As a genereal rule, I tend to disbelieve nearly everything Upstate says about any issue. Alison tells me the sun is up, and I'm checking the window before I grab my shades!

However, while the ultimate details will likely never be sorted out, it seems clear that a) Alison owes Ken his domain name; b) Ken owes Alison for the web design; c) Ken is selling animals that belong to Sal and Alison; d) Ken has no problem advertising animals as "proven," when, infact, he has no proof whatsoever; and e) Ken will lash out in an emotional, illogical, hateful, and childish manner when cornered by his own lies!

Given all of these evidences, I would have to say that Ken Yates is a "Bad Guy!" He ought to be avoided at all costs, and the rest of us should try to make certain that we do not help him to stay in business, regardless of how good a future deal may seem. The guy is just rotten!

Ken, you really need to be careful about threatening people over the internet, my friend. Not only is it illegal and will get you banned from this site, but SOME people really are 6'7" and 260 lbs, and they do not take threats such as yours lightly. Based on your . . .uh . . .picture, I would be very cautious about upsetting anyone needlessly, were I you!

Well, this thread brought to mind a new warning point level I had not considered before: Actual or implied threats. This is a nine (9) pointer. In effect, three strikes and you are out with this sort of behavior.

If it is serious enough sounding, I will also contact your ISP with copies of the threats to have them deal with it as they see fitting and appropriate.

Threats offered as a counter proposal will carry the same penalty. So please don't thump your own chest in response.

Now, I don't know either of you, but in this case, I believe I'm a pretty good judge of character and believe that Ken is in the wrong, not based on what upstate has said about him, but by Ken's replies.

I know that Ken mentioned something like "If anyone complains about me after this is over, i'll shut down my pet shop", something to that extint anyway. What I perceived of this is "Please quit picking on me, and I won't do any more wrong," and he may even believe that himself, but as much as I'd like to believe that he wouldn't do any more people wrong, if the opportunity presented itself, I don't think he could resist.

He was a lucky person to have someone put so much trust, work, and thousands of dollars in, without getting paid upfront, and he really blew it.

I, personally, would take him to court. First of all, he most likely would not even show up, and you'd automatically get a judgement against him. If he did show up, it may be hard proving that he owed you money for the reptiles, because of being in business together without a contract; however, I think that you could get the money for services rendered, as per the legal verbal contract (building the webpage, as well as any personal fees you put into Ken's site) with Ken. If his replies and lack of proof are the same as he's showing here, you should have no problems. It would be worth a shot anyway.

I hope that you two get this settled

I'm so Confused

Okay, last night I responded to an ad at Kingsnake posted by Elite Reptile for farm raised Nicaraguan boas @ $35 each plus shipping. I called the number in the ad and spoke with Ken's wife. I was told they had about 40 of them left and have had them for five months. I was also told they had a website and there were pics representing five of these snakes there. After going to the website I see the pics there but Upstate Exotics name all over the place with no mention of Elite Reptiles anywhere.
Okay, the whole website thing has been discussed here in detail. What confuses me is the ad I responded to is gone and now Upstate has Central American boas posted at $65 each. Here's the ad: http://market.kingsnake.com/detail.php?cat=8&de=138551
My question is whose animals are they anyway and if they are owned by Upstate is Elite trying to sell something they don't have? If they do have these also can they be trusted whatsoever? I was ready to send Elite Reptiles $635 for 20 animals ( they quoted me $30 each for a 20 count) plus shipping until I checked them out here. All I can say is thank God for the BOI! Sure are some scary people out there.

Sir, I believe you spoke with me on the phone, not Ken's wife. Just for some clarification here, Upstate has their own stock and we have our own stock. The reason the ad was taken down was because we have sold out of our Nicaraguan and Central American babies. We will not be buying anymore farmed babies in the future as we have several boas of our own we are breeding now.

I did not give you a URL to a website, I believe I told you on the phone that I had some pics of them hosted on my own website and if you would email me I would send you the links. I never referred you to the elitereptile.com site as I would not do that knowing upstate has their site on there. I did have over 50 CA and Nic babies left when I spoke with you, I have 30 going out on Monday to one person and have sold a few to private individuals. When we spoke the animals were in stock and could have been shipped out to you the next day. Im sorry we werent able to do business with you.

