I find it funny that for a shipment with dead and dying animals in it that he seems to be willing to past them off to other herpers. He is selling these snake at a overly high price for sick animals. These are the animals that Ellis got for free (so far). We have all seen the ads on Kingsnake and have noticed that the animals have been selling. Remember the big Mambas sale he had? If he still has the patternless nitschei then why is it not for sale? He was pushing it so very hard and now nothing.

But the fact is none of this matters at all, Ellis broke the deal from the jump. It matters not if all the animal sold, dead or what have you. He sent in the doa report and now he wants to claim foul and get the animals for free, animals I might add that he has been selling for the past 3 months.

this is getting off topic and more in the realm of apparent personal issues which sux. lets TRY to keep this one on topic w/o personal issues!please? which is randall received a 12k order. made a shipment report a WEEK later?. the AAco. knocked off 2K :thumbsup: randall ADMITS he owes this 10K and yet has not paid it? NOTHING not even the 30% upon arrival that HE(randall) agreed to do!!!his terms!!!and its been like 3months! like i said before i dont know how the guy(randall) lives with himself knowingly apparently premeditatedly taking money or this case animals from anyone anywhere. its wrong and i am simply disgusted at his(randall) one responce to this thread with no action at all sad,sad,sad :confused:come'on randall be a man and pay what youve admitted you owe so this ordeal can be done with.

Thomas , exactly how are you adding much? To date your posts are more ranting and regurging from AA's poststhan anything constructive to bring an end to this problem. It seems you have read Randall's post yet you make no connections from it other than what you choose instead of as a whole. Randall has stated that he not only owes the money but has hit hard times. Not to diminish the claim by AA ,Randall has admitted to hitting a hard spot unexpectedly , which can leave one far behind in most cases. I've been there and done that and it does take quite some time to fix. He has never disputed the monetary claim and has offered a payment that AA has refused to accept. Keep in mind some of this deal has happened over the phone so not everything is out on the table.

There seems to be 2 - 3 folks here that didn't catch Randall's statement about 2 orders from Africa coming in roughly at the same time. Considering his statement, how are ya'll branding each and every animal he posts from Africa as coming from AA? You seem so absolutely sure of it yet I can't see anything marking them as such , no mention of WHO they came from in the ads and I highly doubt that Randall has faxed or e-mailed ya'll copies of his invoice with picture IDs of every animal.

The ranting and accusations from those who know just as much about whats going as the rest of us should put the coffee cups down , try to concentrate on what was posted from both parties and reply accordingly if at all. Picking and choosing excerpts to futher your cause is not helping in the slightest . Entertaining .... yes , making you look like an ass ..... yes , helping either side .... no.
 
Well, let's look at what we DO know:

1. Randall Ellis ordered 11k+ worth of animals from AA.

2. He admits to receiving them, but says they were not the quality he expected.

3. He negotiated with AA, and they agreed to lower the price to 9k, because he was not satisfied.

4. He still hasn't paid them a penny. He offered 1k, which they refused.

I am not jumping to a conclusion here, as this picture is not fully developed yet. But, SO FAR, Randall Ellis is not looking like the good guy. If I am wrong about that, I will be the first to apologize.

1-Randall get shipment from AA in 11/06 he states animals were unsellable.

2-nitschei post that he was with Randall the day the AA shipment was unpacked and the cobras and mambas were so bad that he did not buy them.

3- Randall claims to have gotten 2 seperate Tz. shipments in at the very same time.

4- Randall admitts that he could not afford the shipment from AA or even pay for friaght.

5- Randall places KS. ads for the AA animals and brags about how great they are and maybe gravid even the cobras and mamba.

The list goes on and on.

But do any of you really think that Randall got 2 Tz. shipment in at the very same time? :NoNo:

Thomas , exactly how are you adding much? To date your posts are more ranting and regurging from AA's poststhan anything constructive to bring an end to this problem. It seems you have read Randall's post yet you make no connections from it other than what you choose instead of as a whole. Randall has stated that he not only owes the money but has hit hard times. Not to diminish the claim by AA ,Randall has admitted to hitting a hard spot unexpectedly , which can leave one far behind in most cases. I've been there and done that and it does take quite some time to fix. He has never disputed the monetary claim and has offered a payment that AA has refused to accept. Keep in mind some of this deal has happened over the phone so not everything is out on the table.

There seems to be 2 - 3 folks here that didn't catch Randall's statement about 2 orders from Africa coming in roughly at the same time. Considering his statement, how are ya'll branding each and every animal he posts from Africa as coming from AA? You seem so absolutely sure of it yet I can't see anything marking them as such , no mention of WHO they came from in the ads and I highly doubt that Randall has faxed or e-mailed ya'll copies of his invoice with picture IDs of every animal.

The ranting and accusations from those who know just as much about whats going as the rest of us should put the coffee cups down , try to concentrate on what was posted from both parties and reply accordingly if at all. Picking and choosing excerpts to futher your cause is not helping in the slightest . Entertaining .... yes , making you look like an ass ..... yes , helping either side .... no.

ive hit hard times to we all do sorry if it seems im picking on randall i just feel from what ive read he should pony up and pay his debt, and its certainly not me stating all of his animals are from AA im sure he does biz w/several importers from all over the world which kinda makes it all the harder at least for me to swallow the hardtimes story but hey whatever :rolleyes: if i look like an ass for stating my opinion then sobeit :bleep: but i certainly dont feel ive ranted or accussed at all i feel dave lawson has but his name is MUDD so i dont feel he adds anything sorry you dont feel i add anything but please dont lump me with dave lawson! i am proud of my reputation unlike some :confused: but i have every right to state my opinion and will certainly do so whenever i please as will you and all of us and with whats on the table imho randall needs to ponyup and pay AA simple pimple,,,,,,,,,thomas davis
 
There is a difference between stating an opinion and falling into a rant. Everyone has the right to voice their opinion about anything but how its voiced is the difference.

