    In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

I know "alvaro" mentioned getting another chech issued .... uhhhhh .... ANOTHER CHECK????

My move would be show up in person and leave with:
1) YOUR animals .... you didn't get paid, you still own them
2) CASH!!!! ... unless you need to retread your tires with cheap rubber
3) A combination of the 2 above ... let them pay for what they can afford to keep (make sure the ink on the bills is dry too)

Why take a chance on another check from some clown that already gave you a bad one?
 
Having given this more consideration over the last couple of days I think a couple of things should be mentioned here.

The shop has been in business about 6 or 7 months according to the guy who was behind the counter. They are, in my opinion, either still just starting up or on their way out. There are not a lot of dry good in the store, most of the cages are clean but there are not a lot of animals in the shop as a whole. There are a couple of large rooms that have half built or unbuilt cages and "stuff" in them, again denoting either things being built or unbuilt.

The feeling I got was that they won't be around that much longer. I had to give it some thought before I posted it. Now I have and if I was owed money by them I would be there everyday to get something or pick up my animals.

And if the big guy behind the counter is what's deterring you, call the cops and tell them these guys have stolen your snakes and you want to get them back. Have the BOUNCED check for proof. I would not wait much longer for them to make it right.

so whats the current status?

What I don't understand after reading this thread (and maybe its been answered already somewhere else) is why you don' t simply go pickup your animals already. If they try to stop you, call the police.
 
Civil vs Criminal

In reading this thread I am reminded of a circumstance that happened to me. Several years ago I was an active coin dealer, a person at a show bounced a check and refused even to contact me. I proceeded to bad mouth him and try all the things that people are mentioning, he finally contacted me made partial payment with promise to pay monthly. Well needless to say he never made another payment. So I went back to the neg comments on trading wire, posted the bounced check on a poster paper at the the next coin show. I ended up being sued because of unfair collection activity.

It has been touched on by others posting and yet I want to cover it again.

If all you had was the bounced check then the potential for criiminal action would be there. But by accepting the partial payment you have in essence given a line of credit with payment plans, and so your collection activity is limited to those allowed via any unsecured line of credit. MC and Visa dont come collect the new grill when you dont make a payment. And I am sure the law wouldnt allow you to collect your animals without a security arrangement stipulating that the animals will be returned for breach of contract.

I would at this point in time go to an attorney one that gives a free consult and outline it all. Get a feel for what the state laws allow you to do and do them, not more, but only what the law allows.

So the moral of the story is do what you can to collect, but this guy sounds like he knows the law and loop holes it contains. If you do something be sure that your not the one to end up on the wrong end of a law suit. Our wonderful system restricts how we can collect debts so we can be fair to the person who owes us money.
 
I don't know if that's true for all states or if it applies to animals.

But I believe the original payment was accepted with the stipulation that others follow in a timely manner. Ben, could you verify if this is so or not please?

And, let's not forget, this is california, things are different here.

What happened with these snakes is not right. Sometimes going in person works wonders. And if you get the right cop that can be helpful as well. They have stolen his snakes. Ben has every right to have them back.

Of course, I am a little more hands on than some perhaps are and if you steal from me I may well just come and get what's mine and deal with the rest later. It just bugs me to see this happen. When I had my shop I had people bounce checks to me several times. I used to go to their houses and reposess my animals. I even had one guy call the cops on me while I was getting my snake and cage back. When the cop got there he said that it was technically illegal for me to take my stuff back but, he completely understood my doing it. Then I took my snake and cage and drove away.

Just another opinion on letting people get over on you. Personally I'm not for it.

whatever happend? i go there daily, and my friends work there,the owner is in debt and the store might be closing..do what you can,,trust me,he hasnt even paid his employees,,its a crap hole,,i like your snakes,but damn,,take them back.they dont take to good care of the herps anyways,very sad indeed
