Terry Parks - [email protected] - BAD GUY

Wes, i'm proud of you :) Kelli's very grateful i can tell in her words for you. I'm sure you are the "knight in shining armor" for all the girl herpers here :)

Kelli, i wish you the best of luck. I really do. I know what it feels like to have an animal very close to you. We all do! It may not be a 5,000 dollar snake, but it has some sentimental value, which is by far more than any 5,000 dollar snake.

I will be following this thread, and supporting you. I hope very dearly you get your snakes back.

I'm the one that Kelli spoke of that never got snakes I ordered or the refund I requested. In early August knowing that Steve and Kelli had nice locale bairds and knowing they were on Loan with Terry, and after reading nothing but praise here I contacted Terry.

(Sorry! I know allot of the following is irrelevant snake chat and such but I thought it best to post everything I had)

Hi Mark -
Thanks for the inquiry on the Texas Bairds. I have a clutch of Texas
Bairds from one of the pairs that came from Steve and Kelli Hammack due to
pip the third week of August. Are you interested in one or a pair or? I
don't think I have the prices listed on my website. The Texas bairds are
$35 each plus $35 dollars overnight shipping to you.

Hi Terry,
Thanks for getting back to me.
Yes i want at least a pair,Maybe 1.2 if possible?
In your opinion whats the nicest Texas line your currently working with?.

Received 8/2/04
Mark - You are going to put me on the spot. LOL. Actually, a good
question. Everyone has their own individual preferences on Texas Bairds.
The nicest line that I have or the one I really like is the line from Hwy
277 in Loma Alta, Val Verde County, Texas. I also like the line from hwy
377 in Edwards County, Texas. The trio I have from the Davis Mountain area
turn out very nice. I guess I'm giving you several answers to your
question. The one from Hwy 277 in Loma Alta, Val Verde County is the clutch
of Texas Bairds due to pip the third week this Month. I have 2 03' CB
females from Aaron Mattson that came from w/c hwy 277 near Loma Alta, Val
Verde County, Texas. I was going to breed a male from this years clutch
that pip the third week of August to one of those females. What I would
suggest, if I may, would be to get a pair from the clutch I mentioned and
one of the females that I got from Aaron. That would give you a trio with
the 2 females unrelated. Should produce some great offspring when they
breed. Only a suggestion, you most certainly have the choice you want.

lol sorry about putting you on the spot, that's always a hard decision
picking a Fav. locale I can imagine its even harder with the bairdi .
The Trio you suggested sounds like a plan to me.
Put me on the list for those 3 , do you need a deposit or anything?
just let me know.
Thanks
Mark

Hi Mark -
That's really a nice trio you will be geting. I have you down for a pair
of Texas Baird offspring from the Val Verde County, Texas that came from
Steve and Kelli Hammack. In addition you will get an unrelated 03' CB
female Texas Baird also from Val Verde County that came from w/c parents
collected by Aaron Mattson. The Texas Bairds are $35 each plus $35
overnight shipping to you. The total for the trio including shipping is
$140.
This trio should produce some very nice offspring. I myself am going to
keep a pair from the clutch your pair is coming from. I will have the other
female like the one you are getting so I will be keeping a trio like the one
you are getting.
I'll take some pics of the 03'CB female and the parents of the clutch
for you to see.
If you have a PayPal account, then a $25 deposit would be nice to send.
If not, don't inconvenience yourself and go out and get a money order to
send me. I will hold the trio for you. I accept PayPal or money orders.
I guarantee my snakes to arrive to you live, healthy and will have eaten
for me numerous times. They will also be growing and developing well for all
babies. I back all my snakes by either a refund to you or replacements.
It's your choice. If you have any concerns or something comes up with the
snakes, I'll give you a refund or replacements. It will again be your
choice. The number one priority is and will be the health and safety of the
snake with your happiness and satisfaction right up there with it.

Thanks for your inquiry and snake reservation,

Hi Mark -
Here's a couple pics I took last night. Texasbaird 01 and 02 are the 2
03'CB unrelated females I mentioned. Texasbaird 02 is in blue eye and
doesn't look as nice as 01, but she is every bit as nice as 01.
Texasparent02 is one of the parents to the clutch of Texas bairds that are
due to pip the third week of this month. They all come from Hwy 277 in Val
Verde County, Texas near Alta Loma. Cameras just don't seem to pick up the
orangish colors in bairds. People almost always say they are better looking
than they thought when they have only seen pics. You won't be disappointed.

