    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Bad Guy Fire and Ice Dragons (Terri Sommella)

I understand that breeders have policies in place to protect themselves. I am by no mean trying to scam her. No where on her site does it say that there are absolutely no refunds. I do have a message out to Terri and I am hoping I get a response.
 
Since the deal isn't between you and him, you don't really need to understand "why" he wants the refund. Whether "sh.t happens" or not, it's not your place to say, as the transaction was between him and her...:rolleyes:

If you look at her site, there are two hatch dates for the Mia x Photon pairing.

Babies Hatched: 6-7-10 SOLD OUT
Second Clutch Hatched: 7-3-10

My suspicion is that she over sold the first clutch and bumped me to the second and I am being mislead to believe that I am still on the first clutch that I had originally bought from.

i don't know what the exact arrangement was but lets say that's true and there wasn't a hold back in that clutch for you

then is it any hard ship waiting a few more weeks for what you wanted

see this is what i don't understand when i import i can wait 6 months
for the dragons Ive ordered i thought that was the norm
people over here order from me sometimes 12 months in advance
 
Mark, I don't think there is much you can do to help the situation as it stands. We can sympathize, offer advice, and commiserate with Terri and/or Josh all day long, but ultimately it is between them.

Just as I think Terri should just go ahead and refund his money, you believe Josh needs to wait it out. Everyone is entitled to their own opinion, but in the end what happens is between them.

Josh purchased the dragon thinking he was going to be receiving it by the end of June. Now that it is mid-July, he feels that Terri did not uphold her end of the bargain. Since she will not offer pictures for another two weeks and has possibly oversold her stock, Josh wants a refund. I am not certain what you can do to remedy the situation for Josh unless perhaps you are able to send him a healthy young dragon worth the amount he paid or issue his refund.

Yes it is. This was not in our original agreement. Do you think she would have held the dragon for me if I told her that it would take me and extra month to make payment? No she would not have. This goes both ways.

IF that is the case, Josh is being misled as he suspects! He paid for the best (or one of the best) dragons out of the first clutch! To be given a dragon out of the second clutch without making prior arrangements means that the original deal has been broken and Josh is NOT getting what he paid for. Who knows maybe the second clutch will have a better "hold back quality" dragon, but maybe not. Either way, IF this is what has happened, Josh should have been kept in the loop more and I suspect this would have never been brought to the BOI.

Yes, but that is when you are expecting the wait. You know that you will be waiting months and you are okay with that arrangement. Josh did not sign up for several months of patience. He paid up front for a dragon that he was expecting to be delivered by the end of June. When there are dozens of other high quality dragons looking for homes, there isn't the incentive to wait for weeks on end with no contact from the breeder.

Some people are happy to wait a little longer than anticipated and some are not. Maybe if Terri were to pop in with some pictures showing Josh's healthy baby eating heartily, basking luxuriously, sleeping peacefully, and looking around at this great big world with big bright eyes he might be inclined to stick it out. A little customer service goes a long way and Josh doesn't seem to be getting what he needs.

Why are you hung up on the flipping flag?
It's an icon that's used on the site there is a whole mess of them just to right side of the screen when you post. I could have easily picked any one of them, just like any user can. There are a few loads worse than the flag.

I'm sure the OP is pretty put back at this whole mess with his dragon and money.

no this is a bit of a worry???
what I'm trying to do is see if josh is willing to Wait the few more weeks
and try and reassure him he will get the dragon he ordered

Of course, he will get his dragon shipped. I posted an email from josh this morning where he elected to wait 2 weeks until his dragon was out of shed to get pics. Then he changed his mind again.

shes kept on hold dragons for me and breeders over here for some time
until we could pay

the refund issue well i don't know
lets hope that it doesn't come to that, I'm sure some how the problem can be resolved

You forgot to add the part about the phone conversation we just had. I have formally requested a refund many times. As stated on the phone, I want the refund not the dragon. You stated that your site clearly states there are no refunds but couldnt tell me where it says that.

I have nothing to gain from the back and forths. Per our conversation, a refund is the desired outcome. I really wanted this to be handled in a professional manner but it is obvious after talking to you, that can not be accomplished.

Please do not take what I am saying as a threat. I will be filing a complaint with the Better Business Bureau and I will be contacting the Littlestown police department tomorrow.

I am really disappointed that it had to come to this but you leave me no choice.

i can see where your coming from
but in Terri's defence if the baby is in shed then josh would not be happy with a picture of a dull baby

Notice how the option for a refund isn't there? I am not simply going to give you $360 for nothing.

I had actually posted earlier that I had respect for you as a breeder. Since our phone conversation, that is not the case.
 
Wow Terri...I would welcome any proof that you have to offer that I was threatening. I really think that so far I have been playing nice. By no means was this a smear campaign. If you remember, I had sent you this email:

I have been doing a bit of research and I am beginning to think that I am being taken advantage of. I have been a member of faunaclassifieds for a bit of time now and have put in extensive research. Every other breeder of dragons provides updates and pictures of the animal. Also if there is an issue with the dragons not being the correct weight and size by this time, there is something wrong with that batch of animals. Per your site, you do offer refunds. "Please note: No refunds are given on deposits for special order dragons or dragons held for International shipment before the dragon has shipped. Thank you". My order was not for a special order dragon or for international shipping. I am formally asking for a refund. Our original agreement was for the clutch that hatched on 6-7-10. You stated in the email that it would ship the end of June. It is quickly approaching the end of July.

I am asking that you please honor your guarantee for a refund. I wish to settle this amicably.

When I read that, I do not get any threatening tones. No vulgar language was used or any type of "you need to do this or else" type statements.

When I placed my order, I consider the purchase as a commitment to both parties. I had the commitment of getting you a payment as well as getting the supplies in order that you had said needed on your shopping list. You had the commitment as a seller to, within reason, provide me with hold back quality dragon. I also do not think that pictures were out of line.

How is providing me a refund, rewarding me? I am not asking for any type of free anything. I do not expect a refund and the dragon. I am asking you to honor your commitment and do the right thing.

If you receive your dragon and are unhappy with it, we will provide you with a refund after the dragon is returned in good health. We do not pay return shipping.
