To everyone now being put in a tight place with PayPal, there are a couple options.
You can file a claim against Derek. I am familiar with MA legislature for small claims in that it must be at a district court where either the plaintiff or defendant live, usually it is where the plaintiff lives, and the defendant (person being sued) must appear at THAT court house. For people out-of-state, I'm not completely sure. I think you'd be able to do it via your own district court, but you would also have to notify the district court serving the defendant.
PayPal also does not cover or reimburse purchases of live animals. I have however heard of people suing PayPal for their money back. This is actually pretty easy - file a small claim summons and have the court send it to the local PayPal address for your state/city. Chances are, the less you tell PayPal about your situation (eg., gecko and live animal purchase) the more likely you are to win the case based on their "unshipped goods" policy. File a claim with PayPal first, and if they fail to return your money, take it up with the court system.
IC3.gov will add an addendum to Derek's record if he has one, and if he does not, they will file an investigation and likely open a case against him if there are recurring reports highlighting his fraudulent behavior. It would be good to report him to IC3.gov prior to filing a claim in court and will only strengthen your case. A person CAN be arrested on an IC3 report.
