Ok, first, my name is Candace Owings.
I've been following Ben's auctions on facebook for awhile, since he started posting them really. Never heard any negative comments about any of the animals. I had bid a few times but never won anything.
I bid on this male blood last week http://www.facebook.com/photo.php?fbid=1761791704254&set=t.1313541453&type=1 I have been searching for a male, for a female I already have, for over a year and this one appeared to be a suitable match so I went for it and won. Not "the" male I had been searching for but he would work. I figured all of the pictures I'd seen of everyone who posted pics after receiving animals from Ben looked better then in his pics so why not.
I received the male this morning, unboxed him and gently took him out of the bag to look him over. While removing him from the bag I noticed something on his neck and when I got him to the light I was a bit shocked at what I saw (see below pictures)
I immediately called the store to notify them that the snake was injured but there was no blood in the bag and to ask if they knew about it and what was going to be done about it. I spoke with Stacy, she asked me to send her pictures, which I did via text because my computer was not turned on yet and I already had my phone with me and it was faster. I hung up, took the below pictures, sent them and then called back. I spoke with another girl at the store at that point at which time I was told Ben was not in yet and they would have him call me as soon as he walked in the door. This was all over the phone so I have no documentation. It was also at 11:00 am, I was told Ben would be in by 1:00. At 2:00 I still had not heard anything back so I called again, spoke with the second girl again and was told, again, Ben would call me that he still was not back yet.
At 3:00 I received a text from Stacy saying that they were sorry it had gotten over looked, she must have missed it while bagging the snake and I was entitled to a full credit of the amount in auction credit. Now yes, i've read Ben's rules multiple times and this is what it says:

"GUARANTEES--We have a 7 day live arrival guarantee on retail animals. All claims are handled with store credit. Regular purchase store credit cannot be used on auctions. Would be very hard to keep up with. Auction animals carry the same guarantee however any replacements for auctions will be auction bucks in the amount of the winning bid. Being that auction animals are often unique this seems like the fairest way to handle any loss. WE RARELY RARELY have any doas or loss, so this is just to clarify in case."

Nowhere does that note if the snake shows up injured, to me the way that is written makes it sounds like that only applies to dead on arrival or dead within a week animals. I thought, since i still wanted to keep the animal, maybe a partial refund because I didnt want to bid on anything else but I also didnt really think $120 was fair for an injured animal.
I texted Stacy back asking if there was anyway they could just do a credit back to my paypal account instead and around 5:00 got a responce of "No, sorry, we can only give you auction credit"
Well I did not really want auction credit because being as they did not even have the decency to have Ben call me and talk to me in person to handle this, I'm not sure if I would want any other animals from him. Me being upset by all this, I posted a status on my facebook about it but never mentioned any names and as I have about 4,700 friends, it got a lot of attention. One girl in particular asked me who it was, I told her if she really wanted to know she could PM me and I would tell her but I didnt want to post it for the world to see yet because Ben still had a chance to make things right with me. I figured, ok, you want to keep is as a credit, thats fine, what if you send me pictures of the bloods you have in the store that you would be willing to part with for $120 shipped and I can pick one out and buy it from you, I was told no, that it MUST be used to bid in an auction that i'm not guaranteed to win or guaranteed that he would post anything I would remotely be interested in anytime soon. I dont make a habit of watching his auctions as I am busy and have other things to do and I dont like having money sitting around when I have bills that I could use it towards but since I wasnt allowed a true refund, I thought that letting me buy an animal with the credit was a fair offer, apperently Ben thought different. So I then asked him what would happen if I were to submit a claim on paypal about it.
Back to the PM comment from earlier, mind you, it's called a private message because it's a private message, I'm allowed to voice my opinion to whoever I want, that's called freedom of speech, Ben seemed to think differently because at that time he commented on my status, outted himself as the seller, called me rude and asked me to stop "smearing his name online" which I had not done. He then proceeded to call me from the store phone and then Stacy's cell phone at which point I answered.
I have never been good with conflict, I don't like arguing, my mind freezes, I can't think, I cant talk. I was bullied a lot in school and the phone conversation with Ben took me right back to that time. He kept asking me why I was upset and why him offering to let me keep the snake for free and give me auction credit for the amount paid wasn't sufficient. How do you explain to someone who sells so many animals everyday that I didn't bid on him just so I could have another blood, I don't collect them, I selectively buy good stock that I can work with because I am a blood breeder and just because he posts up a blood python and tags me in the picture means nothing to me. Having auction credit sitting there waiting till god knows when he has something else that peaks my interest is a completely waste to me not only because they money could be used for other, more important things, but also to the fact that it's an auction, there is no guarantees i'm going to win anything. If he is willing to give me my money back, then give me the money back and be done with it but dont force me to use it to bid on other stuff you have just because you want more business. And more to the fact, who is going to say that the next one wont come in injured either?
Ben openly admitted to me on the phone that I was not the first person that this has happened to but all the others thought his offer was fair and accepted it, ok fine, I am not like everyone else, I actually care about the well being of the animals I buy and am very picky about which ones I will actually purchase. By this point in the phone call I was crying, he had actually upset me that much. He was asking for me to apologize to him for smearing his name, which I never did, this is the first post I have made about it. That man is manipulative and knows how to use his words to make you think that it actually is your fault, he will take anything you say and flip it around to make it sound like you are the one who did wrong.
Now he did admit that they over looked the injury BUT there's no way that it wasn't seen, note the last picture I posted, the one from the auction. The part where I have circled, only now that I know where to look, you can see the injury. So this poor, little, sweet, snake has been injured since before the auction even went up. Also note how the snake is positioned in the pic so the injury is not really visible, almost like whoever was taking the picture knew it was there and was trying to hide it. Yes I saw that section of the photo beforehand but it just looked pixelated to me and I thought nothing of it at the time. Ben still swears up and down that no one noticed the injury on this snake but I find that hard to believe as it is 3/4" long and fairly open. it looks to be only about a week into the healing process.
At this point I was so fed up with dealing with Ben that I told him to keep my money, I'll keep the snake, he will have a good home with me, I will get him healed, he will have a scar for the rest of his life and the fact that it is in the shape of a lightning bolt is why I named him H.P. (short for harry potter, yes I'm a dork and I love it :) lol ) but I'm ok with that. Ben then emailed me a UPS label with which I was suppose to pack the snake back up and ship him out tonight. I never wanted to do that, that was never an option, nor is it going to happen. I'm more upset that the snake was misrepresented, arrived injured and the "compensation" I was offered, to me, was bull, I don't want to bid on more snakes, I don't want to ship the snake back to you, I just wanted at least a partial refund, it didn't even have to be the whole thing but apparently that was too much to ask and required yelling at me and prodding on the phone till I was in tears. That if you ask me is highly unprofessional and is not the way you handle anything but according to Ben, I'm the one who is wrong and I need to be apologizing to him.

Unfortunately with me getting upset, I deleted my status off of facebook and Ben knows I am posting this and I'm sure will jump in with a counter. I am NOT bashing him, just stating what happened today and how things were handled because I don't think it was right. At this point, I don't care if I get my money back or not. All I care about is the well being of the snake and knowing that he will have a good home with me and if that's wrong then I guess I'm wrong

Definitely, Ben has been a hit and miss guy with alot of people I know. He has a nice store but the staff has little knowledge of the animals and Ben can come across as a real jerk.
 
That snake was clearly chewed on by a rodent. If Ben didn't see that when he had it that just show the care he gives his animal and I don't care the number of animals he has they should get better care than that. I would be embarrassed to sell a animal like that
 
I'm an active member on his auctions. Constantly in the store. I've seen into the back a few times and as I have never been back there I can't say much. I'm neither agreeing nor disagreeing with anyone however that snake was badly injured. I noticed it in the auction but didn't not want to be removed from further purchases. And I do wish you the best with him. If you would no longer like him please send an email my way and we can work something out. I'd be happy to help this guy.
 
