On January 24, 2011 Em Wright of Crimson Ice Reptiles contacts me about the animals I had up for sale. She was interested in two of the females that I had and she was looking to breed them this year. I let her know that they weren't ready to breed this year. We chatted about those animals a bit and then on January 26 she asked me about a female anery stripe I had on my for sale list. I then sent her the following photo.

Hey Kevin,

She's gorgeous. I'd love to have her for a few projects of my own. How much are you wanting for her?

Thanks!

Em.

On January 27 we had talked on the phone a bit and discussed a few of my other snakes for sale. She was interested in my pair of Mexican Black Kings. I answered her questions about their temperament and told her they were a little flighty but they didn't bite.

On January 31 an paypal invoice was sent and paid.

On January 31 she sent the following

Hey Kevin,

I had to actually send you split payments. My card has a limit on it and I had already spent some money from it today so I wasn't able to utilize the invoice and I had to use my other card for part of it, too. Sorry for the hassle. >.> But you should have the full $260.

Do you mind if I use the MBK and Anery Stripe pics? And would you be willing to send them to me as attachments? I went to get them off your website but it's been taken down. (Congrats on selling the business, btw!!) I would just use them on my website until I can get the snakes here and rephotograph them.

Would it be okay to pull the three snakes out of brumation now? I mean when I get them home to go ahead and put them on heat and warm 'em up?

Thanks!!

Em.
I sent the photos as requested in an email and also let her know “they are out of brumation and will be fed tonight. The last several days it has been too warm even with the window's open and everyone was moving around. I'll have to get you those images when I get home tonight. Im running behind.”
She was going to show up on February 3 to pick up 3 snakes and a hatchling rack with tubs.
On February 2 I sent her an email with the following.... “I just spent 12 hours loading up my business and shipping it out. Im too tired to remember much. Still have another 2 loads to go out tomarrow. (the day she was going to be showing up) After you leave... and he leaves.... it's gonna be barren around here.”

I also wanted to say... if you'd like tomorrow I could probably stay and help you pack up some of the animals and whatnot if you'd like some help. It'd be no trouble. I like handling and seeing the snakes and whatnot anyway. :)

Em.

This information will come into play here in a little bit.

February 2 rolls around and the buyer that bought out my business shows up to load everything up. He brought a trailer and thought he was going to get everything in two trips. Turns out his trailer was not near big enough for that task. He asked me if I would mind transporting some of the equipment using my truck and trailer. Sure... No problem. That day we spend all day and well into the night loading up my 16' fifth-wheel trailer and his smaller trailer. It had started to get late and he offered to let me crash at his place for the night and then we could unload everything first thing in the morning.

That's when I realized I couldn't make the 4 hour trip to his place that night. Em was supposed to arrive sometime between 11 and noon. There was no way I was going to be able to get the truck and trailer unloaded and make it back home by that time so I told him I would have to drive up after she left. We loaded up all the snakes into his SUV and he took them home with him and I would be delivering the racks the next day.

The reason I say between 11 and noon above is because during our phone conversation I remember hearing 11, but in the emails we have noon listed. Either way... that hour wouldn't have made a difference on what transpired next.

February 3, I wake up earlier than I wanted to and checked my emails. My buyer made it home around 2am. I go about finish packing up the trailer and truck with the smaller items from the buyout and at 11:30 I call Em to see where she is at. Her husband answers the phone and when I tell him who I am and why I am calling he informs me she is in the shower. Keep in mind she is around 2 hours away from me. At around 12:15 she calls me and says they had some car trouble but was getting her folks car and would be on the way. At this point I let her know that I had a trailer load of racks and equipment that I had to carry 4 hours away. It would take us 3-4 hours to unload it, and then a 4 hour drive back to the house. If I left now it would probably be around midnight before I got back home. I couldn't wait another 2 hours min for her to get here. I let her know to call my mom and she would come meet her in town and bring her out to my house so she could get her snakes and rack. At 2:54pm my dad calls and lets me know that she has got the snakes and rack and had just left. Just a little after 11:30 pm I roll back into my driveway.

February 4 I had to work and when I got back out to the car I had a missed call and voice mail from Em. According to the time stamp she had tried to call at 8:01pm. In the voice mail she sounded like something was wrong, but wouldn't say what. Now Im worried something is wrong all the way home and I am hoping that maybe she left me an email. I really didn't figure she wanted me calling her after midnight.

