I agree with what Ken has said, they are both at fault.

Regardless on Vicki’s Literacy, personal attacks sway us from the truth, and truth is all what were looking for on this site.

I think Duane is a good guy, and I also think Vicki is also a good person which cares for her animals dearly. There maybe a few things that contributed to death of these animals.

I believe the shipping is what weakened these young animals and the subsequent care may have contributed as well.

Vicki, words of advice from a fellow herper, in the future give substantiating evidence to support your argument.

Maybe the buyer and seller can workout something?

Maybe, Duane can send a couple Cams out for good measure?

The delphs have a big problem with clear communication, and received 4 deserved warnings from the moderator.

With respect to your shipping practices:

Do you intentionally use USPS express mail with the hopes it will be late so you can file a claim with the post office? I dont think so. I think you try to keep the shipping charges to a minimum for the customer while providing service similar to the higher priced carriers. I commend you for that. But the facts are USPS cannot guarantee overnight deliveries to a great many locations. If you knew this was the case for her destination then a delay in shipping while you clarified this with the Delphs would have been in order and more than likely an acceptable delay given the fact they are devout animal lovers (to the extreme).

If you didnt know this then it should have been a question you threw at your post master when he took the package. The fact you never had a previously bad experience doesnt mean it couldnt happen, and that it happened, and will most likely happen again in the future.

I can tell you though, all kidding aside from previous posts, if it does happen again and it comes to this board, you wont have half as many people thinkng the other party is nuts and running some game.

Thats just my opinion on this situation.

about the "BUYERS" they truly do puzzle me... sometimes their replys seem decent, even make sense somewhat, then other times they are truly confusing the heck out of me.

Those chams were in transit for 2 days and the second shipment was in transit for 3!! days.

I'm sorry, but that STINKS. I do not care for how many years that might have worked, it doesn't make it right.

They are such incredible small, fragile animals, BABY ones at that.

USPS shipping should not even be an option for the seller.

Duane why do you keep going on and on about what the buyer wanted you to do shipping wise? It's your perogative to DECLINE their demands. You do not have to risk the health of your baby chams because of what buyers demand.

They are YOURS and YOUR responsibility.

Why worrying about whether people are to cheap to pay a extra $18 for decent shipping??? The ones that don't want to , don't need to buy live animals, sorry.

You don't have to pay for the shipping, so why being cheap on that?
Is it that you are afraid the buyers will go to sellers that DO offer cheaper shipping?

Ok, for anyone that thinks its ok to ship fragile little cham babies for 2 to 3 days, with all those climate changes, no less.

Stop eating and more importantly DRINKING!! for 3 days, yes, for an entire 48 to 72 hours...nothing, not a drop of water.

See how you feel ( I bet not to chipper). Now imagine tiny fragile baby animals, going through this and the stress of shipping as well.

Anyone that is willing to have this going on to save $18!!!!! has no business dealing with live animals, that goes for sellers and buyers

I am no expert on photos being used as evidence in court but I can say with some degree of confidence that an expert authority in the field of photo manipulation would need to be retained on behalf of the plaintiff if he would be using it as part of his complaint.

Last Winter I Sent A 20 Lot COD To Good Friend Of One Of My Buddies In Freezing Cold Weather Doing Christmas Time. He Never Picked Them Up At The Post Office. After 11 Days Of Being In The Box And Sent Back Here Jan.2. I Got A Call At The Post Office To Go Get Them. I Openrd The Box There At The Desk, After Returning in Zero Wether With No Heat Packs To My Surpise Most Of Them Were Still Alive, Very Very Very Cold But Still Living, I Slowly Left Them Thaw At Room Temperateur For A Couple Hours Then Gave Them Water So I Wouldn't Shock Them. Of Those 20 Of 6 Of Them Grew Out To 3-4 Months Before I Sold Them At Our Reptile Show. So I Know After 7 Years How To Ship And Take Care Of My Animals, 2 Days Is Nothing For Me, I've Sent 100's Of Trio's All Over This Country In That Time And Its Funny Only Vickie Complains. The Only Other Person In That Time On Here Complaining About Me Is Gil. But He Never Got Any Chameleons From Me. We Just Couldn't Get The Shipping Thing Under Agreement. When He Got To Difficult To Deal With I Returned His Money. I Wanted To Do That With Vickie Too But Decided To Honor Her Bid Fearing Bad Feedback. BOY WAS THAT A MISTAKE.

