I think a reasonable person would waive their TOS once they realized that their own words were misleading. This seller's refusal to accept any culpability for her own self-admitted mistakes - ones that directly contributed to this situation becoming what is has - may just be a huge turn-off to more than a few people. No doubt, however she can still turn things around. $150 is simple not worth the long term damage.She must really need the remaining $150 really bad, to stick with her TOS, even though she is clearly in the wrong. She even admitted it.
I'm sure she will lose a few sales over this.

it is your responsibility as a buyer to know the product your buying and the terms you're agreeing to before you send payment.

I wouldn't either but my point is; I'm thinking people tend to read the first few pages of these longer threads then skip to the last few pages to see how it ends. imo An opportunity to lessen the damage.She isn't turning anything around now ... the damage has been done. I've tried to work with John on this but he has done nothing but ignore what I've said and treated me with total disrespect so at this point I can't do anything more.
You could refund him. You should refund him. As a result of this thread that YOU created, a large number of people are telling you that you are in the wrong and how you should resolve this. An even larger number of people are reading this without posting, the majority of which will have the same opinion and will avoid buying from you as a result. It's bad for business when people see you take $150 from someone and give them nothing in return, especially over a miscommunication/misleading advertisement, however you prefer to view it.