I get home to find this in my email

Hey Kevin,

I left a message on your phone, you can ignore it. I decided to just write you an email. :)

Well, I took some pictures of the Anery Stripe girl and posted them up on Cornsnakes.com to show her off and some of the folks on there informed me that she is not an Anery Stripe. She is an Anery Motley Pinstripe. And that is NOT what I wanted. Here's a link to some pictures where it shows the difference. http://www.cornsnakes.com/forums/showthread.php?t=91145 She has the spot and then the stripes coming out of the spot. Honestly I was never certain of the difference and believed what you told me. Now I realize you may have been bamboozled into thinking she was a Stripe, I do not mean to accuse you of lying as that's pretty strong words when so far it just looks like an error in records or morph identification.

Second thing I wanted to bring to your attention... the MBK female is extremely spazzy. She musked, tail rattled, and flailed when your Dad took her out. When we got her home she had regurged from the stress. It was a glob of mouse with a tail and oh man did it stink!! The male, while not nearly as easily freaked, is still pretty skittish. I'm a first time Kingsnake owner and most of the kingsnakes I have met were foul tempered. I asked about their temperament because I am not comfortable handling aggressive or skittish animals. If you had been present and if I had not already sent you money I would not have brought the MBKs home. I understand I should have come earlier in the day, had I known you had some place else to be I would have made an effort to be there earlier so we could conclude our business together. I was somewhat offended that I was not informed of your errand sooner and that I was forced to deal with your Dad (after you said I'd be helped by your Mom) who is not the person I drove two hours one way to buy snakes from. No offense to your folks, your Dad was a swell guy, I just wasn't comfortable discussing our deal with someone it didn't pertain to.

I seek a solution to these issues. I'm willing to bring the snakes back for a refund or something of that nature. I have no use for the cornsnake female and I'm just not comfortable with such a flighty snake as the female. And with her regurge I just don't think I want to put her through the stress of breeding this year. She's very high strung, I just don't like that in my animals.

Please let me know what you think. Thank you for hearing me out.

Em.

I goto the link she provided but it doesn't take me to my girl. So I decided to go looking around to see if I can find her thread. Well I found it. She had started trash talking about me even before she gave me a chance to fix the supposed problem.

EM1.jpg

In that screenshot she admits to saying that she was supposed to be here at around noon... but they didn't show up till closer to 3pm. Then she wants to go on about how I told her mom would meet her and it was dad that actually met her. She should be happy dad was the one because mom would not have held the snakes for her like dad did. She also told me via our phone conversation that she wanted to bring her mom with her because she had gotten her mom into the corns. I told her no problem... then she show's up with her hubby. Which is also no problem. I just think its kinda ironic that she would bash me about who let her into my house to get the animals when she her self changed who she was bringing to my house. The only idea I had that she might be bringing someone different was because when I talked to her hubby he said we. She sure never mentioned the change in visitors to me. Once again... not that it really mattered. It's just that she wanted to make a big deal out of who helped her get her animals.

At this point... I think it's safe to say I was a weee bit ticked.

She made the post bashing me at 7:57pm, tried to call my phone at 8:01pm, and sent me the email at 8:30pm. The very first email she sent me said.... “This is Em from Fauna (you may have seen me posting around, I don't post much though, so perhaps not). I saw your For Sale ad and …......”

She knew that I was over on fauna, but yet she never not once tried to contact me there. If she would have... this could have most likely have been fixed before I ever got off work.

I sent the following email to her

Hey Em,

Sorry I missed your call. I was at work and I didn't figure you wanted me calling you after midnight.

In that thread you stated that"urks me to no end..."

You putting me on blast before even talking to me urks me to no end. Actually that urks me more than you will ever know. I pride myself in my animals and the reputation that I have built for myself over the years. And because of that pride I am not going to do what most would do in my situation since I am out of business.

The corn was sold to me 2 years ago as a stripe. She looked like a stripe to me. That's what I labeled her as and ultimately what I sold her as. Everywhere on my website she was labeled as a stripe. I was not trying to pull the wool over any ones eyes... nor was I lying to anyone. I honestly thought she was a stripe and I still believe she is a stripe. There are different variations to the stripe trait. The vanishing pattern is a stripe trait, but you don’t see any stripe on a goodvanishing pattern morph.. I know... I had a superb example of a vanishing pattern and I paid out the nose for it. The stripe and motley trait resides on the same allel. The motleytrait is dominate over the stripe, but this is a motley anery and she doesn’t look ANYTHING like a motley

http://iansvivarium.com/morphguide/anerya/pics/anerya-m.jpg

I was completely up front about the MBK's. I let you know they were skittish but never bit. You said you were OK with that as long as they didn't bite.

You knew I was in the process of moving all my animals and racks out because I was shutting down the business. You knew I was working with someone else that was buying up everything I had. You even expressed disappointment that you wouldn't be able to see the collection because they would be gone. You offered to help pack up some of the animals if I needed it, and I had even let you know that after you left that day and he left that day my place would be barren. The only difference was instead of him making two trips we loaded up a 16ft 5th wheel trailer and I was going to pull it to his house.

