Provide an explantion why you did not return them the next day or any day afterward? If the other 3 were unsat, then why did you keep them when we told you a dozen times to return them? Dan, I think I have more than met my burden of proof over the past 39 pages and have explained over and over the situation. If you continue to fail to grasp any of this information that has nothing to do with me. Find someone else to take time out of their schedule in order to help you understand what has been going on for the past 39 pages( ie. you loose). Not too mention you were just told by and independent expert in law that your story so far holds no water and yet you continue to argue every asinine point you can possibly imagine. Me giving you an explanation once again is not going to solve anything as you'll just move on to the next asinine thing you can imagine and make an issue out of that.

Dan, I can call you if you like, but in all fairness to everyone here, I have not asked you anything that you have not been willing to freely discuss here on this public forum, and I would be willing to bet there are others who woukd be interested in hearing your direct answers to the issues I've brought up here. Again, please keep in mind that I am not trying to challange you in any way, but am only attempting to get you to slow down and clearly address these issues with truthfullness, clearness, and logic. You have been very cordial and pleasant in our posts between you and I, and I greatly appreciate that. You are showing everyone that it is within you to be professional. Truthfully, I feel that you are being somewhat evasive at times for whatever reason, but perhaps this may be a trait that you don't recognize but would be willing to work on. It is understandably difficult to concede to the world on a public forum of our peers that we made a mistake, but I have noticed that you have conceded a few times in this thread that you had done a few things that you wish you had not or had done differently in terms of this transaction, and that shows growth on your end.

I think that if the table were turned, and I were in your place, I would much rather just say "Yep, I (or we, if Miller is a factor) screwed up, but I made good on the deal and even threw in a little extra to appease the customer, and that's all I have to say about it." I think that if that had happened, this thread would have died on page one.

Fred, well we did not screw up. Mr. Liar Garcia refused to return the expensive snakes and held them and according to the law he has to prove he made reasonable contact to return them to submit for a refund 5 months later. If you see if different then I don't know what else to tell you.

We have hard evidence of phone records we tried to make contact and get them back and issue him a refund. If you think he should get away with 4 snakes he never show any photos of dead and the cash, then I don't know what else to tell you except I let it die long ago and this crook brought it back up for no good reason besides he is a bad buyer. And people read this thread and not a person said he was justified keeping the snakes and the money. And it does not matter what they say as they don't like the way I proved them wrong many times before so their opinions do not matter.

He gave me his roommates phone number when he reported one with blisters and said to call him to have him ship them back. And I now recall that he said he contacted his roommate and would be sending them back on a Tuesday because that was his day off or something. I called the roommates number several times and left messages for him to call me back and to coordinate the shipment of the snakes back to Mr. Miller. Mr. Miller tried hard to get the snakes back and he has emails perhaps from me asking Mr. Miller to get the snakes back.

Also, these are very valuable and rare snakes. What makes you think that me or anyone would permit someone to hold them for nothing? Have you not figured I had to pay for them and just might be interested in getting back the few hundred dollars I paid for them. I am sweet but not that sweet. I wanted my money back from the importer of course and I had to make sure the snakes were shipped back to him. You have no clue as to how upset I was that the roommate ignored calls and it seemed the folks in Texas were not working hard to get the snakes back because it meant I was gonna get hosed in the deal. So of course I did my best to get them back. The scammer refused to send them back. He said he wanted them and would treat the fungus with medication. I told him I did not want his new tank to be polluted with a snake that had a fungus and keep them out of that particular tank and ship them back the next darn day. I recall all of this garbage now. Let me see Mr. Liar Garcia deny it.

Now I will produce phone records of incoming and outgoing calls for that time period and I will show my outgoing to that number several times and there will not be one incoming call from that number.

Now the only question here is this?

The M.O. is the same throughout each of them, and it seems on each one, there has been someone such as yourself who has tried to take the time to talk with Dan, reason with him, just get a few straight answers...and well, it always ends up the same.

Really, it is like the old figurative "beating your head against a brick wall". At first, you think you might be getting somewhere, but eventually you end up with nothing but a headache and feeling rather stupid for having taken the time to do it in the first place.

You know what Dan you're right in that I don't believe my personal cell phone will appear on your phone records. You see at the time I was in Dutch Harbor. Dutch harbor has it's own cell provider that doesn't allow calls from any other provider. You have to buy minutes from the local provider and I'm not aware if that then gives you a local Alaskan # on your cell phone( area code 907). This is completely verifiable just ask any Alaskan fisherman or tourist who's been to Dutch and they will tell you this is true. I believe I called you from the one of the ships numbers which are as follows:

there was also another sat phone on board I could have used but I can't seem to locate that number although it would also start with 011 8816 denoting it was a sat phone and if called would contact a geophysical company called FUGRO(although I wouldn't recommend it as the charges incurred will be exorbitant).

I don't feel anyone is entitled to "rob" anyone or break any laws for that matter. If I felt this way I would be out of a job.

Fred, they were not my snakes, the were the personal pets of the importer. Did you read the importers email I posted earlier? It is below again.

Mr. Liar Garcia called after I ran out of the stock I was advertising. I told him I would not get them for months if at all again. He pried and got me speaking about the importer and asked me if I could persuade the importer to sell his personal snakes to him. He pushed and pushed and I said I would try. I called the importer and he said he had 3 in his collection and his son owned one and would help.

And if you belive I allowed Mr. Liar Garcia to keep the snakes for 5 months and then file a non-delivery report, then I don't know what else to tell you but read my guarantee. It does not say keep the snakes 5 months and then you have an option.

If you doubt the content of this email, then telephone Mr. Miller or send your email and I will forward it to you. Do it not, and you have no right to deny the facts here.

I think we are beating a dead horse here. The facts remain he received the animals and did not return them and filed a bogus non-delivery report which forced his refund. He stole the snakes and stole the money and if you see it any different, than you are ignoring the truth. It is his burden of proof to provide evidence he tried to return them to submit for a refund. He has no proof and is a mega scam artist is all.


On the request of Dan as a favor I sent Juan four blue file snakes, personal specimens I held back for myself and son. One arrived DOA (the smallest & bluest male), the other three arrived alive. Juan was upset that the females were not very blue (as he was told before, the males are more blue). He wanted new snakes and I requested he send back the three animals to me. The three animals were never returned despite talking to Juan as Juan was not available (in Alaska) and his roommate never returned my calls when I called to set everything up for them to be returned. I even offered to pay to have them shipped back to me as well as sending any supplies they would need to ship them safely back. Once returned to me I (Justyn Miller) was going to supply new specimens to Juan to replace the animals I supplied him.
