I have want to buy ads up on Fauna and Kingsnake because I am trying to start something up here in Las Vegas.
I was approached By Patrick Malloy of Malloy herps with an offer to buy 5.5 olive pythons via email. He offered them to me at one price and i counter offered and we agreed on a price.
Patrick was paid via paypal on Wednesday April 4th. He had agreed to ship the snakes the next day. The next day I asked Patrick if the snakes went out and he told me he had to order some boxes and would not be able to ship out until the following Monday. Which was fine, that's the way it goes sometimes. He said he had ordered them from Superior shipping supplies, he just didn't have box big enough to ship 10 2.5 to 3 foot olive pythons (they are 24 inches)
So Monday rolls around and Patrick says he couldn't get the snakes out because he missed the last pick up when he tried to drop the snakes off. So now I am starting to wonder, as most people I deal with are fast and professional and this guy seems a little sloppy now, which is fine, because that's the way it goes sometimes too.
The snakes are shipped out Tuesday, and Patrick says to me he will do 4.6 olives instead of the prior count of 5.5. He also says he will give me a free 0.1 striped coastal carpet, AND his own personal hold back pair of olives included within the 4.6, which are over 3 feet. I was appreciative of the offer and we left it at that.
So Fed Ex brings the package right on time and I bring it in the reptile room to see what we had. I noticed all ten snakes were in bag, which I thought was kind of sloppy. There was a separate bag with the 5.5 foot carpet python. I didn't think this was a good way to do it being thrown around by fed ex all day, but hey, no one is perfect.
So the moment of truth, I open the bag and take out the first snake and it is obviously not robust or perfect as described. All the others also had very poor muscle tone and looked like they hadn't been fed right their entire lives. One snake is half dead and practically has no muscle at all. I instantly know this was a bad transaction and this guy knowingly sent me animals that have not been cared for properly. One snake is literally half dead (died the next day) with very poor body weight. That kind of thing doesn't happen overnight. So at this point I am PISSED. But not as pissed as when i found out later there was only 9 snakes and not 10!
I called him and gave him hell. He assured me the water blisters and poor muscle tone were completely normal with liasis, I just didnt have enough experience with them to know. He sent me links about scale counts, blah blah blah. I said I would give them a chance but I told him one was really bad. He extended his warranty from 7 to 14 days for me. I know now he did this because that's about how long the starved snakes will take to start to become healthy again.
He also Said he was 100% sure he sent me 10 snakes. A couple hours later he said I was actually right, he had left one in another bag and found it. I'm wondering what the hell I was thinking at this point, I really screwed up trusting this guy. He is either a scammer or shouldn't be selling animals.
I sent him pictures of the emaciated olive. Its lower intestines are completely bloated, his response was, " so an animal with skin folds that needs to take a shit?"
He says to send all the animals back back for a full refund. I was stupid once, but I will not be stupid twice.
There is no way i am gonna trust this guy to refund my money promptly and to be honest, he already failed the animals, why would I want to send them back? I tell him I will accept a partial refund for the missing snake and the one not sent, and all the time its gonna take me to get the others sell able. I told him 700, which admittedly was a little high but I was pissed at this point. So after tons of emails and texts we agree to a refund of the two animals, one dead (it died the next day) and the one not sent. And I'm not gonna lie here folks, I'm not being nice at this point. I don't care about being nice when someone lies and tries to manipulate me.
So Thursday morning he tells me he has to make a deposit before he can refund me for the two snakes, but he will take care of it then and email me back. So i watch my emails, time goes by and no email. So i guess i need to push a little harder. After more emails and texts he tells me he only has 500 dollars and has to refund me 210 dollars over 2 fridays.
So I ask you this? If I was to send back the olive pythons, would he have been able to refund me thousands???
This guy hides behind a nice guy personality, he is a person who thinks he can talk his way out of things. Seen it many times. But the fact is I got 1 dead snake, 1 snake not sent and somone who cant do what they say over and over. Do you want to give money to this person?
I suggest you have him send first
I have notified Patrick of this thread. He told me If I keep up with the threats he will pay me 10 dollars a week for 42 weeks via paypal. Alls i want is my money back for the two, I gave him a couple days and that's all he is gonna get from me. I told him I would not make a BOI complaint if he could simply refund me the 420. He says he doesn't have the money.
Can som one please explain me how to show emails and texts? I have not done this before, is copy and paste sufficient? I also have pictures and video of the emaciated one.
