(s) being shipped. It is recommended that an expanded polystyrene (EPS) box be placed inside the corrugated box to provide additional protection from sudden environmental changes to which the package may be exposed during handling and transport. If an EPS box is used the external corrugated package may be constructed of single wall corrugated."
 
Hope this helps. We are 100% approved by UPS to have an exemption to there policy about not shipping snakes. This is not easy to get and we will make every effort to keep this exception in place. That is why we are going a membership based program and we will verify your identity before you are approved and why we have a very detailed TOS in place. about their quote shipping when I do a box quote it tells me the retail rate is $26 when in fact the real retail rate is $36. I think there may be some flaws or errors on their quick box quote. Things I do not think are added are DAS surcharge, Residential charge, and Fuel Surcharge. The $26 retail rate it shows is close to the retail BASE rate on UPS.com Can anyone confirm or deny ?
 
Please post you box specs and to and from zip code or a screen shot of your quick quote and I will take a look. The quick quote does not include the residential charge. This can be added when you go to generate your label. It is just a quick quote it does not have extra option like res fee. sat delivery fee, pickup fee....or any other option not used on a reg basis. Out of the extras the res fee will be used the most. Where did you get the retail rate you are using?

I think it is the difference between 2nd Day Air AM and 2nd Day Air.
 
If Next Day Air is a requirement, why are 2nd day options made available? ....or is that requirement only applicable to snakes?

Insects don't have to be shipped next day. When I was utilizing SYR, I was using their system for ground shipments of products. I don't see why they can't offer all the options.
 
As stephanie said crickets,roaches,and semi non parishables, like Reptile food or Medicines
alot of people can 2nd day for that! Live Reptiles must be shipped overnight for guarantee of live delivery or Non parishing the Parishable Items
 
Wasn't thinking in terms of nonperishables - when I've been up for >36 hrs, I tend to lose the big picture - I was focused on reptile shipping :blush:
