Interesting......as I stated before, yesterday was supposed to be the actual shipping date of the snake. Not surprisingly, I did not recieve a tracking number or a snake. But today I recieved an email from her stating that she had a family emergency and that she would be emailing later with the shipping information. I guess I will see if I actually do recieve the snake (the actualy snake I ordered, not some tick infested male) and if I do, I will send her back her money? Kind of weird??

That is weird. So this person tried unsuccessfully to cash the money order and now she is saying shes going to ship? Did she mention anything about not being able to cash the money order?

Nope, no mention of the money order and no mention of the email I sent her asking about her possibly selling the snakes to someone else. Although the email she sent her reply from was that email, so I know she read it. I am curious to to see if she does send it or not?

That's one of those rare ocassions where you get to inspect the animal you are buying before paying (if she actually ships her of course)! Please let us know of the outcome I'm also intrigued as of what's going on.

agreed...I wouldn't hold my breath waiting for it to arrive, but if it does (and it is as advertised) you are obligated to send payment promptly or return the snake. Did you notify her that you stopped payment?? If not, if you return the snake it's at your own expense (and an argument could also be made for you to reimburse her cost)

of course, at no time should a snake be shipped without confirmation & approval by the buyer...so that shouldn't happen. I hate getting the email: "oh, btw, I shipped the snake today. It'll be there first thing tomorrow." the only thing worse is getting home and finding a box outside my door that I didn't know was coming

Certainly one of the more interesting posts to follow. Great job Dennis with the research !! You are "A#1". As for the whole "will she ship, will I then send her the money, stop payments successfully completed....etc", I am doubtful that anything will be sent, but I also think it likely that she may not yet know that there are stop-payments in, etc. I am not sure that I caught it all, but what I think was said that she had one attempt to cash it turned down, maybe because she didn't have an account, or do we know that the bank checked the money order and tld her it was no good? Even with an account, she could have it deposited, hopefully not credited until it clears, and not find out it is no longer a good money order until it comes back from her bank, which can take a week or so in such cases, I believe. Puts her in even more hot water with her bank, as they usually credit it before it gets returned, and if she has withdrawn the money, she will be hearing from her bank very quickly once that happens. A lot of specualtion on my part, as I may have missed something, or be unclear on details. Nice to see the good guys win one though!

Unless the snake results to be a male instead of a female, then I don’t feel Lee should be responsible for the return shipping.

I was truly very surprised to hear from her today. After hearing of the two other people that she agreed to sell the snakes to, the information that Dennis posted (great fact finding!!) and the fact that I have never heard back from her since she recieved the money (inculding the inquiry about her selling the snakes to someone else), I figured I was totally being scammed and put a stop payment on the MO as fast as I could. They tried to cash the money order BEFORE we put a stop payment on it. The bank thought it was probably due to lack of proper ID, but they don't want to give out too much information. Even if she was planning on sending the snakes, I still think I did the correct thing and anyone would have responded in such a way.

I have not responded to her email yet, as I am not sure how to handle it. I'm still not sure that I will actually hear back from her with the shipping information. If she writes me back with the info I would tell her, but I am not resending the money without seeing the actual animal first. If it is indeed the correct animal I would send her the money overnight at my expense. If she is not happy with this she can simply put the animals back up for sale and see if anyone else wants to deal with her. Sounds kind of harsh, but with all of the internet scamming going on out there, this is definitely not sounding like a cool situation.

When you do reply, invite the "seller" onto the BOI.

Let's see how they explain the previous transactions that have been detailed in this thread.

Could the bank refusing to cash the money order simply be coincidence?

Maybe, but given the scenario I would conclude that this is a scam.

Just tell them that you are not comfortable based upon information that has come to light since you initiated the transaction.

If she is truthful to her word by now the snake is on its way. It seems odd that she would send her when she wasn’t able to cash the order. One way or the other what you are planning on doing is the right thing to do.

Not harsh at all Lee. Under the circumstances I do not think there is a member here who would recommend you paying first. She is not really worht an escrow arrangement either. While it is not the normal procedure, she is certainly not in the "reputable breeder" category that would ease someone's mind in paying in advance, and I do not expect her to attain that lofty title anytime soon!

After my last post I was thinking to myself..."what am I thinking? I should just tell her to stuff it!" But, call it morbid curiosity, I want to see what she is up to. Maybe by telling me that she's still planning on shipping the snake, she is trying to buy herself a couple more days to find a way to cash that MO. Unless she's visited here, of course. However, I would never let her send the snake without telling her I canceled it, unless she sends it without contacting me first.

I guess a part of me is hoping that she is not a bad person and that maybe something did happen, and not so much because of the snake, but because it would be nice to not have been taken advantage of. I hate to think the worst of people all of the time. Although I'm not thinking this is the case.

I disagree (on 2 counts)- If Lee cancels payment, but does not inform the seller - returning the snake is Lee's responsibility; and if the seller (any seller)sends a snake of the incorrect sex, the seller should pay (or refund the cost of) return shipping

Now that I read what I typed it leads to confusion.

What I meant was, I don't feel Lee should be responsible for the return shipping if the snake ends up being a male (misrepresentation). In fact the seller should pay for shipping both ways as he send something that was not agreed upon.

On the other hand if Lee cancels payment without notification and wants to return the snake, shouldn't he be paying shipping both ways and not just the return shipping? Let's forget for a moment the possibility of attempted scam, and strictly deal with the facts at hand. Why would a seller that was not notified that the buyer did not pay (and will return the merchandise) should be paying shipping both ways?

The cost of shipping the snake to me was factored into the cost of the snake. She was $175 shipped. Seeriously, if she were to ship the snake to me without letting me know first without giving me a chance to tell her, the only way I would send the snake back to her was if it wasn't even the snake I originally purchased in the first place. In which case I am still getting scammed and I don't see why I should have to pay the shipping back for a snake I didn't order? But, I think at this point the best thing to do is to write her and let her know that I did stop payment and to direct her here as to why.