That night we worked till late and he wanted me to follow him home (he got there at around 2am). I told him I couldn't because you were supposed to show up around 11ish per our phone convo. There was no way I was going to be able to get the trailer unloaded and leave his house and make it home before you got here (because I would have crashed on his couch at 2am), so I told him I would come up after you left and we would get the trailer unloadedand get everything set up.

When you called at 12:15 and said you had car troubles but was on the way I let you know that I was going to have to have my folks let you in. Yes I know I said my mom, and that's because she is the one that offered. Had I known dad would be the actual one... I would have said him. By the time I got up there.... unloaded the trailer and got back it was just a bit shy of midnight. Had I known that you and your hubby was going to have a lazy day as you put it I would have requested that you come earlier in the day. If I would have waited for you to show up it would have been closer to 3am before I got back home and I had to work the next day.. or in that case.. .the same day.

If I had known ahead of time that I would be needed to move the business I would have told you. I honestly expected my buyer to make all the trips, He said he coulddo it in two trips...but he showed up with a very small trailer. He then asked me if there was anyway I could help him move the stuff. Like I said... I had expected you around 11ish so I said no problem.

My guess is you're not happy after what I read in your thread.... so why don’t you just bring all three of them back and I'll let my buyer know to expect 3 more snakes that he can breed this year. I promise you he will pair up that patternless anery to that anery stripe and make more. I can meet you either Wednesday or Thursday and we can do the return there in town. Let me know which day you would like and I'll let the guythat's buying all my tarantulas know toshow up on the other day. I'll bring my laptop and you can watch me issue the refund.

What day is good for you?

Kevin

Even though I am out of business and she knew this because she offered to help pack up the remainder of my animals I was willing to take them back since she was not happy.

I get this from her in return

Hey Kevin,

She looked like a stripe to me as well, but after asking some questions and being shown those pictures I'm pretty confident she's a Motley pinstripe. Is it possible that she's a Motley/Stripe? Yes. But it is also equally possible that her genetic is Motley. Didn't you tell me that she produced some Motley babies this last year? So you can't sit there and tell me she isn't at least a Motley/Stripe, especially judging by her lack of a solid stripe pattern and the manner in which her stripe begins. (if you looked the comparison shots you would see a clear difference between pinstripe motley and stripe - I did) Point being, I don't have a use for Motley. I prefer to work with Stripe. I want the stripe gene, that's what I wanted when I got her. Is she fine, beautiful specimen? Yes, but even the slightest chance she isn't stripe makes her genetics useless to me. Breeding trials would tell. I do have a male Butter Stripe that I'd planned to pair her with... that would put the controversy to rest...

I never once meant to call you a liar or imply that you are lying. I just want to make that clear. Yeah, I was upset at first, I think I have a right to be. I've never bought an animal and then found out there's a good possibility the genetics are incorrect. I've never got a snake home and found that it regurged because the seller fed it right before shipping/pick-up and you knew I'd be coming Thursday.

Which brings me to the Kingsnakes... you said the female was "a little flighty" and said nothing about the male. Now, by my standards the male is a little flighty and the female is very high strung. I purchased a breedable pair of kingsnakes and if the female continues to regurge there's no way that I would be able to safely breed her. I plan on giving her a peach fuzzy next week to see if she can hold it down, I hope she can. Based upon what you told me about her behavior I thought it would be okay. I wanted to check her out in person to see if I would be comfortable handling her - didn't really get that chance because you weren't there for me to talk to. I never would have brought either of them home if you'd been there and I knew I'd be able to get a refund. I wanted to make sure I at least got the snakes, even if I didn't want them. At least I wouldn't be out the snakes and the money if you decided "hey, I'm out of the business, don't need my reputation, to hell with her" and you have to admit it isn't so bad to think that way, what with some of the crap people pull on Fauna. I've been bit in the ass for being too trusting and it sucks. So no offense to you, I've just learned the hard way not to be naive and trusting.

I never said I would be there at 11am. I never really said I'd be there at noon. I do remember telling you I would be there after noon or around it - I was iffy on the time. I have to be up at 6am for class, the days I get to sleep in a bit are really nice, especially for me as I am not a morning person. I was under the impression that the other guy was coming Wednesday and I was coming Thursday. I didn't know things had changed or I would have gotten up and been there, not dallied around all morning. Perhaps just something to keep in mind for the future, for both of us, as this was just a miscommunication between us.

