Since you were told in your emails that you could get a pciture of the ACTUAL animal, you have NO legitimate complaint.
An ad that states multiple animals, and has one pic, is obviously not showing a picture of the actual animal. When you were offered pictures, you declined.
Trying to trash someone who does GOOD business shows what sort of person you are.
Thanks for making it clear, so that everyone can avoid deals with you.

Uh... wow. At first I wanted to give Au Duong Phong the benefit of the doubt in that maybe he misunderstood something about the transaction with the seller.... but now not so much.

IF the seller is clear BEFORE any money changes hands that the particular animal pictured in the add is not available, and the prices, species, availability etc on the add are all accurate, then the seller has done NOTHING wrong. That's nothing, as in there is nothing to "Warn" or "give people info" about. Nothing.

There is absolutely nothing wrong with repeatedly using a "glamor shot" to advertise as long as the seller has the rights to the picture and is up front with any inquiries. Some people like taking photos and drawing up individual adds for animals. Some people don't. As long as they are clear then everything is fine.

If ben siegel was clear and Au Duong Phong misunderstood the add and communications, that's their fault.

That's all I really got to say on that, although I think I would advise against sellers giving an extra free snake without confirmation from the buyer - sure it seems like a nice thing but the buyer may not be prepared to commit to an extra animal. Just sayin. Sounds like ben siegel is a great seller, though.

I'm not sure I agree with this 100%. In this case, since inquiries were made and answered, no harm, no foul.
But I think that the picture for future use should be labelled as representative just to dispel any misunderstanding that a buyer might have.
It does seem to me that baby snakes probably look a lot alike, but I also think erring on the side of caution by including something to the effect that the pic is representative might be a good idea.

In that case, buyer might logically assume that the one pic is the pic of the snake being sold. There would be no reason to inquire, that would be a logical assumption.

Again, those were not the facts here, but if one is using stock photos, a disclaimer might help avoid misunderstandings.

It really depends what kind of add we're talking about here. A banner add, for example, doesn't have a lot of room and adding "picture not of animal available" can really throw off the flow. In a longer classified add, it seems like a good idea to add it if one is only selling one animal (and thus someone might assume the single picture was of the animal). BUT, if the seller left that out of the add but made it clear in any inquiries (whether or no the buyer asked - to make sure there was no false assumptions) I do not think that would be wrong.
However, if the seller doesn't notify the buyer before money changes hands (even without being asked) then yeah, that's a ~little~ sketchy because it's reasonable for someone to make the assumption that the animal is the one pictured, even if they haven't confirmed it.

Anyway, in this particular case if there is a photo of a single animal and it's obvious more than one animal is available in the add itself, I think there's no need to add any such disclaimers, even if the animal in the photo is not among those available. Obviously they can't all be the same snake.

To be both fair and accurate, Mr. Nguyen is Vietnamese, not Japanese. In addition, I think this is to the regret of Vietnamese people everywhere and the relief of Japanese folks everywhere.

there is a breeder on ks that sells monocled cobras. he has used the same pic of the same baby for like 4 or 5 yrs. big woooop.

i bought a female aru scrub from ben, had trouble getting her too eat, benn went beyond what i expected helping me get her eating, she is healthy, eating, and will bite anything warm near her, love scrubs. will buy from him again in a heart beat.

I made a deal about the snake in the ad. Agreed on buying. Sent payment.. All good and done! Then after realize it wasn't the same snake in the ad. I should've been told in the very begining!!
But I said oh well and didn't want to pay fees sending my money back and forth so I bought the snake and accepted the deal anyway!! OK? But Im not worried about what happened. Im telling that only to have ppl see clearer!! My deal is done and all ok.

Im basically giving folks a heads up about sellers with bogus ads.. Ben did give me a free snake out of nowhere. Thank him for that but in all honesty, I did not want her for I do not have room like all you snake keepers!! He did not ask me if I want a normal female but just gave her to me with the Enchi. I was like "what the heck Im gonna do with you now girl". Tried to give her away to my friends but no one wanted her.. Lucky I sold her for $15 to some guy to buy some feeders. It's nice of him and I appreciate that and I never complained or act happy about it because his act of kindness and my problems with her evened out.

Not trying to say he's so bad and dont buy from him or anything like that. That's way off. But I don't care how big of a friendship or network you built around here.. Im saying my piece and Im not making anything up.

Maybe he doesn't like you because right now, you're coming off as an ingrate and a whiner.

If someone gives you a gift snake, you don't do anything but say 'thank you'. I really was sorry to hear that one of Ben's holdbacks went for some feeders, but I think he will be happy that ultimately the snake went where is can be appreciated.

You had and refused an opportunity to see the picture of the snake you were getting. No one is siding with Ben for ANY reason except that.
We've discussed in this thread how possibly it would be good to identify a stock photo with some words like 'representative' in the future but that possible complaint is not available to you because you were given the option of exact photos.
