Im part of three forums/websites that have tons of photography and actual drawn pictures as the theme for the forum/website.
You steal something on there, whether its a photograph of someones dog or a drawn picture of that dog or a different one, you get the same treatment.
Youre stealing and that is that.

At this point, if you find your photo(s) being used illegally on Reptilesncritters.com, I would suggest filing a complaint against 1and1.com with the The Internet Crime Complaint Center (IC3) - http://www.ic3.gov/default.aspx

In the past when ISP have been slow to act to remove illegal content, a call and/or email from the FBI normally gets their attention.
 
I agree that it is time for some serious consequences. In my opinion, Crespo is simply playing this community for fools, he has previously agreed to clean up his act, and according to posts here he has been confronted about these issues on other forums, and yet people are still finding many infringed photos on his site. I think he is lying when he claims to have gained permission for some photos or even paid for use.

He is a skilled evader, whenever anyone confronts him directly he simply changes the subject or vaguely agrees but never seems to actually do much.
Perhaps prior illegal photo uses were met with complaints and requests and those wronged did not take the time to complete paperworks and send it to those who could really put him on the hot seat, where he belongs.

Contrary to what the members of this forum believe, ReptilesNCritters.com has been selling reptiles and amphibians for many years to the general public. Even though I do not see the animals before shipment, (to which, I might add, is not a crime the last time I checked) I take great pains to make sure my suppliers pack the animals with the utmost care. Do accidents happen? Of course they do as no delivery can be guaranteed to arrive alive 100% of the time. My customers know that they are covered on ALL DOA deliveries with either a money back guarantee or a free reshipment provided that additional shipping is paid for (which is another standard practice). From what I am describing, does not sound like I am scamming my customers?

You do not at any point in any place notify the customer on your website that the pictures are representative, not actual... which makes your statements in email to Danny Mendez a lie. Sooo.... yes, it sounds like you're scamming your customers.

Maybe it still does to you but this is what we call subjective moral values. Like when you made fun of one of my freelance writers by saying in effect that his work is junk. In comparison to what? Time will tell on whether I make good on all of my objectives to clean up the image and content issues of my website. What I am not going to do is wave some kind of magic wand to make every last change that people are demanding. These will be progressive changes that will rolled out over the next several weeks and months.

You have a "picture coming soon" placeholder on your site... this one, to be exact:

It wouldn't take much to replace every illegal image with that until you do the respectable and honorable thing and stop making money off of other people's intellectual property. You won't do that, because you are a shady and unethical businessman, but it was a nice thought.

Here's a thought, wave your magic wand and make a spreadsheet of all the email permission slips you've been written and actual photo licenses you've purchased for stock photos, and check your site against it. I guarantee you don't have more than a couple of dozen legal photos, if any, so deleting all photos EXCEPT those should be a cakewalk.

p.s. -- you (wisely) chose to completely ignore the fact that while you tried to convince us that you "write" the species descriptions, they are 98% copied wholesale from other sources WITHOUT CREDIT. Now tell me, why does a "writer" need to copy and paste whole passages without credit if they are any good at what they do? Does this mean you're a terrible writer and don't want people to see what would come of you actually putting your own words on "paper"? Does it mean you're just an incredibly lazy business man more interested in dollar signs than in producing legal, original content? Oooh, the mysteries!!

I get what you are saying, but I don't understand why it matters? If someone wants to call it theft, that's alright with me.

As far as the situation, obviously Mr. Crespo has shown a blatant disregard to the law and the people that put the time and effort into taking those photographs. Sounds 'scummy' to me.

Well, I hate when words are used incorrectly, and this is a particular pet peeve as it is an issue I've kept track of / debated / read extensively about for some time. Semantics are extremely important.

And again, I'm not excusing what this person did. It is copyright infringement.

Hey i just purchased two red eyed tree frogs 1 small and 1 medium size. The small 1 passed away today she was not eating and didn't look healthy when we got her and the med. size looks good but we came home from work we noticed a redish brown soar on his nose. we have the tank set perfect and feeding everyday. What should we do ? Please help

Myself I would just file a lawsuit of some sort and quite warning the guy. Ovisoly , he won't stop making these mistakes until someone bruises his pocket book. If he was a smart man, he would research the laws you clearly stated and think twice before he attempted the second time. I am sorry Chris you are going through this. I hope this issue is now solved and he won't attempt to steal from you for the third time. Take care...Tonya

I found this when I was researching where to by my Caiman Lizard. I ended up going with Florida Herps because they actually answerered their number and emailed pictures of the exact lizard I was getting which is something I required before spending that much money.

I just thought others would like to read this page, apparently these folks weren't too impressed with the guy running his reptile company from an Apt. in Brooklyn either. Not to mention there was some great info on Reptile City and the kid running his reptile company from Oklahoma too (another flipper).