From My Perspective

After calling the number that was in the original Kingsnake ad I spoke with you and while on the phone you asked a male in the background about how many animals you had left at that point. I was told about 40 and was given a price of $30 each for a group of 20. You mentioned you had pictures of five randomly picked animals at your own website but you'd send them to me if I sent you an e-mail. Forgive me for not realizing that Elitereptiles.com is not your website (how stupid of me) and that there just happened to have been five CA boas pictured there. After seeing Upstate Exotics name mentioned there I then proceeded on to the BOI and low and behold Elite Reptiles and Ken Yates thread was right on the first page so I didn't have to look very far. Needless to say I was concerned about dealing with you because I generally feel that way when virtually everyone warns otherwise NOT to do so. I posted here accordingly and then received a private message from Ken Yates saying he never ripped anyone off and that I could have a group of 30 CA boas @ $25 each and he'd even pay the shipping just to prove himself. So at this point the animals were still available even though the ad had already been yanked off of Kingsnake.
You said in a private message to me here that the animals are spoken for and going out Monday yet Ken told me he'd prefer to sell them to me and that he'd hold them for me until this coming Sunday night when I told him I'd have the funds available to paypal him.
When we spoke by phone you said you only had about 40 animals left so how can you have them sold and promised to someone else yet Ken is telling me they're mine if I want them?
Besides other people's warnings posted here I was willing to give Ken a chance to redeem himself and Elite Reptiles by posting here if the deal went through smoothly as promised.
In all fairness to Ken I don't think he knows what you're telling me versus what he's proposing. The problem I have here is this is often a common ploy used by disreputable dealers. It's always one partner in a business saying the other one's the bad guy responsible for mistruths or miscommunication or downright fraud.
So here I was willing to give Ken a chance to prove himself and was told the 30 animals in question would be reserved for me until this coming Sunday evening. You're telling me they're history and being shipped out Monday.
May I ask a simple question please? Who's in charge and calling the shots at Elite Reptiles anyway? I responded to the Kingsnake ad and reached you. Then Ken gets involved after I posted here. Then you respond here and post that I'm mistaken and shouldn't be confused. Well, I can tell you my confidence has not been reassured and would like to know if these animals are available or not? If so you and Ken might want to get on the same page. He did say he'd prefer to deal with me but if you've already promised the animals to someone else I suggest you send them to that party since in their mind they're being shipped to on Monday.

Greg let me just say two things about kennyboy and anja.

RUN AWAY RUN AWAY RUN AWAY RUN AWAY JUST AS FAST AS YOU CAN!!!!!

These people know what the truth is and have REPEATEDLY chosen NOT to use it. Even if those boas were being sold for 10.00 each it's not going to be worth the hassle you're going to get from them.

They're both liars and theives as has been proven many many times in several threads. kennyboy likes to do things by pm now because when he shoves both his feet in his mouth here he gets called on it.

There are some really nice and not doubt upstanding people who use this board. Several of them have posted here about how they are willing to give someone with a bad reputation the benifit of the doubt. Several of them have gotten burned by those same people with the WELL DESERVED bad reputations.

Folks, some people just suck. kennyboy and everyone associated with him seem to be of that variety. They suck your confidence and money right out and give nothing but heartache and hassle back. Not to mention that they are closely associated with upchuck exotics. Whether or not they are currently doing business with eachother is irrelevant at this point, they have spawned and it seems that anja is the resultant offspring. It seems that lying is an inheritable trait, though hardly surprising since both parents have the SUPER LIAR gene.

Wes, please tell me how I am a liar and a THIEF???? Ive never once ripped anyone on a reptile deal. Not ONCE In a lot of years of messing with reptiles. I dont believe I have lied about anything on this board either. I have stated my opinion but never lied.

anja, a statement is much like a bond or promise. You stated multiple times that you were going to post this proof and that proof that kennyboy was right and upchuck was wrong. When you did not, for whatever reason as you did have a lot of excuses for it, you have told a lie.

If you are indeed selling animals as proven breeders that you have not proven yourself and have no documentation on, again you have lied.

If you have actually sold the GTP that I refer to then you are indeed a thief as there is no proof that what you sold it as is true, you have gained through dishonesty.

These are just two that come to mind as I'm not going to go and dig through all the threads about kennyboy and upchuck to find the rest.

Greg, I still say RUN AWAY just as fast as your legs will carry you. Now these snakes are sitting in her living room, what, in bags perhaps, waiting until NEXT monday to go out to you!!!

Re-read the threads anja, there's ample proof in there of kennyboys's shady dealings and if you represent him then of yours as well. You are known by the company you keep.
