In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Sellers Beware of John Franco!

Wow so she hasn't even refunded the second payment? The one she has no right to according to her mighty TOS?

Must feel nice stealing from people.

I do understand where you are coming from, but the (possible) victory may prove Pyrrhic.

Sometimes it is very wrong to be right.
Notions that the OP clearly hasn't stopped to consider.

Yes, I could have done a better job of representing the animal and in the future I will clearly state Male, Female, or It, but it is also NOT my responsibility as a seller to make sure you read my clearly stated TOS.
I think a reasonable person would waive their TOS once they realized that their own words were misleading. This seller's refusal to accept any culpability for her own self-admitted mistakes - ones that directly contributed to this situation becoming what is has - may just be a huge turn-off to more than a few people. Having acknowledged that you played a real part in this, I think you forfeit the right to whatever perceived high ground you feel you're occupying.

She must really need the remaining $150 really bad, to stick with her TOS, even though she is clearly in the wrong. She even admitted it.

I'm sure she will lose a few sales over this.

No doubt, however she can still turn things around. $150 is simple not worth the long term damage.

it is also NOT my responsibility as a seller to make sure you read my clearly stated TOS.

it is your responsibility as a buyer to know the product your buying and the terms you're agreeing to before you send payment.

So let me get this straight... you messed up, he messed up. However, you have $150 to show for it, and he has nothing.

What in the actual heck makes you think ANYONE reading this will want to voluntarily do business with you, know you're an unreasonable TOS Nazi? Is this really what you're hoping to accomplish? I know you're all "these are my terms, my hands are tied" and "i have a TOS for a reason" and blah blah blah. No really, it's adorable how you're pretending to be a big shot company with inviolable TOS because you have a global brand to protect.

What you ACTUALLY have is a tiny, tiny company that no one outside a fairly small community of exotic animals will ever care about... and newsflash, they usually check HERE before doing business. If you are really this intent on cutting off your nose to spite your face, business may not be your thing. Keeping his deposit is a jerk thing to do, given YOUR errors in this situation.

She isn't turning anything around now ... the damage has been done. Even if she returned the money at this point, would you deal with her ??

I would never consider buying from her .

I do hope future buyers see how she'd rather keep $150 for HER error that invalidated her TOS. Mariah Peterson basically scammed him out of $150, would have been $300 if I hadn't brought up the fact that she told John she was going to refund $150.

Her business is tiny compared to others I know who breed geckos.

I wouldn't either but my point is; I'm thinking people tend to read the first few pages of these longer threads then skip to the last few pages to see how it ends. imo An opportunity to lessen the damage.

Some do, some read the whole thing.

I've tried to work with John on this but he has done nothing but ignore what I've said and treated me with total disrespect so at this point I can't do anything more.

You could refund him. You should refund him. As a result of this thread that YOU created, a large number of people are telling you that you are in the wrong and how you should resolve this. An even larger number of people are reading this without posting, the majority of which will have the same opinion and will avoid buying from you as a result. It's bad for business when people see you take $150 from someone and give them nothing in return, especially over a miscommunication/misleading advertisement, however you prefer to view it.

:iagree:
Considering everything, I am disgusted by this seller's decision to not refund the entire $300 to John Franco.

Me too.

She has decided our input is garbage & will believe her cronies. However, this will come back on her.
