    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Something stinks here ....

Besides all the excuses surrounding the refund, and the noble "exception to TOS" that so many of us seem to fail to appreciate, I am having significant difficulty swallowing the excuse that although Adam deposited final payment more than 3 weeks before the Daytona show, he claimed he was so engrossed and occupied by that preparation that there just was no proper time to get this snake shipped. I could understand if the time-line were inside of three days, but three weeks? I don't presume to know the real reason for not shipping, but it wasn't that. I might have been born at night, but it wasn't last night! There are other inconsistencies here that really stink as well, or put more bluntly, excuses that seem like a whole lot of hot air, and frankly don't sound believable. Seems like I have this little reptilian devil on my shoulder that wants to put a big BS stamp on so much of what's been said here. If I'm being too much of a Doubting Thomas, LMK.
 
Let me get this straight "NOW HE HAS TO WAIT" another 30 days ????? I hope he is getting interest on that money to boot Adam it seem like your just playing games here and this board will destroy your company. And I'm sure you dont want that road traveled trust me..... :rolleyes:

You have the money and refuse to refund it. Plain and simple you have money that is not yours. Matt has nothing to show for the $2600.00 he sent you and at this point is $2600.00 in the red. You on the other hand have been sitting on $2600.00 No doubt collecting interest and it is not even rightfully yours.

I would not buy a cricket from your company at this point. I also hope that Matt contacts his CC company and disputes the charges. Following up in civil court would also be a good thing to do. Go for the remaining balance, interest and anything else that you may be out because of all this......

Millennium Morphs should be ashamed of itself.

Nah Jim, I think you are right on. Daytona is a "really big shew" but it doesn't take 24 hours a day for 3 weeks to prepare for it.

Fact is, Adam offered the man a full refund. So Millenium Morphs aka Adam's TOS does not mean diddly any more, in this particular deal. Also, when Adam offered a full refund, he never stipulated that the cash would be refunded ONLY after the boa sold.

I certainly won't be doing any business with Millenium Morphs. Yeah, I know Adam, you are probably thinking you don't need my business anyhow. But the "little guys" such as myself that choose not to deal with you because of this will add up and become a "big problem" for you.

The only possible way for you to redeem yourself (in my eyes at least) is to send a refund in full to Matt, pronto. Whether the boa sells or not.

That is not fair. I should not have to wait another 30 days. I have waited long enough. Show me where I agreed to waiting for her to sell. You gave me no choice. You had the animal and my money. Look at your email again (posted below), it says you will refund my money ASAP. You mention that you think she might be sold, but you never say that the refund is dependent on it. Give me my money!!!

I had just received your email and have a couple of words in my defense. I spoke to you earlier and you said you emailed me, so I checked. First of all, I appologise for the small delay. The last payment I had received from you was deposited in the beginning of August. I told you I was busy with Daytona and all, you said OK. I have been super busy with shows since then and have been slacking off with my emails, because I have had no time. But I was shipping this week like I told you. You had purchased this animal MAY 26th and I finally received your final payment in July or August. If you recall I did not call you once to bother you for money. That is the main reason why I do not understand why you are so upset that you did not receive your snake yet. It is mid september and it was going out. We agreed that you would receive it after Daytona and it has been just about a month. So you did not loan me money for a snake you didnt get, you paid me in dribs and drabs for months. Which I was kind enough to accept, even though I had the animal sold to 10 other people the same night for full payment instantly. I am not angry at all and will give you your money back in full, But I want you to understand I tried working with you as much as possible and got a little busy this last month and was getting you your animal this week until you cancelled the order. So please understand and accept my appologies for what there worth. I am reselling the animal and will be selling it for alot more than you paid. If I get alot more for the animal, I will pay you for the 1/2 day of work that you missed due to our miscommunication. I didnt want to ship the snake without hearing from you. And it was my fault that I didnt ceck my mail. So I will try my best to make it up to you.
I will refund your money asap. I think I already sold her. I am just waiting for a response. I will post her tonight and hopefully sell her by the end of the week. Once again I am sorry and will make it up to you ........Thank you

Alright, I have just read this whole thread in its entirety, but I may be missing something here... Where did Matt agree to wait until the animal was sold to get his refund? I don't see it anywhere in any of the e-mails (though there is a ton of information and I possibly missed it, though I don't think so). Nowhere in the e-mails do I see, "I'll refund your money only after the snake has been sold."

As for being amazed at how he wouldn't accept shipment on another day... I can't blame him! If I missed half a day's work to receive a shipment that apparently was never shipped, do you think I'd miss another day just to have the same thing happen over again? No way. He's already waited MUCH longer than I would have and given you quite a few more chances than I would have as well.