I will be honest with you, I don't think the MBK should be bred this year. And if you're just going pass her off to someone who doesn't care that she regurged (which is pretty damn serious in my book) or take note of her stress level, then I don't think it's in the best interest of the animals to be returned to you. In spite of what I want or what I'm comfortable doing I refuse to not consider the snakes in this. The female MBK at the very least needs to be left alone and not moved around until she can keep a couple meals down. Your years of experience might tell you she's okay, but my gut tells me not to take risks with a living creature, even if it's a small risk. So no, I will keep them. I may rehome them in the future, but I'll make sure they go to good homes that care about their well being.

I'm sorry if that insults you and your reputation. But I pride myself on putting the animal first.

Thanks for hearing me out.

Em.

From my perspective it seems like every time I turn around she is trying to insult me. First she all but calls me a liar about the geneitcs. I listed her as she was sold to me.. and as she looked. Up until last year I didn't know she was het amel. Who knows what is lurking in the genotype.

She then thinks she knows more about my snakes after having them for around 24 hours than I do and I have had them for around 2.5 years.

She also goes into sayin how I told her that female produced motley babies. I never once told her that female produced motley babies. In my next email I even offer photographic proof of her clutch.

Hello Em,

Never once did I say that female anery stripe thru motley babies. You're getting your animals mixed up and I can prove it. Here is her breeding records from last year.

http://www.ridgetopreptiles.com/RTR/clutch-database-2/2010-clutches/10-06/

Her genetics are true. Did you even look at the photo I sent you of a motley? Are you still gonna say she's a motley? Would you like to see a motley baby that I produced from another clutch?

http://www.ridgetopreptiles.com/RTR/Database/clutch-database/2010/clutch07/10.07.03.jpg

and to prove it wasn’t the same pair... .that baby is the third one in the list.

http://www.ridgetopreptiles.com/RTR/clutch-database-2/2010-clutches/10-07/

As for motley vs stripe....Motley is dominate over stripe. If its motley... it is going to show motley. It's not going to show stripe. I can prove that just by looking at the link above in clutch 10-07. I bred a stripe to a snake that was het motley. And what did I get..... more motleys which proves motley is dominate over stripe. Each and every one of those motley babies is het stripe... or also known as Motley/Stripe. Do you still think my girl is a Motley/Stripe?

As for the regurge... I am sorry that happened. I did let you know that "they are out of brumation and will be fed tonight because for the last several days it has been too warm even with the window's open and everyone was moving around." Out of around 70 snakes only two regurged due to the move. Your MBK and a snow that the other buyer got.

Compared to what I have worked with.... that female is a 'little flighty'. The female will NOT continue to regurge. She may have been stressed from the move... or whatever handling you did with her. I have had her for a very long time and she has never regurged before..

If I didn't care about the rep I had built up... .I would have already told you .... too bad. I am offering a refund. Bring them back and you can get your refund. You could have had your refund that night if you didn't want the MBK's. You just had to call and I would have processed it when I got home. Please understand I had someone that had bought out my entire collection and they were at his house WITHOUT racks to put them in. I couldn’t wait around all day. I had to get those racks there, and then I had to get back because I had to work the next day.

Please don’t take this the wrong way. But your last paragraph is NOT sitting well with me. You're telling me you don’t think the snakes should be bred this year... and YOU'RE the one that called me telling me there was a problem with my corn's headand it turned out to be some urates because she had gone to the bathroom and gotten it on her? I can understand and appreciate your concern.... but with your last paragraph I also have to question your experience level in deciding if a pair of snakes should or should not be bred.

You contact me looking for a refund... and I offered one... and now your telling me the snake shouldn't be moved? You've had that snake for around 24hrs and you know it better than me and I've had it for almost 2.5 years? She has never regurged before and I normally do a tank clean either the day after or two days after feeding. That means she gets handled with food in her belly.... and never not once has she regurged. If I thought there was even a slightest chance I wouldn’t have fed her and told you to do it when you got home.

Do you honestly think I would put animals that I spent the last 2.5 years caring for in danger? I may be a lot of things... but I'm not some flipper out to make a quick buck. I have put my heart and soul into my business. Yes.... I may be out of business now... but that does not negate the fact that I care about what happens to my animals. Your obviously not interested in my animals and I would prefer they reside with someone that is.

As to this..... "I never would have brought either of them home if you'd been there and I knew I'd be able to get a refund. I wanted to make sure I at least got the snakes, even if I didn't want them. At least I wouldn't be out the snakes and the money if you decided hey, I'm out of the business, don't need my reputation, to hell with her" and you have to admit it isn't so bad to think that way, what with some of the crap people pull on Fauna"

You obviously don't know me at all. That is exactly the kind of person I try to bring down on Fauna. Maybe you don’t think it’s a bad way to think.... but quite frankly I do. As I have said for the last 4 years... RTR stands for 2 things.... Quality animals and Quality customer service. I may be out of business, but Im not willing to toss it all away because of it.

