    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Touch of Class Reptiles

Jason, I believe you, man. But 51 hours? I'm sorry, but if I am taking delivery on $500+ woth of herps, than my boss AND Beyonce have to wait. Again, I believe YOU. But can't you see that 51 hours gives these &$#%@s all the legal ammo they need? My unsolicited advice, NEVER put yourself in this position with strangers. EVER.
 
Ya, $500 would be worth risking all the money he has invested in veterinary school. On call during your practicals is a big deal. He had them safe and secure.

51 hours does not give them any legal ammo. Immediately could mean less than 51 seconds by the company interpretation, but the law goes by a reasonable person standard. Less than 3 business days, especially when a person has such a demanding commitment, would certainly qualify as immediately by any reasonable standard....and certainly to file a complaint with the detail and evidence Jason provided. He also has solid proof that there was no medically possible way for them to obtain the illnesses they did within a 51 hours and 45 minutes, so it is a completely moot point.

I went to college, got good grades in my law classes, and watch the People's Court : )
 
You can file complaints all you want but what it really boils down to is that more then likely Jason still won't get his money back at least not for another 6 months if not longer or at all.
So lets say he files charges of check fraud and for the fees (including vet costs) for the animals and for court fees. IF said scumbag is found guilty he MAY get jail time but more then likely will have to just pay all fees /restitution. Now how do you suspect they'll make the scumbag pay all that when he has no money??? No traceable income??? I'm almost 100% positive that that his Touch of Crap business is all under the table. Which is not traceable via a SSN (if he has one). Bank accounts can be quickly closed or left negative.

So that would still leave Jason without what he was promised.

It's true, can't squeeze blood from a stone, and I imagine as a vet student Jason's time is quite precious. Just throwing the options out there on what can further be done to legally make things difficult for ToC.
 
Ladies and Gentleman vet school costs in excess of $$$150,000.00 which is quite a bit more than 500.00 and thats not even to mention that I have the lives of living, most times critical patients that I am required to provide care for. If it was your animal in my care, would you appreciate me bailing on your pet in a time of need for some business deal I worked out in my private life? I don't need to comment further on that.
 
Also I am very sad to report that the other snake has passed away today, despite recent improvements shown. I will be performing another necropsy and this time photos will be of the up most priority. I will post them for all who are interested, to see. To sum up my entire experience with Kelvin Soto and touch of class, I purchased two emerald tree boas, received two corpses, got a check that bounced and no reply to my emails. This is not even to mention the money invested in veterinary services. This is one of the most unpleasant experiences I have ever had with a vendor.

I wonder what was done with the $500 you sent them though...under the table payment to Alex Estrada perhaps. So I guess we don't need to take him out to lunch now do we Jason : )

Sorry to hear you did not get your money. Way to be super cool, and such an ugly situation. Soto's through on Fauna, and aside from the monetary loss, you've just gained respect points. Good luck with vet school.

I hope you didn't think that when I said to include vet fees in a lawsuit that I meant your tuition fees. In case you did (I know it sounds odd) I was meaning the vet fees you've spent caring for both animals, all the lab work, xrays, necropsy fees. :D

No. I have nothing to do with Jason's payment of $500 to TOC. Nor do i have anything to do with the bad e-check..i honestly thought Kelvin was going to do the right thing..i guess he decided not too..thats to bad for him..

I think Jason's comment on his fees was to Groundhog...who said he should have not gone to work so he could make sure the snakes were reviewed and ToCR was contacted "immediately." It was a silly comment they made, as the term "immediately" actually leaves Touch of Class Reptile more open to lawsuit.

Gotta disagree with the bolded sentence. IMO, coming here posting of one's innocence does not prove either the exsistence of integrity or lack of same.

There's still the issue of how a snake that he admits to have personally packed that was "healthy" per his statement, showed a remarkable decline when received per the OP's statement in post 1:
These individuals were exhibiting clear evidence of detectable disease visible to the naked eye and the photos advertised were not representative of the disease state they were in at the time of shipment.

Just saying...:shrug01:
 
Mike, the comment was slightly tongue in cheek. I think I gave Alex Estrada plenty of credit in previous posts. All I was suggesting was that Jason's money went to paying Kelvin's overhead, not back to the owed customer...so Alex would be in a better position to buy lunch than Jason. Unless of course he is getting screwed as much as Soto's customers, which I suppose would not surprise me either. After all, Estrada did put in his notice.

I gave Alex tons of credit when Soto made out the check. But I did that because I believe he was going good and was a critical aspect for making Soto aware of his flaws. And with this in mind, it makes no sense to lift the weights off an affiliate when they are still in the power position. Again, when the correction gets made, Alex gets the credit, and Alex, Jason, and I have lunch at my expense : )
