    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy JERRY TRESSER--BAD GUY- the worst kind

One other little fact we are forgeting here is that this peice of 'human' has recorded Many if not All his customers on that 800 number. Not only is that illegal but to record all their personal information, includeing credit card info??? He is no where trustworthy enough for that and I hope his past customers find out that he has all that info.

1) I think you are lying about the lizard. You took no pictures despite the fact that cameras are everywhere these days. I believe the lizard is alive and well.

2) I believe by your extreme and outrageous conduct here you could be on the hook for a LOT more than $900.

I see you've lost the bullying threats since everyone here saw through you, and are sort of trying to slime your way into SOME money. See #2, above, and pay Ben what you owe.

That was not the criteria for the sale. It was based on good faith and I never would attempt anythng dishonest with Ben.

I don't know what world you live in where you think you're entitled to take home animals without paying the full amount for them. Maybe it's a common thing in some shops to let the animal go on a payment plan, but it isn't EXPECTED :confused:

Why should he "resolve a problem" by accepting only what he paid for the animal? That doesn't factor in his time, employees' time, housing space, feeding costs, electricity, etc. Or his wanting to make a profit, being a business. It doesn't matter if he's physically in the store or out fishing. You failed to provide any kind of proof that the animal had died. Only someone out of their mind or truly naive in the business world would think that a store would just let you get away with not paying for an animal based on your word alone.
 
Why should Ben take $500 for a lizard he could've sold for $1000? It's not like you bought it, and it died. It's like you didn't buy it, and it disappeared.

Lets set the story straight... In order for me to know how much Ben paid for the skink, I asked him, and made the following proposal . I will pay the $ 500 less the 100 deposit and that will be the end... This way Ben would loose nothing. Not a penny . Get his original money back, and move forward...

No, you pay him 800.00 that you owe or return the skink. You are a thief! Plain and simple.
 
First off I want to say thank you to KNOBtail. I appreciate how you leveled with us in your last post and admitted you lied. Now all you need to do is finish paying the $800 outstanding balance and no one will care what you do with that skink.

Also your underhanded insults to Ben and his employees is kinda pathetic. The only thing I would call a fault on their part is the fact that they trusted you with anything. Oh well. They may take an $800 hit but it has opened everyone's eyes.

On a personal side note. I won't be ordering my fly cultures from you Jerry. I recently contacted you about some because I am looking to get some froglets. After your couldn't careless attitude where you were unable to actually communicate via email I will just have to find a new supplier if I do get the froglets.

So let me get this straight....Apparently you didn't comprehend what I said on page 8 in my first post in this thread.

First of all...what does Ben's hobby with fishing have ANYTHING to do with the fact that you won't complete a sales transaction? Basically you just told us that you don't want to pay because he is stubborn and likes to fish, and in the next paragraph you say that his manager, Billy, is basically inept...and therefore you shouldn't have to pay, or almost just as worse, only make up for the "cost" of the animal.

Yes, sometimes sales agreements are done on good faith. I worked in the shipping industry. If a situation arose where I needed to outsource a delivery or a service, to do _____ at _____ time for _____ reason, then the XYZ company I called would go do it knowing that we had just entered into a sales contract, which then, after the service was provided, an invoice would be sent and funds would be dispursed to their accounting department. I'm pretty sure transactions such as these, done IN GOOD FAITH happen every day, all around the world.

Basically, what you have just told us, that under a sale in good faith, under the TOS of Ben's Live Animal Guarantee, that the fact he came to you and asked you for the remainder of the funds (basically sent you the invoice) and you refuse to pay, or pay less than the agreed upon amount...that this is OK?!

In your last paragraph, you once again hint at your displeasure at dealing with Billy (as you feel he is incapable of meeting your requirements upon fulfilling a sales agreement) and wince out another excuse that Ben is at fault because, (quote) Ben was never there.. He was fishing.

Pathetic. You clearly do not understand business law, good faith laws, contract agreements, or even just manning up and accepting the consequences for an apparent lack of following protocol.

Your past transactions with Ben have nothing to do with this one. Each sale is independent of itself. So...I invite you to read my post on page 8 where I clearly describe the events of the transaction you made with Ben, and where you have fallen short, and what you need to do end this. Better Yet, I will make a shortened list for you.