I'm offering again. Pick a day (Wednesday or Thursday) and I will take them back and refund your money.

Kevin,

I have a Motley/Stripe Snow that has STRIPES over most of her body. She is genetically a Motley/Stripe, having one Motley and one Stripe gene. She still has the Motley pattern in some areas of her body, but there are distinct differences to a Stripe. As someone who owns several striped snakes and has seen comparison pictures of the same morph where one is a Motley/Stripe and a Stripe. Not all Motleys have perfect circle spots... some of those spots are elongated to look like stripes, but it is not a true Stripe - Much like my Motley/Stripe Snow girl. You can see this in some of these pictures: http://iansvivarium.com/morphguide/motley/

And I was asking if she threw Motley babies. You told me about several of your clutches from this last year and I couldn't remember which was which... and that is why I asked you. Now, for someone who isn't being accused of anything you sure are being defensive... I don't think you were trying to rip me off because she was listed on your website as a Stripe. Whoever bred her probably misidentified the morph. Until today I probably would have as well.

I did mention a refund, but I never said it had to be this next week. I wasn't setting up a time when I could dump the snakes back on you, I wanted to see if you were even willing to work it out or if you were going to blow me off. You're right, I don't know you and you don't know me.

You know, she probably won't regurge again, but even so I'd prefer to baby her a little and make sure. Better safe than sorry, in my opinion. And you think it's a bad thing that I was concerned over seeing an anomaly on a snake? It was dried and stuck on, I couldn't tell if it was a sore of some kind, or if she'd gotten a piece of something stuck on her or what. When I picked the top layer off it looked like there was a sore on the underside of her mouth. It was a small spot and difficult to make out what it was exactly. I'd much rather put medicine on a dried poop spot then ignore the spot and it turn out to be something serious or develop into something serious due to my neglect. Once again; better safe than sorry. I called you because I thought you might have seen it and forgotten to mention it. I knew that you had been crazy busy and just wanted to touch base with you. Is that really a crime? Is that so bad? If you care about the animals wouldn't your rather I call you and have it turn out as a false alarm? If I found a spot like that on one of my other snakes I would have been on the phone to a Vet to have it looked out. I've been in situations where if I had waited the animal would have died and that is why I simply will not take risks and why I will not feel bad for over reacting when it comes to the health of my babies.

I don't have any issue with admitting this is my first year breeding, I told you as much in my first or second email to you. If I have any doubts at all about a female's size, health, or condition to breed I simply do not breed her. Again, better safe than sorry. I'm not in this to make money, I'm in it for the pleasure of producing specific morphs for myself. It doesn't hurt me if a snake isn't big enough to breed in a given year. That's a policy I'll keep around even when I do have more experience.

In closing... I am declining your offer of a refund. I've made up my mind. I'm going to hold onto them. I appreciate your willingness, so thank you anyway.

Em.

At this point I have about had all I will put up with.

This was my last email to her and as of this writeup she has not responded back.

Em,

On Jan 27th I sent you a photo of her. You liked the way she looks and you wanted her. She was sold to me as an anery stripe.... I labeled her as an anery stripe.... and I sold her as an anery stripe. She does not look like a motley.

You asked about the MBK's on the phone and I was upfront with you. I even told you the demeanor the babies would have because they are more spazzy than the adult with their slinging crap, and musking. You said as long as they don’t bite I'm ok with that.

You asked about a refund and I said sure.... bring all three back to me next week and we will get that taken care of.

At this point I am going above and beyond, because you saw the photos of her before purchasing and you admitted that I told you the MBK's were a little flighty.

In the last email you stated... "I did mention a refund, but I never said it had to be this next week. I wasn't setting up a time when I could dump the snakes back on you, I wanted to see if you were even willing to work it out or if you were going to blow me off. " By the time rolls around for next week you would have had the snakes in your possession for a week. During that week long period I have no way of knowing how the animals are being taken care of.... but I was still willing to take them back (this is not a dig against you or your husbandry... most breeders only guarantee live arrival because we cant control what happens after they arrive). I was trying to do right by my customer. Most breeders would have said ship them back the next day. I realize our deal is a little different than most because of our somewhat local nature and us working out the pickup on my off day. Now you saying that you "never said it had to be this next week". I'm sorry... but I'm not willing to extend a satisfaction guarantee (which I don’t really have stated anywhere) for longer than the next available time to return them.

