In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Danielandjacob

Also SLC on Thursday WAS 73 degrees. It snowed 18 inches LAST NIGHT... One day difference of over a 40 degree drop in temps.... There is no guarantee with weather. I've placed on hold several shipments coming this next week to hope for warmer weather. SYR states that shipping below the 38* mark is not advised.

In Bloomington this next week the forecast looks rather bleek.

If she IS adamant on a Mon shipping for Tuesday arrival, arrival temps will be 28 degrees as of the current forecast. This would require double insulation and a true 40 hour heat pack. Not a 8-12 hour grabber heat pack I have seen. I guarantee the seller will not responsibly pack for a live arrival in those conditions.

I'd suggest she push the refund option vs. shipment at this point.

Yes, and hindsight is 20/20. But honestly, sometimes you shouldn't have to be punished for trying to put a little faith in people.

Welcome to America... Those that work hard are punished while those that don't are rewarded. It's the American dream these days unfortunately.

I agree about having faith in people, but regardless of value, that is hard earned money and these days.... trust is earned, not given. There is no reason to trust anyone for any reason without just cause. It's the sad state of the world we live in.

I normally buy my animals locally so I've never had to deal with distance payment before. Now that I know about Paypal protection, I definitely won't deal with anyone in any other way. I didn't want to judge someone for having no history on here because neither do I, but I would like to think of myself as a responsible buyer. I've been looking hard locally for this kind of snake to no avail, so I jumped on an ad when I found one on here. Now I know to be much more careful.

Paypal protection

I've had very good luck with Paypal, and they have backed me with transaction issues I've had a couple times, but some of that 'luck' is reading their TOS very closely. I absolutely suggest that you do that prior to making a Paypal purchase.

Agreed. I see people, even people I know request to send as a gift. I will never do it by choice, as you immediately have "0" recourse at all. I always use a CC as well as the consumer protection the CC company provides is an extra step of potential protection. Not to say I "can't" possibly, in no way be taken advantage of or scammed, but I do try and find specific avenues that give me a higher probability of protection. The 2 times I have made a paypal claim in the past 8 years or so, I was successful.

Well the publicity you have created for yourself is not a detriment with this thread. If anything, you have shown you are a legitimate buyer and someone many business people wouldn't hesitate to work with.

It's unfortunate, that for us to learn, is typically by our own mistakes (this time it was your faith in humanity). Like I said before, although a 100 is a 100 no way you slice it, it could be MUCH WORSE. I'm happy this was a smaller transaction vs. some I have read on here. As you said as well, you still do have specific avenues of recourse and I hope it follows through if the snake or money do not arrive in your hands via some means!

It's not just America.
I got frauded recently too.
Explained to my bank it was a fraud, they claimed since I sent the money it was a gift ... and said talk to the Police.
Talked to the Police, they said talk to your bank and report it as a fraud.
When I mentioned this to both of them they just looked at me like :shrug01:

WTF? How else is someone supposed to get their money back from a scammer? That's what the court system in this country is supposed to be used for.

I think what he was getting at is that if you had ANY idea about what it takes to litigate a small claims case, you wouldn't threaten the action, as it is an obvious bluff and bluster. The fact is, there is nothing to be gained from filing a small claim on this, as anyone who's ever ever researched ANYTHING about filing a small claim already knows. Small claims are not CRIMINAL matters, they are CIVIL, and are not the "auto-win" cash generators that people think they are. First of all, you have to file the lawsuit in small claims court (plus fees), you have to hire a private process server to serve the defendant with the lawsuit (plus fees), you have to appear in court or have a lawyer do it for you (very $$ if you hire representation, and is NOT automatically granted a "+court costs" restitution if a judgment is won... and no lawyer in their right mind is going to take a small claims case on contingency), you have to argue your case with evidence, and you are then PERSONALLY responsible for collecting the money from the defendant, EVEN IF YOU WIN. Everyone always thinks that winning a small claims case means that the defendant gets thrown in jail unless they pay or something, but it's literally a judgment that confirm that the defendant owes the plaintiff the money the plaintiff claims is due, the courts do NOT get involved in helping you collect. In order to collect that debt, you either have to hire a professional collection agency (for a fee/%) or go through all the legwork for taking your proof of judgment to the Sheriff's office and having them issue a legal writ of garnishment or whatever may be appropriate for the situation.

So yes, for $100, it is an obvious bluff... and that's how everyone is going ot read it, especially people that are trying to scam you. Experienced scammers have heard it 100 times and they know that no one is ever going to do it. Community pressure on the BOI is, and remains, the best tool.

You do know that nationwide shipping right now is a fairly bad idea, due to dropping temps.

Thats not an issue, anyone advertizing herps for sale online should have a good supply of insulated boxes and heat packs on hand to ship when your customer requests.