It's too bad the one female is in blue eye. You can pick the one you'd
like. I wil send you pics of the babies from the clutch and you can pick
the pair you want.
Terry Parks
I see no need to post the pics. They appeared healthy and well feed. If anyone wants to see let me know and I can mail them.

Hello Terry,
Sorry it took me so long to respond.they both look very nice even with the
one blue.Ill leave it up to you to pick me a nice trio:).
Is this the address you use for paypal? I will send $25 or more as a deposit
ASAP.And pay the remaining $140 by the 1st of September,Is that okay?
Also have you got a current list of what all you have available at the
moment?
Thanks again
Mark

Hi Mark -
No problem on the response. I'm glad you made the joice to pick up the
trio. You own't be disappointed. I like all the bairds that I was
fortunate to get on loan from Steve and Kelli Hammack. They get half the
money on any of their babies.
A $25 deposit works for me with the balance of $115 coming the first week
of September. The total [rice with shipping is $140. The clutch is due to
pip the third week of August. I would like a few weeks to make sure they
are eating and developing real well. I don't ship babies just because they
eat a couple times. I like to make sure they start developing like they
should. Is that O.K. with you? If you send me money by PayPal, use this
email address to send it to me: [email protected] I carbon copied this
address on this email.
I do have an Availability Page on my website at www.kernreptile.com.
I'll send you a list of what I have later today or tonight. If you go to my
2004 expected offspring page it shows what I have eggs from and what has
hatched. The only hatched babies I have at the moment are the japanese
ratsnakes. I'll list what eggs I have for you on the email I'm going to
send. I'm just letting you know there's some info on the website for quick
reference on what may be available or coming, but it's best to send an email
and get updated info.

also I was wondering if it would be okay to send you $50 more tomorrow then
to paypal the remaining $50 when there all ready to be shipped?
let me know and thanks again.

Hi Mark -
I like to keep new hatchlings about a month to make sure they are eating
and developing. Just because a hatchling eats twice doesn't show me that it
is growing and developing. You can send another payment with a final
payment when they are ready to ship. Whatever is comfortable for you. Your
Texas bairds will have your name on them shortly. LOL

Hi Terry,
Okay ill send $50 today and try and get the other $50 there within this
month, sorry bout change of plans some unexpected things came up and im

with making sure there okay,im glad you take the extra time to be sure:)
Just pic me a nice trio :D

Thanks for the $50 payment. Don't short yourself. The bairds are here
with your name on a trio. No rush. They will be fine.

Due to computer problems I'm missing a few emails from September and October. Payment was complete 10/20/04. But if I remember correctly I didnt hear anything from him in Oct.

I am in standby with shipping due to Bakersfield's fog. The airport was socked in last night and I'm waiting to see if the fog foecast for tonight will change. There were scholl delays, etc. If the Fog rolls in and I have tried to ship, then package will sit in the terminal until the fog lifts and I can't chance it. I'm waiting though and will keep you posted if I ship

Thanks for the update. No problem, safety of the snakes comes 1st. just keep me updated.

Also please keep in mind our low temps here, lows have been in the mid 40s this week and were in the low 30s last week.

Hi Mark -
I have another package to ship where the temps at night were just below 32 degrees, but the daytime temps were 68/69 degrees. The shipping container will be insulated and a heat pack will be in the package with the snakes. I just want to watch that the daytime temps are in the 50's at the lowest.

I have your snakes and one other persons to finish the season and I haven't gotten them out to you. Your snakes are fine

Let me know Monday if they go out.

I didn't hear anything from him. And at that point in time because of a combo of a all of sudden lack of comunication, the weather, and just a bad feeling I decided to ask for a refund.

Hi Terry,
I don't think we are going to have a day with highs above 50 again this winter. Most likely not until May. Plus neither of us can take another day off of work to be home for delivery. So could you please send a refund ASAP?