Even though I am no longer in business, I have tried to do right by you.I have done everything in my power to work it out (even though I didn't have to) and your blowing me off. The anery will produce you some beautiful babies, and with light handling (don’t grasp them tightly) the MBK's are a joy to work with and not real flighty. If you grasp them hard they think something is trying to get them and they want to bolt. I actually only grasp them when picking them up... after that I let them slither thru my hands... going from hand to hand.

Enjoy your 3 snakes,

Kevin

Tonight when I got home I went over to CS to check out that thread. My buyer had posted a comment and she responded with

EM4.jpg

That is the straw that broke the camels back. I offered what 2, 3 times to take those animals back because she wasn't happy. She refused my offer of a refund for returning the snakes to me.... yet she still wants to blast on a forum how she's not happy. I attempted to go above and beyond what I had to do to make things right and she still wants to talk about how she is not happy.

She saw photos of the snakes in question BEFORE purchasing them and she loved them. She admits that I told her the MBKs were a bit flighty. Everything was disclosed before the sale was made. I could have just as easily said.... you saw photos and were informed on the MBKs temperament... all sales are final as I am no longer in business.

I didn't do that. I offered a refund in exchange for the snakes back. What would have made you happy Em? A refund and letting you keep the snakes?

I offered on a few occasions to take those 3 snakes back and give you a refund. That is what you were seeking with your very first email to me where you voiced your displeasure. I did everything in my power to try and satisfy my customer however apparently you cant be satisfied... but yet you still want to talk about how your not happy with the animals.

I never thought I would do this. For you Em and only you.... I am recending my offers. There is no chance to change your mind. I am officially out of business. You saw photos of the snakes and the MBK's were honestly represented. You still wanted them and paid for them. All sales are final!

yes... she has been notified of this thread.

Wow... I can't say I'm not surprised at this Kevin... and I can't believe my attempt to work it out with you turned into you posting a BOI about me. This was completely unnecessary in my opinion.

http://www.cornsnakes.com/forums/showthread.php?t=108783 Is the photo thread I posted, showing off my new snake from Kevin. A friend of mine there posted about the Motley vs the Stripe and I decided based on that info to confide in my friends on CS.com. I was upset, not only about the possibility of the snake I just got not being of the correct genetics (something I have said time and again that was not Kevin's fault and was likely an honest mistake of the person who bred her), but about some other things that had been bothering.

I chose to keep the snakes because I felt like it was in the MBK female's best interest to remain here and not be moved around due to her regurge and the fact she seemed high strung.

And never once did I claim to know more about these animal's than Kevin. I simply made a judgment call based upon how they acted in my presence.

As for posting to friends on CS.com - that is a public forum, he was able at any time to step forward and post. I also went to lengths to keep his name unknown and edited my initial post in the photo thread so that his business name was not disclosed. I was not intending to bad mouth or degrade him or ruin his reputation. I was simply venting about a business deal in a place of comfort to friends. And after making that post I sent Kevin an email to discuss my issues with him.

I would also like to point out that I made the decision to keep the snakes and ceased contact with Kevin. I even thanked him for hearing me out, not once, but the second time I even told him I appreciated his efforts! He pursued this further, even going so far as to tell the man who purchased his business about the issue who then posted in the photo thread to scold me for "degrading" Kevin.

In closing, I know my side of things, those I do business with know me and know that I'm a good person. That's all I need.

So to you Kevin... You have shown your true colors to me in posting this thread. In my eyes you are vindictive and petty and I pity you for that. I know that I should have handled certain things in this situation differently and there is certainly room for improvement on my part. But at least I can admit that.

I certainly agree with your stance!

From what I have read, I can conclude that it appears that she was attempting to see if she could get a refund while keeping the snakes. We have seen so many buyers try that tactic and claim it's out of 'concern'...sometimes it is..but as a business deal, it is simply not feasible to let customers decide on their own to keep animals while expecting a refund.

In my opinion, she certainly does not present herself as someone that I would want as a customer. It's simply NOT done, to blast a seller before giving him a chance to make a resolution to the issue. What irks me from reading this case is after she decides to keep them and try and keep the option of a refund open..she still continues to blast you other places, while denying that it's what she is doing.

Thanks for the heads up on her, and sorry you had to get this one just as you were getting out. :(

Vindictive??? Did you ever ONCE stop to think that the seller and/or his friends would KNOW who you were talking about? Did you ever once stop to think that the seller should have been the FIRST person that you contacted (forget this hooey about "comfort in the presence of FRIENDS") It's a PUBLIC forum as you noted, and as such it's a PUBLIC complaint about your business deal with Kevin.