Pfft...I sure would not have noticed that in the auction picture unless I was looking for it =(
 
i want to keep the snake, he is sweet and the scar that will result from the injury shouldn't hurt his breeding possibilities. I know i can get him healed, just going to take time and some antibiotics :)
 
Wow. You are right. You're darn right you have a right to tell others of your experience! I for one am very glad you did so. You have done absolutely nothing wrong in this situation and I must say, you have handled it very tastefully! I agree, this animal was definately mis-represented in that photograph. There's no way that injury was noticeable (without prior knowledge of it being there) in that auction photo. That is awfully coincidental that the animal was positioned in a way that the injury was concealed. No matter what way you look at it, that is just wrong, to sell an animal to someone that has such an injury (looks to be a nasty wound from a live feeder, which I won't even get into because this isn't the place) tp someone who is unaware. So let's say that they "didn't notice" the wound. You contaced them right away to inform them, and sent pics. Just like you are supposed to do. You're told BEN will CALL you when he gets in. Hours later, you get a TEXT from his wife? I am a small business owner, and if a client of mine is upset about something, you better believe I personally will be calling them and speaking to them. Not having my partner or employee send a TEXT message! That in itself wasn't very professional. You didn't slander his name on Facebook. You COULD have. He pretty much blew his cover on there from what I gather, then has the nerve to demand an apology from YOU? Sounds to me like he only got angry at this point because he knew he sent you an injured animal, and he didn't want the public to see. Only then does he finally decide to take the time to make a phone call to you? To verbally lash out at you? To the point where you end up in tears? Really? What a "man." I sit very quiet on here usually, but from what I have seen/read from past posts here, as far as this guy goes, either people are happy with what they get from him, or they are VERY unhappy, and usually share an unprofessional experience in dealing with him, and most state that he's prone to get a nasty attitude. NOT a way to conduct business. No excuse for that. There was no need for his dis-tasteful verbal assault on you. I sure hope you did not let this guy ruin your day, nor convince you that YOU did anything wrong here! And KUDOS to you for keeping that animal and being willing to put the extra care into his medical attention. Thank you for sharing this experience, so that others are aware of what they may potentially have to deal with one day should they have an issue with any animals they may purchase from this man. I always look at both sides of a story, but in this case, after reviewing the facts thoroughly, this customer has done nothing wrong, no matter how you look at it. Good luck with gettin' the little guy better!

Just thought I'd put my 2 cents in lol. I'm glad it at least went to a good home. I got a few snakes and sold a few from and to him haven't had a problem yet but I have a seen some bad incidents. Sorry you got the shit end of the stick. Hope everything works out. And as a breeder I feel you have the right for a partial refund considering your keeping the snake and all. Honestly I wouldn't want to send him back either. More stress for the snake and the possibility for them to say they never received it and keep your money as well.

I can totally understand why your mad since that snake was shipped to you with a scar/cut and you are entitled to compensation however the defect of your snake is not life threatening and it can't spread to your other snakes. It's just a half healed cut. Ben has offered you to keep the snake for free and he would give you full purchase price in auction credit and I think he also offered to have the snake shipped back to him and he would then give your money back...I personally think both of these offers are fair. If this was a situation were he knowingly shipped a snake that could risk the health of your other snakes then I would say give him h*ll but that's not the case.
 
Im not mad, im upset with the way it was handled and to me, only giving auction credit and not even be willing to do any kind of exception even for a partital disscount isnt right. I dont want another snake, wasnt planning on getting one for awhile and when my only option to get any kind of credit back is to purchase another animal? How does that make sense? Im completely over it though, im not worried about getting compensated, my only concern is getting the snake healed. I just wanted to let other people know about the experience I had today

Not from what I understand... Ben sent the shipping label but then only offered an auction credit. Correct me if I'm wrong.

