Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them.     Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Great work Paul! Sending that snake back in the previous condition would have been criminal in my opinion.

I agree that a return for refund provision is just, only Chris isn't Wal-Mart and getting your money back would prove as difficult as getting a response from him. Paul has been very patient and above board as far as his conduct ([public at least). Maybe just the difference between a male and female would be justified? I'd say anything was better than nothing.

Yes, you are right but only if Paul decided he wanted to keep this male. If he accepts the $1,500 he is stuck with a ball python that I'm not so sure he wants as a future breeder.

I'm glad the python is doing better. And yes, having a thrid party receiving the snake also is a very good idea.

My conduct in public/private

I believe I've shared everything. So far, I've failed at direct telephone contact, but have left messages with both Mr. DeLay and Mr. Nelson to please call me back or reply via e-mail. I have no idea the verbal exchanges that might occur because I am upset about this situation, but none have. I did not post my e-mail to Skip Nelson informing him of this thread and the situation as this situation does not directly involve SNReptiles. I thought that his partnership with Mr. DeLay at least warranted his awareness. He has chosen to remain uninvolved and has not responded to e-mail or voice mail communications. Right now I'm just waiting to see what comes of my claims with Paypal and Mastercard, then will escalate as needed. I plan to provide weekly updates on the health of the snake and immediate updates of any developments on the refund front. Thanks all.

Wow! That is a HUGE difference in the health of that baby! Good work with him. Honestly. I am just glad to see he is improving... still wish you'd not send him back to the original breeder at all as I am of the opinioin that he is being sentenced to death if he goes back there... but it is not my snake, so not my choice.

Hope he continues to improve... and REALLY hope that you at LEAST get the difference in price between a male and female refunded back to you... one way or another ...

Though somehow I doubt it will ever happen ...

Update

Well the little snake is doing pretty good. It had a good 1-piece shed and has eaten 2 live fuzzy mice on his own. Its weight is staying around 50g. The head tremors seem to vary in degree from time to time, but are still minimal compared to the previously posted video clips. I've been leaving him alone with exception of clean-ups and feeding. He needs the break after all the medication and intervention. Still nothing to report on the refund issue. Will provide updates as appropriate.

Paul, have you initiated any proceedings of any kind against this seller or taken any steps towards forcing him to own up to his mistakes with this transaction?
 
Still in the Paypal/Mastercard loop. My view of Paypal so far is simply poor service, nothing to do with this being an animal-related claim. They acknowledged receipt of faxed documents and promised to review and update the claim...They did nothing. There is no indication of them receiving these documents or reviewing them when I check status of claim. Mastercard is now working with Paypal. If this doesn't pan out, I will pursue case in small claims court. Of course, this will be for notably larger sum than $2,500 as it will include vet bills, cost of maintaining the animal, and travel expenses to Texas for the court date. It would be so much better if Mr. DeLay would simply reply to my last e-mail or phone message and work this out. The ball is in his court and he's refusing to play. I'm not going to hound him about this. Apparently he firmly believes I am in the wrong here and he's dug in, waiting to see what will happen next.

It's a credit to you that it's still alive Paul. What I don't get is that this is someone who has a business and is trying to be a breeder. If it was just a person trying to pull a one time scam it would make more sense to me. Ripping you off for $2,500 is going to cost Mr. DeLay far beyond that in lost business in the future. Oh well, at least we have the BOI so we know who to avoid.
 
My mistake.

I should have demanded refund immediately upon receipt based upon his failure to disclose the underweight condition of the animal. Of course, there's always the chance it wouldn't have survived return shipment and this would be an even bigger mess. Oh well...

The snake's doing great, eating live hopper mice now. Almost doubled in weight since receiving in mid-July...Now 65 grams, a little smaller than my smallest hatchling this season. Since it's "not a runt", I guess I've always hatched out giants! MasterCard seems to be giving in to Paypal's policy that since the merchandise was not returned, there is no buyer protection. I sent them a letter quoting their promises to act on my behalf in disputes with a merchant and indicated that policy is very enabling to those intent on fraud. All someone has to do is send out fraudulently represented product, failing to disclose significant flaws, then refuse to accept return and there is no recourse from Paypal or MasterCard. Paypal won't talk to me since I've initiated the dispute through MasterCard. That's just their excuse-of-the-day though, because they either ignored or made false promises prior to my filing with MasterCard. Once again, Paypal never indicated their lack of support is due to this being an animal-related purchase. Their policy requires you to prove you returned the merchandise. If the seller won't accept return, apparently you're screwed. They claim they will pursue cases of fraud if a letter of inauthenticity from a qualified expert is provided to them, but they seemed to ignore that promise when they found out it was not an E-bay purchase. This chapter is still playing out, but at this point it's not looking too promising. I'm glad though, that I've been able to keep the snake long enough help it achieve good health. I can relax a bit about the possibility that my collection has been exposed to IBD. If there are any significant developments, I'll post updates. Thanks.