1. You entered a sales agreement. 10% up front, 90% to be paid off.
2. 7 day Live animal guarantee starts.
3. 7 days later, the guarantee ends.
4. Appx 21 days later after the sale. you claim animal was sick, died, and the body discarded.
5. #4 does not apply at all to sale because it is outside the time limit.
6. $900 still owed on animal...
7. You refuse to pay.

Just about as basic as it gets. You still owe money on the animal. Try returning a broken TV to Best Buy or Walmart after the manufacturers 30day standard warranty. If you put the TV on a payment plan...you are still required to pay it off even though the TV is no longer working and not under warranty.

The logistics of the business transaction alone find you at fault of completing the contract...all these excuses for "he likes to fish" or bringing up the death at Ben Siegels storefront have, once again, NOTHING to do with your business transaction with Ben! He doesn't want the cost of the animal to be paid off...THAT IS NOT HOW THIS WORKS! How is this not getting into your skull!?! PAY HIM WHAT YOU LEGALLY OWE HIM!!
 
Sorry, one last thing for now...

If Ben is an "absentee employer" and that gives you some sort of right to not pay for the animal you purchased...do you ask for the owner or CEO of any company you shop at to be present when making your POS (thats Point of Sale) transaction with your local market or wal-mart or Best Buy or restaurant when you eat out, or gas station, or fast food, or....well you get the picture. All of those employers hire Managers...who manage the stores...and complete sales transactions...and adhere to company policies (such as TOS's)

Bah, I am getting too involved in this. Common sense about the solution to this screams to me like it does everyone else in this thread....except, that is, for Jerry.
 
I emailed him about the DOAs and he said he'd send replacement flies as soon as it warmed up. I thanked him and waited, and waited, and waited...
He then replied that he wasn't going to send replacements and that he would no longer accept emails from me.

Dont want to get into details. I will say Jerry tresser came into our store and purchased a monkey tail skink....I came to Jerry to resolve to resolve this issue as at this point he had not as much shown us a picture of the deceased cb corucia...

I too was dumb in falling for Jerry's tactics from the old importer ways.
I sent Jerry 2.4 Sauvegi Frogs from Paraguay.
These 2.4 were sent to him without payment processed due to the fact that he had a good "reputation" and was an "old timer"...
...We realize we never even got his card information, so call him up to finalize deal. He doesn't pick up.
He doesn't pick up for DAYS.
... I go up to him and ask him about the payment on the frogs. I had to remind him which frogs, and he said oh they all died, I am not paying for them.
No proof of bodies, no contacting us to let us know, no answering calls, no anything from him till I surprised him at Ben's shop. .

After all, this is my modus operandi.
Now there's an unintentional nugget of truth.

What we have here is a pattern of behavior. Several examples of you choosing to disregard your obligation to follow through with business transactions that you willingly entered into, while hiding behind lame, and likely false, rationalizations to justify not paying up.

It's interesting to make note of all the cited comminucation issues people have had with you. Surely, it's just a series of coincidences that people have had so much trouble getting ahold of you to collect what they're owed. I guess they're all liars, and you're the innocent victim here, right? :rolleyes:

Just in case you'd decide to whine that your other Bad Guy thread is irrelevant to this one (assuming you're willing to abandon your childish passive-aggressive choice to not acknowledge most people posting), you'd be incorrect. Unlike the unrelated gibberish you keep spewing, in regards to Ben's recent contest; the other thread is another shining example of said modus operandi.
we prefer to maintain an atmosphere of a healthy business relationship with everyone we sell to..on trust. Its that simple....

But it goes one step even further than that in ridiculousness because bringing in the broken TV is at least proof (well, not that you didn't break it yourself but it's something) whereas this is like going in without the broken TV, telling them that it broke, and refusing to pay. The police would probably be called for theft.

Oh yes, my apologies! I was assuming that in the case of a broken TV from Walmart or Best Buy that said TV was brought back and proven beyond a doubt that it was broken! If it was within the warranty time period, said TV would be repaired or replaced as per the warranty! (of course only for manufacturers defects...not for the fact you threw a football through the screen)

In Jerry's case...he didnt even bring the animal in, let alone document the issues and give proper notice! Sorry bub. This is one of those times when you gotta own up to the fact that you are SOL....kinda like the guy I saw today peel out at a green light and speed down to road....and failed to see the cop right behind him at the light!