I also hope your new little guy gets better soon. I don't understand why somebody needs to lie just to make a quick buck. I bet somebody would have still bought him if Ben told the truth or if he would have kept him a couple more weeks for him to heal and then shared that he has a scar. There are definitely other ways that this situation could have been handled. I am glad that you want to keep him though, he is a nice looking blood and seems pretty tame and sweet from the pictures! :)
 
Well I'm a friend of Candace on Facebook (I'm sure she will defriend me soon, LOL) but I seen what Ben wrote on her facebook status and the way I took it he was willing to send a shipping label to have the snake shipped back and he would return the money. I strongly feel Candace wants to keep the snake and get a full refund which IMO is taking advantage of the situation. I think it's odd how she deleted the status and post on her facebook page and then started a different one on bens page. I think if most people would have seen her status and the posts under it they would also feel she was trying too get her cake and icing. It was like she was trying to blackmail him into what she wanted but Ben called himself out and I don't think she was expecting that. I got no dog in this fight and am not a friend of Bens I'm just stating what I feel.
 
I won a couple of his slam deals and sent him payment through paypal. I thought I was going to get a killer deal but the money was never picked up and I never got what I was trying to pay for. No responses when I tried to e-mail him as well. Everytime I see something I might like to bid on since then I just think why bother. Even if I win I probably wont get it. I guess there wasn't enough of a profit on his slam deals and it was a ploy to suck people in for some very creative advertising. Either way I have been done doing business with him as well.
 
wow---cant beleive this got posted as boi bad guy thread. Ok--here is my full side and honest truth to the story. The whole truth and nothing but the truth. If I am not mistaken yesterday was quite busy. Getting packed because of the short week.

Candace was shipped a red blood python that had a pretty good size cut on it. We do not doubt that the animal had the cut when sent. It was overlooked. Sometimes when packing bloods they are not the most cordial animals. I am sure my sister open the bin picked the animal up and bagged it. We dont normally inspect bloods closely as they can be a handful. Regardless--the animal had damage and we did not doubt candace. My wife asked her to text or mail a pic over which she did. An hour or two later I get back and my wife brings the issue to my attention. I beleive Candace paid around $80 for the blood. I see the cut and that it is quite noticeable. I TELL my wife to tell candace to keep the snake for FREE and we will give her full auction dollars as well. All of our auction claims are handled in auction dollars. It is really the only fair way as most of our auctions go cheaper then retail, it would not be fair to give store credit, as they would win at a cheaper price, and then have to use the credit at retail price which is not fair to the BIDDER.
We thought candace, or anyone would be thrilled with that offer, as one---the snake is fine and even in the pic the cut looks to be healing. Had we caught that it would never have been shipped to her. But it wasnt and she liked the snake, so I figured free was a pretty good deal. My wife texted her back and told her that.

I then went to jump on Candaces fb to send her a message and notice a post she put up about how she got this animal and she is just waiting to out this guy for crooking her and blah blah blah. THIS IS AFTER WE TEXTED HER THIS! She wrote up on her post I am going to post pics and anyone who wants to know who it is private message me and I will let you know. I was shocked to say the least. About this same time she texts my wife back. My wife had texted her that all auction credit is in auction dollars and this is clearly stated in our auction rules and that she could keep the snake for free and we though she was happy. She texts--"so there is no way you could just do a refund to my paypal account"---so she is ok with keeping the snake, but want a paypal refund.

SO THEN SHE WRITES BACK---and I am typing this word for word from her text.

