2. Coverage of Fish, Wildlife, and Plants
The first step in analyzing a potential Lacey Act violation is to determine whether the wildlife, fish, or plant at issue is covered by the Act. The Act defines the terms "fish or wildlife" broadly:
(A)ny wild animal, whether alive or dead, including without limitation any wild mammal, bird, reptile, amphibian, fish, mollusk, crustacean, arthropod, coelenterate, or other invertebrate, whether or not bred, hatched, or born in captivity, and includes any part, product, egg or offspring thereof.