Sorry, it didn't come across to me as just a "sharing with friends." If you were actually sharing with FRIENDS you would/could have sent a Pm to a few that you knew intimately.:NoNo:

Excuse me?? I was not expecting a refund while keeping the animals. I never meant or intended that. If I had kept the animals I wouldn't have taken a refund until I had returned them to Kevin's care and even if he had refunded before receiving them I am not a crook, they would have been returned as promised in as good a condition as when I took them. Period.

I have done plenty of respectful business with Carol Huddleston, Colorado Corns, Susan Willis, and others of the Cornsnakes.com community. Never ONCE have I ripped someone off, even when I could have and I never will. My integrity, morals, and sense of honor are worth more than a measly $160.

See, that's the thing; WHAT were you trying to accomplish? :shrug01: Kevin offered you a refund since you publicy stated that the genetics were wrong and you weren't happy with the deal.

So blasting the deal in public while refusing a resolution in private, would make any business irked.

I am sure you have done good business in the past and will in the future, that's not the point. Right HERE and right NOW, I don't see how this situation reflects favorably on you as a buyer in this instance. :shrug01:

That's where you have it wrong, miss Deborah.

At the time of my post on CS.com I was set on a refund because I was upset. Later after speaking with Kevin and had cooled off I decided to refuse the refund and keep the snakes. I felt the MBK female might need some babying after her regurge (I have a small collection, it's easy for me to baby my snakes) and I wanted to go ahead with my plans to breed the Corn snake female to prove one way or another her true genetics.

Here's the times on my initial post and the email where I declined the refund.

My First email to Kevin: Fri, Feb 4, 2011 at 8:30 PM
And the email where I refused the refund: Sat, Feb 5, 2011 at 4:19 AM

If you'd like I can screen shot it all for you. But in short. I was not, as you said, bad mouthing him for not coming up with a solution while privately declining his offer.

Anything else you'd like me to lay out?

I didn't say, you were bad mouthing him FOR not coming up with a resolution. Reread, please.

I stated exactly what happened. You were posting about your unhappiness with the deal. You were posting about your concern with the genetics. In private emails, Kevin was trying to make you happy by giving you a refund. You did not at first decline the refund, you did decline later.

SO, you were bad-mouthing the deal in PUBLIC, while declining a resolution in private.

If I misunderstand what I read in the situation, I am sure you will once again correct me Auntie EM.:)

Ah my mistake, I misread what you wrote.

If you check the thread you can see I made that post and we continued to discuss snake genetics. There simply was no further mention of the issue until Kevin's friend Mr. Beasley poked his head in. But, since it seems to be an issue, I have made a statement to let everyone know publicly. Not that it should matter since Kevin decided to post the BOI and all our emails in public for them to see. :shrug01:

Something I've really been wondering here...

Kevin, why did you see posting a BOI thread as necessary? You got your money. You lost nothing. As far as I'm concerned your reputation was intact (I didn't post a BOI thread about you and when I did make that post I didn't mention your name or business - I was trying to keep your identity confidential in an effort to protect your reputation)... What was the point other than to smear me? There are people out there that are actually a menace to this community, why waste everyone's time with something so obviously pointless?

I wasn't out to get you. I wasn't trying to smear you. I didn't accuse you of ripping me off or intentionally misguiding me. I paid you as was agreed, early even! What the heck is the issue? The real issue... Are you upset that I posted on CS.com about the situation? If so I apologize, as I have said a zillion times I was not intent on ruining you or insulting you, I was expressing my concern to friends. If you want to think that's an act, fine, I can't stop you from believing whatever it is you want to believe.

And that goes for everyone.

But the bottom line is this... I'm an honest, moral woman that sought only to voice my opinions to a seller and reconcile the situation. At first I felt that I wanted a refund as I was upset, but after cooling down and talking to Kevin I changed my mind. I'm a woman, I change my mind a lot, just ask my husband! Did I make mistakes? Yes I did, I'm sure there are areas of this I could have handled better and I will in the future. Live and learn.

-- when I first saw a photo of that anery "stripe" girl, before reading the post at all, I thought it looked like a motley. But I completely understand how someone not into cornsnakes would confuse the two

-- Em, this is an unfortunate situation, but I think it's wise to be aware that when posting things publicly on the internet... they are public. Even if one doesn't "name names" it's important to think about what if the other party read it, what would they think? It usually pisses 'em off! They can't reply without "outing" themselves so they have to sit and stew and try to be polite in private notes.
That said, I think an advice post "is this a motley or stripe" is perfectly reasonable.