I understand and I agree with your position on how you are dealing with your customer given the circumstances of her communications with you and within this forum.

I am not against using USPS when I am absolutely positive that the animals will be there on time and the customer requests this type of shipping.

For those who think Fedex or UPS is better I dont agree.

Yesterday I shipped a snake out. The pickup was scheduled for 9:00am. The driver arrived at 5:45pm. Whe he took the box from and was explaining the delay, he spun the box from both corners like a child spinning a top on a linoleum floor. I just stared at him and he looked down at the box which was marked clearly on all sides, top and bottom, "LIVE ANIMALS, CARRIER PLEASE KEEP BETWEEN 72-82 DEGREES". It was a kodak moment. I pack all my items with extreme care but I cannot guarantee the box will not be used as a foot stool or seat pad by some moron in the back lunch room of a sorting facility. And that whether its using USPS, Fedex, DHL or UPS. I cross my fingers each time and hope for the best.

However, the snake arrived to Ohio today before the deadline and in great condition. And all the while my customer was capable of seeing each destination point reached and the times of each arrival and departure. It may be a false hope of promise the package is in transit and all is well for getting thier on time, but it better than nothing at all.

USPS doesnt grant that service in any way, shape, or form. USPS closes at a certain hour each day and no one can help you. USPS is lucky, as you pointed out in your story, if they will even notify you in a timely manner if the package was returned for some odd reason.

There is another post on reptiforum about who the most reliable shipper is. Everyone had a different opinion. Ultimately the choice is yours for whichever works best.

Again, I wasnt taking sides. Theres a lot to learn from a post like this and I dont belive for one second this thread has hurt your sales. If anything, while aggravating, it has given you more exposure.

My question for you is - DO YOU WANT TO PLAY. What blows my mind is how people get on this site that can be useful if people stick to topics at hand, yet there is always one idiot that is strictly here to bash all those he comes in contact with. Right off the bat we see what an idiot you are. A fifth grader could tell you that in the first picture the quarter is taken at an angle and in fact there is mention to that fact. Tell me big man (who obviously is a clock puncher since he can not value the typical entrepreneur - quite typically did not even finish school but still makes the big bucks) why is the cham not taken at the same angle...they must have magical cameras in the intellectual world of Mr. "big man on campus".

Another thing that blows me away is how someone will just start spouting off at the mouth to and about someone he has little or no information about. You do not know who I am or what I do but I guarantee I am only a few mouse clicks away from knowing all about "Chuck Kimmell of Pennsylvania".

As far as the three avenues of litigation i represented, they are very viable and conducted every day in the business world. since you are aware of Westlaw then maybe you will find the time to investigate this. I use Westlaw everyday along with Accurint (the amount of info I can find here!), CrimeTime, along with "pretext" services (I am sure someone as astute as you knows what this last one is). If you decide you would "like to play" go ahead and try to bash me stating it as fact and I will happily show you an example of what I am talking about. In fact why don’t I give you some help? Here is a company I own "Jones, price, Cruz & Wong, lc.". Do not worry about the fact that I need to find you to serve you. I use several private investigative services across the nation in my every day work. I think paying $300.00 a day to track you down so i can enjoy the company of ineluctably superior mind is well worth my money.

Lastly it is absolutely ridiculous that I am here helping some one that feels he is being harassed and I am basically telling him to put up or shut up and you come along bashing my help. Yet it appears you far superior intellect does not allow for any alternate solutions. You know what they say about people that always have complaint, always point out faults but never offer a solution. if you feel wronged you should act or just drop it. By the way you do not even need to disprove the picture to win. It is abundantly clear she has no proof. You do not even have to be as harsh as to seek compensatory damages. You can sue merely to get a court order to shut her up.

The fact is the guy would find himeslf in more trouble with the IRS for unreported revenue should the Delphs decide to even the score against his lawsuit. Would a lawsuit be worth that risk? Even if he did pay his taxes on his sales he made from this "HOBBY", I wouldnt want the IRS auditing my behind. All it takes is that one phone call sometimes for everything you worked hard at to be turned upside down.

Do you think that during this he lose significantly more sales than he would generate in your idiotic suggested lawsuit? I think so but thats just me.

This started as a disgrunted customer and turned out to be fights between other herpers. Wow! Duane and I both don't want that to happen.

We have been doing this for so long, (Seems longer to me because of a house full of chameleons and stinky crickets) but to be honest we did learn a few things from this adventure.

And you are correct about another thing too. We have sold so many chameleons in the last 3 days!
