Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them.     Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Well Shannell, we wish you the best of luck in getting this issue resolved with Victor. I have confidence that he will make good on his part. I've never had any problems with him so I have never been put in the position to ask for any type of refund from him.

Still no repy or calls returned by Victor. His doors of his company are closed from march1 to may 1. Will he really reopen or his he running? How many other people has he ripped off latley? If anyone had herd from or knows where he is please let me know I just want my money back.

Victors voice mail says he his closed for remodeling but are moving there business? Sorry but that does not sound right why remodel them move? His voice mail system is full and you can no longer leave messages unless you hit another voicemail#. Please if anyone has info on this guy please let us know. Thank you.

Well to this date no call back from Victor at all and still no return of our money at all as well. We will be filing with the court system this week to file charges against him for our bank will not help us due to live animals were involved. I will advise all as to the final outcome, may take some time though. I em-mailed him as well through Fauna but he never read it as to my knowledge, he is just up and gone no where to be found.

update victor broke his word again

Spoke with Victor on Monday April 12th he stated he was just going to waste my time but would refund my money by friday the 16th. well no money in my account so my husband called on Friday and he stated he was going to mail out a check and we would have it no later than Tuesday the 20th. Well no check, so once again he is a liar! Mediation paperwork was already turned in so that should be taking place very soon, we just wanted to try and settle this with him before that happened but I guess he wants to go to court which is fullish because then he will have it on his company records. Oh well just wanted to update everyone.

He avoided our bank said he was in the right to charge me, he avoided all calls from his bank in reguards to a charge back, he is a liar and a thief and will now not speek to anyone. mediation recomended filing a court case so we just sent that paperwork in. We will be asking for alot more though so we will se what happens. I wonder if he will even show up to court? We will be there and I will let everyone know what happenns for it has now been 3 months since this whole thing started. I can't wait to see what excuses he has to tell the judge!!!! I have everything to back up everything so we will see.
 
He was charging me $10.00 for shipping so he should have just charged my card $20.00 since he had stated he was going to pay to have the damaged reptiled returned, but in spite charged my card in full. I later found out but forgot to reply sorry have been really busy will this mess. He did not send the replacements because he never had them in stock for I had taken the last of the Albino nelsoni, so there is another lie.
 
He needs to do the right thing and give you your refund.
It sounds to me that you are going at this full throttle and you should.
If he said he would give you a refund, and said it was on the way
and it never showed, I would be pursuing this just as hard.

My question was in regards to the ammount of the shipment, not the shipping. How much were the reptiles? Or are you saying this whole thing is over the shipping amount?
 
No the total was over $200.00. I am not just suing for shipping, I want my full amount back. He charged me over $200 for reptiles that had gashes in them and the leos feet were all infected and full of parisites. These reptiles were in fact in no condition for re-sale at all. He received all his reptiles back and then over 2 hours after that he charged my card in full and kept it.

So, wouldnt this be a small claims issue then? The reason I am asking is that I took someone to small claims court a few year ago and was not able to ask for additional damages. I was told that I could only seek the dollar amount of the actual items lost.

You said in a previous post that the mediator advised you to file. Did he bother to tell you what damages you are allowed to seek in small claims court? Also, in California if the defendant countersues the plantiff for an amount greater than the original suit, the case will be heard in superior court. If that happens you will have to retain an attorney just to respond to the case. You are looking at over a thousand dollars before you ever enter the courtroom. If the defendant wins the case, you can be held liable for his legal fees as well.

Im not saying that is the case, Im just giving you a heads up.
 
Ya I know that, small claims is for an amount under $5000. I am fully awair of what I can ask for. As for that it will be up to the judge to award anything to us over the original amount of what was charged. I am not going to get into anymore details of what we will be asking for but of course I will let everyone know the outcome. We are not going into this blindy, we have done all the research and have spoken to the advisors on many counts. we have all proof of every thing, it is just a matter of time before all this will come to an end. I guess Victor just wants this on his business record, he has had many chances to pay us back as he promised and stated several times, I would like to see what excuses he will make up in a court of law under oath.