-- I think the temperament thing is a bit odd, temperament seems to vary a lot based on what the keeper's standards are, plus the snakes were probably riled from the move... though noting the regurge is probably important in case health issues come up

-- in the case of a deal that does not go as expected, it's important to sit down and think hard of what will make you a) satisfied or b) happy. I've had a bad surprise or two and some dealers make me very happy, some have made me satisfied (but not exactly happy). But if they meet what I request then I figure they have done their part. I don't talk ill of them publicly, even without naming names. It's also important not to make random demands and then change your mind, that's a huge headache for the seller trying to make things right.

-- Was a BOI thread "deserved"? Ehhh, I dunno. But it is an "info" thread. Em, you post a lot of stuff with the excuse that "you were upset". Well, I think Kevin posted this because he'd gotten pretty upset too :shrug01: But yes Kevin I think the best thing would have been just to let it slide, especially since you're not in the biz anymore and Em's final post made it clear she was okay with the deal.

Hope you two can work out all the negative vibes! I hate to see so much gruff over honest mistakes from decent people.

Kevin's holding an animal for me until the weather warms a bit to ship her, and has been nothing but courteous and very willing to work with me. In truth, I wish 99.9% of the other folks I've dealt with would be so accommodating. I've been around him on the forums for a few years now, and he's a reasonable guy if you give him a chance to take care of things. :shrug01: If there was a mistake made on the morph, it was an honest one. And the kings had just gone through a transport and handling, I'd be flighty too. The feeding before pickup is the only thing I see that could have been done differently. But if it's handled right a regurge isn't the end of the world. He offered a solution several times which was promptly shot down. That makes him a solid seller in my eyes. Sure, he could have told you to go whiz up a rope because he's out but he didn't.

Another for the DNSTORBF list. Thanks for the heads up Kevin.

I couldn't have said it better myself. I also saw an anery pinstriped motley instead of a stripe, but being able to tell the difference takes experience and even then, mistakes happen. Could this have been handled better? Most definitely. I would chalk it up as being a learning experience and let it slide.

You came to me looking for a refund and to return the snakes. I offered that on multiple occasions. You however declined it , but yet KEPT posting about how your unhappy.

I wasn't sure if contacting him was even worth it or not. Obviously, it wasn't a good idea as it accomplished nothing.

It accomplished nothing... because you wouldnt let it. I offered the refund at your request. What more did you want. Go back and read your first email to me. You wanted to know if we could work something out.... bring them back for a refund or something.

I said YES.

Kevin, why did you see posting a BOI thread as necessary? You got your money. You lost nothing. I posted it because on several occasions I offered what you were after. I offered the refund for return of the animals... I was even going so far as taking them back after 7 days in your care and being out of business. I posted it because I got home last night and check the forums and your still complaining about how your not happy with the animals, but yet refused the refund. That last post to Rich got this put up. You were still claiming to be unhappy... but yet wouldnt return the animals for a refund.

Add that to what you put in your last email
I did mention a refund, but I never said it had to be this next week. I wasn't setting up a time when I could dump the snakes back on you, I wanted to see if you were even willing to work it out or if you were going to blow me off.

And I really have to question your motives. As a seller and breeder, there is no way I can let you keep the animals for weeks on end until you want to return them and then take them back. I was willing to do the 7 days because of our semi local nature and both of our work schedules. Anything past my next days off also makes me have to wonder.

And that is what got this posted. After she sent me that email she was still complaining on CS. What more could I do? I offered and she still wants to complain.

Thinks about it.....

I got no call from her about her reservations on the MBK's. If she would have I would have told her to leave them and I would refund her money when I got home. It's not like I was going anywhere.... she knew where I lived.

Even with me being out of business.... I tried my best to make it right. She wanted a refund and to return the snakes. I said ok.... Pick one of my off days next week... and you can even watch me make the refund transaction so you know your getting it.

She then states I did mention a refund, but I never said it had to be this next week. I wasn't setting up a time when I could dump the snakes back on you, I wanted to see if you were even willing to work it out or if you were going to blow me off.

I am trying my best to accomodate her and make her happy.... even though I dont have to. One... she saw photos before she purchased and knew what she was getting.
Two... I discolosed the nature of the MBKs and she agreed I did.
Three... I could have said...I'm out of businss so what do I care? I however did not do that. I tried everything in my power to make her happy and make it right.

And she still is posting how she's not happy over on CS. What more does she want from me?

I agree the situation looks to be very frustrating - I just personally have a very high threshold for public posting. ... this is also partly why I too am getting out of selling snakes, as doing this can be quite stressful when a buyer comes back at you with some crazy notions and you have to politely deal with that while wondering how to manage a return or what @-@

Personally I would have offered to refund the difference in value between an anery stripe and an anery mot with a stripe pattern. Stripes tend to be a bit more valuable than mots. BUT if this is what Em wanted she could also have requested that and gone from there. I don't think you did anything wrong, just saying what I might have offered.
