any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;

I stand by my statement about concealed weapons being disallowed at the Ocean Center where the Daytona Reptile show is held.
Below is an email from the assistant director of the Ocean center.

Dear Mr. Berry,
I researched your question with the Volusia county legal department and they have advised us the answer to your question is no. In accordance with Florida State statues, the only persons allowed to carry a firearm into the Ocean Center is a uniformed public safety officer on duty.

If I recall, it is posted on every entry door at the Ocean Center. (except perhaps at the delivery doors)

However, if you are concerned, perhaps you should call the number listed and ask for yourself.
Or, call Wayne and ask him.

The email is all well and good, but bears no legal validity whatsoever. It is perfectly legal to ccw in the Ocean Center, regardless of what you have been told by a misinformed employee. Florida firearms law is an area of special interest to me, and I am well-versed in both the statutes and case law.

As John had correctly pointed out, only those portions of an establishment primarily devoted to the consumption of alcohol for consumption on premises would be off-limits. The entire establishment itself would not be, however. For instance, one would be perfectly legal to ccw in Applebees, despite the fact that they serve alcohol, so long as the patron does not sit in the bar area. The same holds true for the Ocean Center- so long as a legally armed individual stays out of only those areas devoted to the sale of alcohol for consumption on premises. The only time the Ocean Center itself would be off limits is when the Daytona Beach Thunder are playing a game.

Likewise, even if the Center is posted with a generic "no weapons" sign, one could legally carry there in most circumstances as such signs do not carry the force of law in Florida.

That Volusia County would provide Mr. Beatty with erroneous information comes as no surprise to me. I've had to educate VCSO deputies on more than one occasion regarding Chapter 790. Their favorite bit of misinformation seems to be the fictional "three step rule" regarding vehicle carry. They would lead one to believe that it is illegal, without a cwl, to carry a loaded firearm in the unlocked glove box of your vehicle. Instead, they claim that there must be "three steps" for you to get to the weapon. This flies in the face of the applicable statute.

That you were not provided with a cite by Mr. Beatty should be very telling. Indeed, they would prefer that one not carry, but the claim as to legality is a work of pure fiction.

I asked them about carrying a concealed weapon into the Ocean Center.
Everyone saw the reply I recieved.

The contact name/number is on there and you can call and verify if you want. I only asked them the question.

As far as the "shootout" in the parking lot, well...the guns will win! LOL!
However Mr. Hill, you and others say you never leave home without a weapon, I would suggest you call Wayne Hill and ask HIM if it's cool to carry a weapon into HIS show.

I know as a promoter, when you rent a facility for a weekend, you get to make your own rules to fit your own show.
Maybe Wayne allows concealed weapons in his show. But,, I doubt it.