"so what happens if I file a paypal claim against it? I think its a little unfair that Im not allowed to buy another animal outright that your forcing me to bid on one that may or may even be what i want. Personally I would rather just have the money back, but if you want to give me store credit or whatever then fine, but let me pick out a blood and be done with it. I dont even care about male or female, send me pics of ones you are willing to sell for $120 shipped and end it at that or im gonna go ahead and file a claim"

NOT EXACTLY a friendly reply to what I thought was more then a considerate offer. Lets just say I am mad at this point as I have read the thing on her wall, read her text to my wife, and attempted to call her twice with no answer. So I post right up on her wall what happened.
I then tell her to just send the snake back and we will refund everything--all of it.-At this point I was even upset that I made the offer I did to this person.
Made a few posts to respond to a couple of her friends already bashing me, and then someone gets on (dont even know who it was) and says something like hey?? This guy is offering you full replacement and you are declining? How can you ask for anything more, and she takes down the entire post with my explanation and all. I finally get her on the phone and ask her what we did to her? I asked her repeatedly what will make her happy and what was her problem with us? I would ask and their would be these unusual long pauses between her responses. It was very unusual to say the least. I Left it with her--I told her to think about it and let us know what would make her happy. She mentioned something about a partial refund now. I expressed that I was upset that she was villainizing our company and she owed us an apology. I told her it was unfair to make us out to be taking advantage of her.

SO HEAR IS THE RECAP FOR THOSE THAT WANT THE ABRIDGED VERSION

OUR AUCTIONS HAVE A RULE SECTION-IN THAT RULES SECTION IT DESCRIBES HOW AUCTIONS CREDIT IS GIVEN IN AUCTION DOLLARS.

CANDACE WON A SNAKE AND WHEN SHE RECEIVED IT ---SHE WAS NOT HAPPY IT HAD A CUT ON IT--WE WERE NOT EITHER---IT WAS UNACCEPTABLE CONDITION-NOT LIFE THREATENING, BUT NOT PERFECT

WE OFFERED TO HER TO KEEP THE SNAKE FOR FREE---AND HAVE HER FULL CREDIT

SHE ASKED FOR A CASH REFUND WHICH WE DECLINED AS AUCTION CREDIT IS IN AUCTION DOLLARS--HOWEVER IN THIS CASE---WE DECIDED THAT SHE COULD RETURN THE ANIMAL(AT OUR EXPENSE) AND WE WOULD ISSUE A FULL REFUND-THIS WAS ALSO NOT ACCEPTABLE----

thats the whole story. I have said this before and I will say it again. ITS easy to sell a good reptile. A good guy is measured by how he handles a bad deal. I believe we handled this problem in a more then fair manner for her, EVEN after she sent that text basically trying to stong arm us into a refund and threatening us. EVEN after she posted up on her wall the stuff she did. OH--and to give a timeline---she received this snake yesterday--so ALL of this happened--yesterday!

and yes--you are correct--not only did we offer, WE sent a shipping label to return the animal to her so she could just send it right back at our expense. She then said she did not want to stress the animal out any more, but I assured her the animal would travel fine and we would have no problem taking care of it.
 
I think you rock Ben and have never been anything but 100% happy!! Things do get overlooked and thats why you have a policy to deal with it. From what I have read, how could you, in good conscious, do any more. Since moving to south Florida I have bought several animals from Ben Siegel Reptiles and all were perfect. The one time I bought a couple from somebody else, one of the babys refuses to eat... I know where I am going next time...

I read faunaclassifieds alot because of the amazing amount of info that there is. And, at times, I do at times check out the boi. I usually am sympathetic because typically it is someone that got scammed by fake hets or snakes that never existed. For 1000's of dollars even!! To me, this was an honest mistake and fair offers were given that would satisfy most people. I just hope people dont read this and decide to not to buy from Ben because they will be doing themselves a great disservice.
 
OH--I want to add one more thing. To the posters that made comments about the texts. I agree that is impersonal, but it was really taken out of context. Candace texted my wife pics of the snake, so they both texted back and forth several times. I think it was just the quickest way to communicate at that point. Was not meant to be impersonal, was simply a reply to the sent pics.