Thanks Again

I know it's frustrating, but I have been playing havoc with intemitent fog and my email has been down for over a week. Your snakes are fine and I will try to get them out by Wednesday. There is no fog in the forecast from Wednesday through the seekend. I didn't want to keep scheduling and rescheduling every other day as it's too hard to keep missing. It's frustrating for me to keep this shipping going like this. I wanted to wait until I know and have confidence with the fog not being here. It's something we live with in Bakersfield for a couple months a year and it came early this year for some reason. Nothing really moves when the dense fog rolls in and if it does quite a bit of it gets in accidents. The snakes are fine and I plan for you to have them by the end of this week. I am sorry and apologize for all this stuff. I wish the fog wouldn't roll in, but it does for a couple months a year. It's alright to check in packages with nonliving things in them and if it goes overnight fine and if it takes a couple days fine.

Hi Terry,
I understand delays you cant control weather or computers. No hard feelings at all.
But at this time and considering the weather and everything I still need to ask for a refund. I'm just not comfortable with shipping reptiles at these temps and conditions using a door to door service, even with heat. packs and insulated boxes. The high temps all this week are in the 30s.and even lower in the Midwest. There's also a high chance of delays due to the holiday season. And the fact that we just cant be sure we can take off work again to be there to wait on the delivery. Again I want to say I have no hard feelings and I don't blame you for any of the delays, things happen. And I'm sorry we had so much trouble with this order, but it won't keep me from ordering in the future ;)

So let me know how you want to send the refund. I don't want to rush you , Just as soon as you can please.

Thanks
Mark.

Hi Mark -
I will send you a refund as you have requested. I am making a shipment to Kentucky tomorrow, Thursday, 12/16 with arrival on Friday, 12/17. I see on the weather link you sent that the high will be 35 degrees on Friday. I do put the snakes in an insulated package with a heat pack and 35 degrees doesn't bother me to ship. I realize scheduling to take off work can be tedious. I understand. I do feel bad that I didn't get the snakes to you especially in view of the fact you are friends with Steve and Kelli Hammack and Kelli and I had discussed that she was happy you were getting some bairds from her breeders. I have no problem shipping the snakes to you Thursday, but I will send a refund as you requested. I would like to send it after the holidays if O.K. with you.

I appreciate the nice email from you. I had a great holiday and hope you had one too. My computer at home is donw again. I don't get my home emails. My computer won't open Windows 98 for me so I am having it checked out.
I was feeling bad since it was out of character for me and it must have looked bad on your end. To add to it, Kelli Hammack had mentioned you and the fact you were getting some of her bairds. I feel better after reading your email.
I will get the refund out to you in a couple weeks if that will work for you. I have the address I was going to ship the snakes if that is where you would like the money sent. My PayPal account doesn't allow me to send money. It's a medium size story. I'll share it with you shortly

You should get the email from PayPal sometime Friday, 3/11. I didn't get this email until this morning. Our MIS department at work has had my computer off and on for about 3 weeks now. There is a hardware problem on my work computer and it keeps shutting down now and then. I've been getting emails in bunches as they reset my windows etc. on the computer. I answer emails as I get them, but unfortunately I've been getting them in groups. It probably looks like I don't answer each email as they are sent to me. I will get the groups of emails and answer them so I may be answering 3 emails with one response.

Sent 3/18/05
Terry,
I will give you until Friday March 25th to send my $140 in full.
If I'm not refunded by Friday March 25th I will have no choice but to file a paypal complaint and a complaint with The Internet Fraud Complaint Center (IFCC). I will also post our emails and the story on the Board Of Inquire and everywhere else I can think of. I feel like I have no choice. I asked for a refund on 12/08/04 and waited patiently when I was told on several occasions it was in the mail, or it would be paypaled on a said date. At this point it does not look like you care much about your reputation or your customers. Please make this right.
The last I heard from him was what I received 3/10/05

Compared to what Steve and Kelli are going through the $140 (even though it's allot of money to me) is nothing. Letting ANY animals let alone animals not your own get to that point is just disgusting and there's absolutely no excuse for it, personal or financial problems or whatever. Terry had options to let Kelli know and to return her snakes. He's also had ample time to be honest with me and let me know what's happening. Instead he chose the old the check is in the mail routine and excuses or just to totally ignore emails. Terry...Break your recent record and do what you say your going to do and send Kelli what's left of her snakes this week. And then send me my $140 and find yourself a new hobby.

