    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Yes, I know they were following the letter of the law and have every right to uphold there own disclaimer policy. But you have to remind yourself we are talking about a $50 rosy here. Not a $5000. two headed tree snake that somebody who knew what they are getting into before buying. What I mean is if the seller who got started in this business because of a love of snakes has forgotten what its like for a newbie to get started . Then there is something wrong with the heart!

Ranier, I am with you 100% on the fact that cost should not e the issue. And with upstate it isn't, they rip of everyone, reguardless of how much the transaction was.

While there are no written rules for playing in the reptile game cover your ass should be one. In this case the girl with the sick rosy didn't. Is this her fault, unfortunately yes. Should she be penalized for it? There are two answers. One, if she can get a necropsy done and prove that the snake was sick when she got it then she should get a refund or repalcement. Two, if she can't prove that it was sick when she got it, and never complained to upstate about it, then she's just out of luck.

If I sold a snake and then had someone come to me a month later, having never heard from them in the interim, tell me it never ate and then died, I would be very suspicious and reluctant to give them a refund. However, if they had been in contact with me throughout I would be much more likely to send a replacement snake out. I'm not saying I would, just that it would be possible whereas it wouldn't with no contact at all.

If she could get that necropsy then that would clear things up quite a bit.

Now, let me be perfectly clear here. I am in NO WAY WHATSOEVER defending upstate. They are bad news through and through. But she elected to play their game by buying from them and they get to make the rules which she did not follow. Keep in mind that even if she had they most likely would not have given her a refund as the snake died 29 days after their guarentee expired. I would never do business with these guys and would actively advise anyone who is thinking of doing so to think REALLY hard about how much they can afford to lose.

Unfortunately your friend got taken by one of the bad guys.

how are you? Please fefer to page three of this thread. Upstate Exotics in reply number two states (Then he emailed us wanting a refund. ) (We have already refunded his money.)
Now Alvaro please keep in mind that my first request was 04/19/03 for a refund. I not only requested a refund but confirmation that it had been processed. Now with many unanswered emails I called Upstate Exotics again on 04/22/03 and talked to Sal he said he would process full refund. Now I have been asking for confirmation of this refund since 04/19/03 with no replies period. If a company processes a credit for a customer and very same customers contact them about credit not received. This company would at least respond with proper verification that in fact it had been processed. Please read all my post carefully and you will understand there is no way to justify their handling of this matter. All facts are stated period. There is no hear say here. I committed to the transaction only after I was told there was paper work on this snake. Paper work is not available 04/19/03 I asked for a refund. As of 04/30/03 no refund was granted.
When a place of business processes a credit to their customers the place of business has what is refereed to as a credit refund transaction number. They not only have a transaction number but date and time. Thanks for you time and input have a great day.

Daniel, I take this to mean that they won't refund the original shipping costs in the purchase of the animal, but will pay for a return shipment.

I have to disagree with bluerosy on the dead rosy boa. It's a shame the animal died, but I doubt that many sellers would refund under those conditions.

Recently, I bought an animal that refused to eat. We contacted the seller within a couple of days and reported that the snake was refusing food, asking him for suggestions and verifying that we were using the same prey items that she was used to. We tried everything, to no avail, and maintained contact with the seller. He agreed, after a month, to take her back and either A) refund us or B) get her eating again. The big difference here is that we paid a little bit more for this animal than we could have because of this particular seller's guarantee. We checked references. We discussed with him prior to the sale a whole list of "what if's".

Yes, it's probably a newbie mistake that your friend didn't check out the sellers. She may have made a different decision if she had. However, that also opens the door to endless possibilities of other "newbie mistakes" that might have been made in the husbandry of that snake for the month she had it.

While I have read about several situations with Upstate that would make me leary of purchasing from them, I don't think that's reason to hold them liable for a situation that most sellers would have handled in the same way. No contact, no complaints, no pictures......no refund.

I have read everything thoroughly from day one. There is no doubt in my mind that the refund is of order. What I meant was wouldn't it be possible that if they made such a big mistake as writing piebald instead of albino in their web page, that they also could have misplaced, lost or thrown away your "credit refund transaction number"? Such a mistake would be embarrasing to recognize, as it would show a faulty record keeping abiltity.

how are you? By suggesting they may have lost the refund transaction number and are to embarrassed to admit it, is the same as saying they processed my refund. If a credit by Upstate Exotics had been issued I could not have called Visa on 04/30/03 and disputed the $180.00 charge placed on my account. I will state one more time for the record. As of 04/30/03 no refund was granted. This had been going on since04/19/03. I checked my account number via Internet daily to see if credit was issued. Again 04/30/03 no credit issued. Remember to get a refund transaction number you have to make contact with the credit card company. There is no other way. You cannot obtain one without the credit card company ssupplying you with one. If they supplied you with one the credit card company would have a record of this. Lets also keep in mind this was a Visa debit card. As always thanks for your time and have a great day.

on the upper right you will see a row of green buttons
press the one that says ucer cp
then press edit profile.
Then in the signature box type in you FULL name
then at the bottom press the button that says submit modifications.

Because full name are required on the BOI section of faunaclassifieds. Thanks

It is a shame Tony that you have not received your refund or for that matter any communication. I vote that everytime this thread starts to get lower on this page to bring it back to the top. This way even new people to Fauna will not miss it and won't have to do a search, it will be here for all to see until this is resolved. Any disputes with them should be handled the same way.
I would never deal with them and I hope as many people possible see this thread!

If non-resolution were justification to thread updates past what could be considered a reasonable period of time...

Then a number of threads should still be updated. Bringing it to the top when it's still pretty reccent, like the update Tony did is one thing...

Bringing it to the top daily for the next month with no change is just a waste of bandwidth and frankly pretty annoying to everyone who has already read and understands the situation.

Until such a point as a refund is issued (unlikely it seems) or Upstate has something they would like to contribute in their own deffense past the few posts much earlier on in the thread...

There's really no reason to eat Rich's server space and put it needlessly into the "View New Posts" listings of those who regularly peruse the boards.

It was a nice sentiment, wanting to protect people, but never fear, Upstate will probably rip off someone else in the near future and they honestly aren't the worst bad guys to make appearances here, not by a long shot... so please... don't keep bringing this up on a frequent basis to try and keep it on the top, the search function works just fine for people interested in reading it.

I have to agree with seamus, it is rather pointless to keep bring this thread to the top just for the hell of it.

I do however feel for Tony, he doesn't deserve what he got.

People need to do a search or inquiry before buying off someone they have not purchased from before.

how are you? Great idea, and you made a very good point. Total awareness of this type of business practice must be made. As I told Upstate Exotics, If they where the first experience anyone had with this hobby I think the snake industry would go bankrupt. It would make you very skeptical to swim in the water. Watch out for the sharks! Thank for your input and time.
