Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them.     Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Well, someone pays attention to it because the TOS page is titled Reptile Addictions and the paragraph stipulating the restocking fee is now deleted.

At any rate, thank you for removing that paragraph. It didn't make much sense that "If you pay and later change your mind and do not purchase a reptile, a 30% restocking fee will be charged."

Doesn't change anything; you're still due a refund.
 
We have not shipped anything in the last 72 hours, have no sales pending, and no ads where currently running when I changed the TOS. I just relisted the ads on kingsnake.

So I did go in and make substantial deletions to the TOS page, as well as updated the payment types, ect. The TOS were a little confusing to begin with. They should be clear cut and simple to understand now. If anyone i still looking at that site.

A year ago I changed the main page to redirect them to the storefront. The website is still river city repptiles, it just now states that we have opened a store.
 
The main page has now been changed also to reflect the true scope of the retail store- and changes where made to the business hours that were changed 6 months ago and never updated.

Also change your advertising. If you are going to make claims that your dragons are unrelated to any lines in the US, then you damn well better have proof of that. Again, it is NOT up to someone else to disprove your claims. If you are making them, it is your responsibility to prove them.

I am assuming you mean to discourage suits when the seller refuses to issue a refund. Those TOS, disclaimers, etc, also PROTECT sellers and hospitals when suits are filed, don't they? Are you trying to say that they don't factor in judgments?

I just spent the last hour reviewing the pertinent sections of the Uniform Commercial Code and can find no such reference. I am a Commercial Banker and have been dealing with the UCC for tha past 18 years and have never heard of this particular regulation. Could you please provide a link to that particular section?

Well, isn't that the general understanding about purchasing online verses locally? You purchase online to save money and to get less common items/animals. When you do, you take a risk that the seller is not representing that product accurately. That is why you read a seller's TOS, isn't it?

John, should we start a thread about this in General Business to keep this thread from getting off topic or do you think that link will be forthcoming?
 
OK I have remained silent as per Heidi, but I have a few things to say. The same time Jean/Wendy were making their purchase, I was making mine. I asked my questions and made my purchase. I have 2 Rankins now. One from Dynamite Dragons and one from Caliente Dragons. The one from Dynamite is the perfect example of a Rankins. Bow pattern, small size, slower growth rate, ect. The Rankins I got from Caliente is the same. As far as the TOS goes, Heidi has NEVER changed it. I just made a purchase and reviewed it BEFORE buying my dragons. Smart people review those kind of things before making a purchase. Heidi is a great breeder and wonderful person that does not need this. I have had the pleasure of dealing with her for a few purchases now. As all the stuff with Jean/Wendy was going on Heidi and I were talking on the phone and she mentioned all this way before Jean/Wendy started this thread. They do NOT deserve any money back on the basis of who badly they have handles this. They try to trash her buissness for crying out loud. I think its time everyone just ignore this thread all together and move on so Wendy will just let it go. Heidi did nothing wrong, she she imported animals to help bring diverse genetics to a species that desperatly needed it in this counrty. She sold to the wrong person thats all. She should not be punished for that. As far as the return, well it was stated in the emails that Heidi would allow the return of the adult male not the baby. So if Heidi does give a refund then it should only be for the cost of the adult. Heidi yet again I am sorry she did this to you, but everyone that has dealt with you knows the truth and will still deal with you.

If a seller chooses who will get a refund and who won't on the basis of how upset the customer was about the transaction, that seller would never get my business, that's for sure. I'm pretty sure good business people don't choose their refund policy on the basis of the buyer's emotions, they refund because it is the right thing to do.
 
Whelp, being that the seller has had the lizards in their possession for over 48 hours and have yet to refund...I'm unsubscribing and considering the "Bad Guy" title deserved.

There are some rights you cannot do away with in this world.

In fact, there are situations where the UCC allows buyers and sellers to make their own agreements and bypass some warranties/rights that would otherwise apply.
It is true that in some consumer situations, warranties cannot be disclaimed, and in others disclaimers must be done in a certain manner, but in other business situations especially between merchants they certainly can.