You sure are a patient man! I wish I had that much patience. This guy is an excuse machine. One after the other. What a joke.

Unbelievable...absolutely unbelievable...and some think this person actually belongs in the herp trade??? Even more unbelievable !!!
Hope this all works out well for all concerned...

Well, it's now 7:30 pm PST on thursday evening and I have NOT heard from terry.

Kelli, have you heard from him about your snakes that he PROMISED to send you this week?

He also PROMISED to email me with a tracking number and did NOT do so.

terry, what happened to all that apparent crap about how I could TRUST you and that YOUR word was GOOD?

Frankly, I'm REALLY disappointed.

You, however should be ASHAMED of yourself. You who spoke so MUCH about your VALUES. HA, I say. Your VALUES SUCK.

Well, as you probably noticed when my posts started, I was extremely disgusted, then after finding additional info on the guy (website, references) I tempered my posts to......maybe he is/was a good guy and he fell under extremely difficult times (it has happened to the best of us), but that he still should have contacted Kelli, and had the situation with the snakes taken care of before they got in such a bad way. Well, I think my initial feelings were closer to the mark. He had every opportunity to "make it right" especially when Wes stopped by. I also got an e-mail from a fellow herper-breeder who says that somewhere between 1 to 2 years ago, Terry wrote him a check on a closed account, yet at the same time was apparently still buying snakes from other sources. I think that he had an opportunity to make a bad situation right and "we" could have eventually forgiven his poor handling of being in difficult times, now however it just seems to be going from bad to worst? worse?
By the Way, if anybody noticed when I posted the info about his old website and "partner" or mentor, Del, they had parted ways before Terry's downfall.

It’s nice when people give the benefit of the doubt and not immediately jump the gun. Even more important is to recognize when one has done so. My question is, what does having a website and well-known friends has anything to do with the way Terry treated the Hammack’s? People in the BOI should be treated similarly, without consideration of who his friends are. Threads seem to go for months on simple things such as how people spell or because they gave an “unpopular” opinion. In this case I waited to see how the events unfolded before posting. Here is what we know so far:

Terry:

1. Lied to the Hammack’s.
2. He not only has $300 that belongs to them, but never shipped an animal that was owned to another individual.
3. He did not ship priority but standard.
4. He did not ship properly (no insulation), not adequately packed, and no heat packs.
5. I’m not going to even ask about the “legality” of his shipping method. From the description I highly doubt that package was adequate to ship live animals.
6. The animals were full of mites.
7. They were extremely thin.
8. There was extreme lack of communication (is there an acceptable time-frame for that?), and, when there was, it was pretty “nasty”.
9. He sent the wrong animals.
10. Only thanks to Wes’ goodwill were the Hammack’s able to retrieve some of their animals.

What I still don’t understand is why because he has a webpage or befriended a certain individual he has all of a sudden “fallen in hard-times” and is let “off the hook”. Something doesn’t seem quite right.

Regards.

Well, here is the latest update on this situation. We received an email from Terry on Friday morning:

I shipped a package to you via Fedex priority overnight on Thursday, 3/31 for delivery to you on Friday, 4/1. My computer at home went down yesterday so I'm emailing this from another computer by accessing my Juno emails. The airbill number is 841632531901. I'm sorry but the pair of Mexican bairds that were here didn't make it nor did 2 of my snakes. I'll work on the monies and any compensation that I can. One of the Texas bairds in the package had just started to shed so keep an eye out for it. Terry

We did get the package (he sent Priority this time, but no styro box). It contained 2.1 Texas Bairds. One of them I don't even think is ours. It looks like it's nose is all bumpy from pushing on cages and it has really rough scales, like it had a bad mite infestation at one point.

Also, two of the baby snakes Terry sent us in the first box have died, and the other looks like is going to die.

Well, just wanted to let you guys that are interested in this know. If we ever receive the $300 Terry owes us I will certainly post here and say so. Thanks to those who have supported us through this and offered their help.

i bet he has those mexican bairdi still in his collection.... just a hunch.... i think he is a lieing piece crap and should be treated as such no matter who his friends were or are.... his mere presence is a total waste of a human body

Well, since I found the old website and also mentioned him receiving praise in the past from someone, I'll try and answer your questions.
Simply this, there are different scenarios (not all inclusive here) such as;

1. A "bad guy" who is really a conning, scummy bad guy, whose only goal in life is to rip herpers off.

2. There's people who were good guys who fell on bad times and sometimes have a hard time making amends, such as making financial restitution, who but for the sake of being in financial ruin were still "good guys" in their heart.(note I'm not excusing this category, just can understand it).

