Anthony McCain. I will vouch for Derek's integrity and that he is a good guy, although this is not the

issue in this thread. The issues are just compensation in this case and the business practices of Anthony

Mccain.

In this trade, everyone's goals & motivations are as unique & time sensitive as morphs & prices. If Derek

resolved the other het issue, it has no bearing upon the unique transaction at issue.
Perhaps Bob Clark should have settled for purchase price in the stolen albino case

compensation of financial liability extended to possible progeny. Misrepresentation of an animals

genetics is fraud, according to filings by the NY Attorney General against Christopher Johnson of TSE

fame, where the plantiffs would love to recover even the purchase price. So clearly there are possible

case specific legal issues here. I hope the misepresentation was not deliberate, but did occur, and

liability rests upon Anthony. If Derek wanted only to harm Anthony financially, he would have filed a

lawsuit instead of starting a thread. The "ballpark" could go the direction of the Clark case,

considering time frames and clutch values.

The specific issue is a 100 het albino female, admitted normal, that required time and upkeep to raise to

breeding size while albinos have fallen in price. Derek tried to negotiate an acceptable solution before

this thread was posted. Anthony's reputation in this area is tarnished, at best. What Anthony said is

part of this, as threats add additional issues (and possibly charges) while honesty & respect will help

resolve issues like these.

Anthony has an opportunity to resolve this professionally & politely earning respect & positive

reputation worth more than any minor financial loss on this specific transaction. Recessive Het value is

a reflection of faith in the breeder, so what is the value of all future recessive hets from Anthony?

I finally have internet access for a bit now. So I figured I would come back on here to keep going as a refund for the snake and "thats all " is just not acceptable . Nor is a Mystic Ball python for reasons I have already stated.

As any have read in the emails , Anthony plainly admitted this was a normal. Then Anthony admitted he bred a sister "het" to an albino , and got no albinos.

I don't beleive this animal is a het, but to disprove anything. I am willing to re breed the animal this season , anyone near Woonsocket , Rhode Island , can come over and check them out breeding , so there is no confusion.

After this year , if we see no albinos come out , Anthony can compensate me for lost albinos of this past season , this upcoming season , and for the adult het female at this years price. The 100% Het Genetic Stripes and the purchase price also.

If I am wrong , then I will publicly apologize to Anthony McCain and to anyone I have turned away from him .

Anthony , come on here and post , don't email me , say it in front of everyone.

I can't see a better way to disprove this . thanks again all

that the snake he sold you as a Het Albino was actually just a normal, and he knew it all along? Simple yes or no answer. I have read and reread some of this post, and cannot find anywhere where Anthony says that the female he sent you is a normal.

I honestly think that you, Derek, are doing way, way more harm to your reputation than to Anthony's. You, Derek, look like the raging lunatic on this thread. You are being totally and completely out of line with what you are asking for. Who in their right mind is going to sell ANYTHING to you now, after reading this? Mistakes happen, does not mean you hit the lotto just because one of your snakes from Anthony did not prove out in the first year/first breeding attempt. I think, as well as most people reading this thread, that Anthony bent over backwards for you, and you just got your feelings hurt, and are not being realistic in what you are asking for. Anthony has gone way above and beyond, and if he tells you to get lost, at this point, who could blame him. I am not a big Anthony fan, and agree with some of what you have said about the way Anthony treats people, but when you are an adult, you do not let getting your feelings hurt interfere with business. I will probably do business with Anthony again, and yes, he is arrogant, and abrasive, but I am an ADULT, and can deal with it.

I can count on one hand the number of people that I would buy hets from right now...there is simply too much of this fake het stuff going on and it takes too long to prove them out!!


Refunding someones purchase price a year or two after the fact isn't fair compensation, imho...

buying a het is a gamble. You pay a lower price and have the chance to produce a visual morph. Some hets don't prove out immediately could take several years. Most people realize that. Lets say they prove out next year does the breeder who had to give a refund plus time and every other thing this guy is demanding get his money back? I bet not. I have friends who purchased visual morphs and the pairings didn't take. Does this mean they are entitled to a refund plus time and effort etc etc..... This is just crazy

Scott, I totally agree, and as I told Derek earlier in the thread I think that once/if it is proven that the girl isn't a Het. that he should be fairly compensated. That being said, his demands get more ridiculous each time he posts, in my opinion at least.

There have been many people in this thread trying to calm you down and talk some sense into you. I guess I'll give it a try. Most people's Het guarantees, at best: 1) cover the purchase price of the animal and you get to keep it... or 2) they will replace it. You should consider yourself lucky that Anthony was attempting to work out a resolution with you, he is already doing more than all of the bad guys out there that we have seen. If the Het doesn't prove out next season most would consider a full refund, and you keeping the animal a just resolution. If Anthony feels that giving you more is in order, it would be an admirable thing, but I have a feeling you have already burned that bridge with your ludicrous demands. Anthony Offered you a Mystic. You should have asked him to try and sell it to pay you, or accepted it and tried to sell it yourself (It was after all worth more than the Het you purchased). Anthony offering you the Mystic was premature in my opinion without a second breeding, and it was a nice gesture.

Nowhere in Anthony's email did he admit to the same being a normal, you have attempted to spin his words. If the snake does not prove out, you are completely out of line to ask Anthony to refund you for the Het Genetic Stripes you purchased from him, that is a completely separate transaction. If and when they don't prove out (which I'm sure they will) you will have a new situation to resolve as a SEPARATE issue.

Here is a comparison.

You buy a new computer monitor for work. After a few months the monitor breaks, and you call the manufacturer. They offer to send you a replacement under the terms of your warranty. You don't want a replacement, you want a refund. You then demand the manufacturer pay you $xx.xx because not having a monitor disabled you from selling your merchandise on-line. You also demand that the manufacturer take receipt of all other products you own of the same brand, for a full refund. I don't think you are going to get very far.

If the Het doesn't prove out next season, and Anthony doesn't give you at least the industry standard Het guarantee, then he is a bad guy.

At this point this thread seems more like a SELLER BEWARE.

Anthony stated something to the effect that he didn't know why you didn't get albinos but that he also bred a sister het of your het to an albino and had 1 out of 6 eggs perish and that he did not get any albinos. Thats pretty much what he said and went on to offer you very fair compensation in my opinion. He never plainly admitted that he sold you a normal as a het.

You have it in your head that you want what you want and nothing less will do. You might get to the point where Anthony just tells you feck off and with total support of those reading along here. Make a deal for fair compensation with Anthony and just put this behind you.

You are correct Chuck and thanks for clearing that up. Lots of breeders have had hets not prove out immediately. You have to love genetics LOL because it doesn't always work in ones favor.