It's not a bluff coming from me because I am familiar with the legal process, I have a lawyer on retainer through my school so it is a service provided to me for free, and I have no problems taking the time with the court, sheriff, etc. I am that educated and that stubborn. Grad students don't take 100 dollars lightly.

That was my point.

I would like to know since it is part of the topic, what school will hold on retainer an attorney for a Student... solely for a civil court small claims with a restitution value of 125-150 plus maybe 300 in court costs? Seems rather awkward to me that a University provides such attorneys, but more power to the OP if she can stick it to this guy.

I look forward to seeing the outcome, similar to the Potts case. That's been, I think 6 months or so and still in the process... To lazy to check exact dates.

This is the same Dan Little that has been ripping people off under the other sn Dansnake or danssnake. My lawyer is calling the police in Hot Spring AR so hopefully they're going to prosecute him.

I say the threats are getting old, because we all know anyone in their right mind will not contact a lawyer for a 100 dollar(ish) suit. I feel she made half-hearted efforts to contact and was quick to threaten legal recourse, which we all know was a lie unless she proves otherwise. That inherently shows she is not-truthful, as well as the seller. I've seen people crucified on here for using that exact tactic of word manipulation and threatening.

I follow a saying. "You get more bees with honey then vinegar".

I have read many on here (not as much as you obviously, you always have good insight and input as to the scenarios imo) where it was a legitimate misunderstanding and then people harp "poster should have been more patient".

My post was more of a "he promised via Tuesday, give him the benefit of the doubt". It's been slightly over 1 week and that to me is a fairly FAST period of time.

Hopefully it will be concluded and 1 of 2 scenarios plays out.

She gets the snake, which in this current climate is risky (i'm assuming someone shipping a 100 dollar snake and this obvious level of communicative abilities (or lack there of) will not follow Robyn's recommendation of double insulating and 40 hour heat packs and waiting to a low of 38 degrees, but I digress.

Or, she gets her money back.

Agreed on the potential of warning other members. Maybe I, like her, was to fast to post my opinion. I've waited several weeks every now and then for proper shipping temps with very little communication from the seller in the meantime. Didn't jump into a hate thread after 2 days with no communication. Then again, I only deal with people with references or a legitimate business, so I am never worried.

She obviously knew of this service Fauna provides and some culpability or responsibility should be placed on buyers to research first IN MY OPINION.

Does not give the seller the right to steal or commit fraud, but.... negligence is NOT bliss, again IMHO.

Good luck on the outcome.

I've rarely seen such a clear attempt to railroad and stall. If you can't see it, I suggest you completely re-examine your outlook. The buyer contacted the seller multiple times, and the seller continued to stall and make excuses. Shocked it's not readily evident to someone who speaks English natively.

Her initial posting(s) showed only text correspondence. Only until I brought up actually calling did she confirm she did indeed contact them via that method.

I have purchased and paid in full for a boa recently. 600.00 dollar value. The breeder is WELL KNOWN and respected. It takes him roughly at least 2 days (more then 4 in some instances) to get back to me. He is also requiring that I check the weather report, when he obviously has easy access to the net and can find it himself.

Weather this entire week would have been sufficient to ship to me (actually the last best weather we will have this year probably) and he stated since he did not have my cell phone number that he couldn't set up shipment. In fact, my cell was sent in a previous email if the emails were looked through to find it, via the search option.

Seemingly this would seem to be "stalling", but I am confident it is not. Things come up, life happens, excuses are made up weather innocent or not. I give people the benefit of the doubt.

It has obviously been proven that this is not the case with this seller and it is indeed a scam. It DOES NOT negate the fact that buyers do need to maintain a sense of culpability to insure the transactions are legit before giving someone hard earned cash (hence why I am not worried with the above as he is immensely well known and all positive feedback).

I feel bad for the OP and have been one to constantly follow this thread to view the outcome.

I was being devil's advocate. No one likes the idea of the purpose of one, but it was to show errors on both sides, which the OP will never make again.

Cheers!

DL Nov 15, 4:19pm: Ok ill make sur they guarantee Saturday delivery send me your address again.

So I sent him my address and hopefully, though doubtfully, I will get my snake tomorrow.

SYR doesn't do Saturday delivery. Thurs to Fri is the last day (not recommended in case of issues the Herp stays in a facility till Monday). IF he does ship it today, you went get it till Monday.

I'd process with the lawyer regardless. My "native" English is telling me it's a stall.

A confirmation/tracking number is also free provided via SYR/Fedex SO request one and find out exactly what/where it is "if" it goes out.

Also I believe you edited the Facility address from above, but make sure the exact facility address is given and Also have your name put on the second address line.

Good luck!