3. There's isolated incidents, and misunderstandings.
and
4. There are posts about "bad guys" where it turns out the bad guy was really the OP, or complainer.

After seeing Kelli's post and knowing it wasn't #4, I was really angry, and had nothing but contempt for this guy, and my initial post reflected it. After some questions from other posters, Kelli posted more details about the situation-how she came to know the guy, and why she trusted him, etc, after seeing this I did some research to try to find out more. I found through an old website that he had a "partner" and also that he had positive recommendations in other threads here. So I posted again, this time with some temperance. Why?, because of the additional info I found......had there been no other info on this guy it would have been easy to lump him in to the first catagory above, however given that he was "somehow" associated with Del whom has been around for a long time, and he had a positive recommendation from someone whom I've known of for many years, I thought maybe he was more of a catagory 2 (is it right that someone, who has no history is more quickly put into catagory 1? maybe not, but you will find anytime someone is well known or has good recommendations, that most times they are given the benefit of the doubt, or allowed more "wiggle room" initially). Lastly after receiving an e-mail from Wes and seeing more updates from Kelli, I very quickly went to my initial contempt.
He did treat the situation with Kelli, very badly, but there are still two (or more) sides to every story, so given the additional information I found, I "adjusted" slightly and only temporarily.

The BoidSmith said:

Some explanation is above, but I would just like to add that I don't think anybody was of the opinion that he should be let off the hook. Even in my more tempered post, I still made it very clear that even if it was a #2 scenario, that there was no excuse whatsoever , to let the situation get to the point he had.

I think we would all (especially Kelli and Steve) just like to know the truth on whats going on...Terry had a good guy post from someone buying Bairds from him in June '04...What snakes were those? Wes stops by his house and the guy hems and haws, and refuses to show Wes any of the other Bairds he "supposedly" has but are in sad shape?...Why not just show him anyway?...
I understand ALL about hard times...I have a wife in Nursing school and just spent a lot of money we dont have to keep my car PA legal. But to take animals given in good faith and turn around and sell them? Just the worst of bad karma
Mr Parks, it's time to come clean, for yourself as well as for the Hammacks...Something like this is like a cancer gnawing away at your gut, never going away and always painful...Put some closure to this...

John,

We agree 100% in your hypothetical situations 1, 3, and 4.

As far as number 2, where you said:

2. There's people who were good guys who fell on bad times and sometimes have a hard time making amends, such as making financial restitution, who but for the sake of being in financial ruin were still "good guys" in their heart.(note I'm not excusing this category, just can understand it).

Yes, but the key word is communication . Everyone can have hardships, but you should let know about them to those you owe. You just can’t disappear with other people’s money/snakes and assume they will understand. What’s a reasonable timeframe without getting in touch with the person that sent you their animals or money? One week? One month? More? What does that make of such a person? He might be a good guy in his heart, but he sent the wrong snakes, the one’s he sent were on death’s door, full of mites, and shipped without a minimum consideration for their safe arrival (not priority, no insulation, no heat packs), when they tried to get in touch with him he got nasty, and on top of that he has their money? I don’t know him at all. But I do know the Hammank’s by the way they have conducted themselves here in the past. The moment they posted in this thread I took their word for it.

“Wiggle room” because he has good recommendations? In all honesty (and this is just my opinion) it doesn’t matter if he befriends Del (which I don’t know), the Barker’s or Bob Clark. He should have communicated his hardships to those he owed. I might have given him the benefit of the doubt had he immediately communicated his problems to those he owed. But not if he misrepresented animals (sent the ones that are not), kept money that didn’t belong to him (with no explanation at all), put the lives of the animal at risk by shipping them inappropriately, and more than likely (we probably need confirmation on this from Kelli and Steve) shipped them illegally .

Again this in no way affects Del, as he has nothing to do with the whole issue.

Just my opinion.