Never intended to lump you in with Dave , I'm not that mean and doubtful you can sink that low. :D

I never said or implied Randall shouldn't pay his bill. Hard times suck and gets you at the most inconvient time as possible. Randall stated he recieved a dry bite but even tho it was dry still needed medical treatment. Even if he had the 30% at the time of order lack of insurance or a sucky carrier can suck you dry in the emergency room.

I haven't seen a really firm time line of order placed to order recieved( been a bit so could be over looking it or forgot it ) so if the initial 30% were present for payment and the bite took place anytime after the order it could've caused problems scraping it back up.

Admittedly by AA , both sides have made mistakes so Randall isn't alone there. Randall did offer a payment which was refused and AA posted the messages which show that for a period time they were not responding to Randall at all. All this means is both sides could have done things differently. Now granted a few folks have tried slinking under the " good guy , great rep " thing to be exposed as bad guys but at this point with the few chats I've had with Randall , I have no reason to not believe him until / unless this situation gets worse. I know I can't crap 10k right now or within 3 days or within 2 weeks even if my life depended on it , how can we know Randall can? Unless Randall comes on here and lists so much personal info to write a book showing his side to prove his story none of us can really know if hes buying time or really sucking right now.

Since Randall has never stated he wasn't going to own to the debt its just going to take time and communication between AA and Randall to see where this goes. Lets give him a chance to show whats hes really made of before the lynching. So far as it stands hes just a guy who hit a hard streak and owes some money.

No pissing contest was ever intended , was taking a shot at a voice of reason. No one likes a bad guy and seeing a good guy go bad is worse but I'm not seeing it going there as of yet.
 
Bryon we see people repeat the same thing over and over all the time here yeah it can get old lol. You mention something interesting that no one has asked about unless I missed it.. IE the other orders he says he received. Anyone know for sure he got other orders?? If so did he pay for them and not this one?? If he is selling animals from this order or the others (IF there are any) then he is still selling something and still not paying AA.

Seems the two involved parties have gone away. Randy

Isn't it really irrelevant? He owes the money and he needs to figure out a way to pay it. A credit card cash advance, a line of credit on his house, whatever it takes.

As for AA refusing a $1000 payment, there are legal reasons why they might do so if they are contemplating a lawsuit. However, Randall only offered to wire the funds and they said not to do so. There is no indication that Randall ever actually initiated the wire and it was then refused. Small technicality perhaps, but it is the difference between someone saying they are going to come by with $1000 and you telling them no to do so and them then showing up with 10 Franklins and you turning them down.

I know he mentioned it but didn't really go on about the details of it but did say he was putting cash aside for a lump payment from those sales. If I remember right a payment plan was set up and agreed on by both parties.

This is true also. There are things that could've been done to make this problem go away or at the least smaller than what it is now. Maybe its a " me " thing having been in some very bad financial positions and wanting to give a benefit of the doubt. Its a new thing I'm trying out.

I can see many of you are wondering and asking why we didn’t accept the 1000 USD offered by Randall.

Please note that this amount doesn’t even cover the shipping cost we’ve paid for the shipment.

Furthermore to offer 1000 USD after 3 months! When you owe more than 10 000! And this only after he understood we intent to post the entire issue on BOI is just NOT RIGHT! NOT ACCEPTABLE AT ALL!!!

In order to keep you all informed of the development – Randall wrote us a letter saying that now he wants to pay only 5 500 USD for what we’ve sent to him!

Just let me remind for those who haven’t gone through all the correspondence or have missed some facts – He has agreed and confirmed he owes us 10 027 USD not in one occasion. He even stated in his e-mails he has no intentions and doesn’t insist this amount to be lowered any more.

Now he’s saying that he has done some calculations and decided that the shipment doesn’t worth more than 5 500!!! And this is 3 months after he has received the animals and as we suspect already sold them!!!
I don’t even think this needs any more comments – at least not from our side.

To you Randall we want to say the following – To your offer of 5 500 USD we can respond that we are firm and stick to what we said before. We are going to wait for the complete amount of 10 027 /not even a single cent lees/ until 10th March.

In the coming days we intend to post on the Wildlife Division’s information board about your actions so all the exporters in Tanzania can be notified.
Further, in case you do not pay we are going to take all the necessary legal actions against you.

Should you wish to clear your reputation you just have to do the only right thing – Pay us what you owe!

I think you have the sympathy and support of everyone on this Board with the exception of a couple of Randall's friends who are desperately trying to find some aspect of the deal they can slant in his favor. For those few who keep making comments about all the details not being in yet, let's do a quick recap:

1.) November 2006 Randall received a shipment of animals from AA. He was supposed to send 30% of the total invoice upon receipt (approximately $3,100)and the remainder in 10 days.

2.) A percentage of the animals were unacceptable in one way or another. Due to this Randall requested and were given a discount on the original invoice price of $2,345 (approximately 20%). They were notified of the problems a week after receipt. No money was sent on receipt as agreed upon.

3.) In the ensuing 3.5 months you have not sent any of the payment. You offerred partial payment of $1000 approximately 3 months after receipt and it was refused.

Now, after almost 4 months, he has decided that the shipment is only worth about half of the already agreed upon price.

Sorry. I don't know what world he is working from but that just does not fly on any level.

There is no gray area or room for interpretation here. No extenuating or mitigating circumstances or loopholes. Both parties have told their story here and all of the salient points have been agreed upon. The deal is complete except for the final piece of the transaction.



You owe them Randall...pay them.