You claim that you have the money to reimburse him. My advice, refund his money as soon as possible because it appears as though you're just making excuses and hiding behind your TOS. Honestly, if you wanted to come out clean, I'd refund him with interest. You've had his money for quite some time now (C'mon it's OCTOBER!) as well as the animal, and Matt has absolutely nothing. Refund the money now and come out clean(ish) or refuse and have whatever may be left from your previous good reputation go straight down the tubes.

Here's your analogy as to why Matt and the rest of us are being unfair in how we view you vs. a possible dispute with a local store:
I said to the people who do not understand, to go down to a local store that has a no cash refund policy and to buy something. Then go back a couple of days later and try to get a cash refund. You will be bashing that store on the BOI along with Matt Crabe. Do you understand a little more on where I am coming from. I am just being realistic

There are several relevant parallels that do not exist in your analogy, but let me point out one of the biggest !!! AT LEAST I WOULD WALK OUT OF THE STORE WITH A PRODUCT THAT I PAID FOR, AND WOULD BE IN POSSESSION OF VALUE FOR MY HARD EARNED MONEY (or credit obligation). I'm trying to imagine myself walking into a store, handing tham $2600, and then walking out with nothing except a promise not kept, and trying to justify the silly smile on my face. Something stinks in Denmark. You Adam, are "not being realistic". Still no posts supporting your position, eh?

Adam, stop with the Company Policy BS. Once you agreed to give him a cash refund , your "Company Policy" no longer means squat in this situation.

Matt, you don't have to wait 30 days, call your Credit Card company right now, fill out the paperwork and get the down payment reversed. Tomorrow, call the county clerk for wherever Adam is located and get the proper paperwork to file a civil suit. Then the judge can decide how applicable his "Company Policy" really is...

You sir, are the one that don't get it. You are very much at fault, regardless of your TOS. It is now OCTOBER 18th. Matt made the final payment on July 27th. That is almost 3 months and you still have not sent his snake.

What part of that even begins to sound right, fair or even remotely professional?

You keep wanting to blame Matt, use your TOS as an excuse, but the really bad part is that you refuse to take any responsibility for your own screw ups. You cant look in the mirror and take any responsibility for your own mistakes in this matter.

You are in the wrong. We know it, Matt knows it AND EVEN YOU KNOW IT.

Here are some questions I have. If you have been selling snakes and dealing with the public for as many years as you say you have, then you should have known how busy you would be this time of year when you made the deal in the first place.

Secondly, if you had shipped to a buyer first (hypothetically!) and two months had passed since you were supposed to receive the money, you would be staring at this thread with a whole new attitude. Whether you tried to "screw" him or not is irrelevant. The fact is that you admit to being to busy to fulfill your end of the agreement on time, and you admit to being to busy to check your emails. You failed to answer the phone numerous times when Matt tried to call you. So how can you say you bent over backwards to help him. It doesn't sound like you have even crouched a little.

You also admit that you are willing to ruin your reputation in order to stand behind your so-called TOS. I will be sure to put you on the list of people to not do business with, EVER!! You obviously care about yourself more than your customers. Too bad it took this long to find that out.

DO THE RIGHT THING. And let me tell you what that is since your vision is blurred, or blocked. Send the refund and don't make arrangements on deals that you know you will be to busy to fulfill. Live and learn, man. But don't screw people over.

How someone like you could become "President" in more than a one man corporation is beyond me. Adam this is getting ridiculous. Your terms of service on refunds allow you to keep his money and his snake because you said so. If you decide to keep the snake, but tell him it just has not sold yet, you are stealing. Yes I said it, you are stealing.

By the way, I thought you had that snake sold over 10 times now. Or is that a lie? Making him wait 30 more days, are you for real?

This is not about your BS policies, this is all about you getting $2600 and never shipping. Matt did NOT change his mind, you screwed him on the shipping, your TOS does not even come to play in this case.

If payment is not received before the 30-day period has ended, the buyer will FORFEIT the entire deposit and the animals will be sold, unless otherwise agreed upon. Deposits are refundable only if we cannot provide you with your specific order

I love this line here "only if we cannot provide you with your specific order" You did not provide Matt's order. Keep to your TOS!
 
Ok guys, I think enough has been said to get all of our points out there. Adam and Matt have head them loud and clear. With Rich and the other modertors cleaning the place up I think we should scale things back a bit. We are fast approaching the " beating a dead horse" stage. JMO

Matt at this point needs to do what he feels he must. Adam in turn has said Matt will get a refund in 30 days. It is up to them to work this out. If either of them need help we can be here to offer it. We certainly don't need to say the same things over and over and over.
