I don't keep this species; but one has to remember that large scale breeders don't necessarily focus on the longevity of their animals. The goal is often to get them to breeding size as quickly as possible if they are keeping them...if they're for sale, a less aggressive approach is common.
As far as the "breach of TOS" - one can put any terms one wants there; but that doesn't make them legally binding. Ultimately, it is the relevant business law that rules supreme.
If you "simply thought it was small" rather than unhealthy, why ask for a refund?
I didnt pay $200 to receive an animal I felt was small for its age, and as the screenshots show I was completely unaware of the age until I went to go find the baby pictures.
If you were receiving baby photos, why did you say you were told the animal had not grown?
Basically it sounds like you are asking for a refund because it is inconvenient for you to grow the male out.
Honestly, I misspoke as I have tons going on this week. No one has ever own the gecko but Margaret/AJD as far as I know and my issue is not growing him out. I have stated before, the issue is the age and weight. We seem to fundamentally disagree.
I had no plans for the male this season but my females I am growing up are rather large. It is a valid concern to breed a smaller male, is it not? If he is only 16g at 18 months at his current rate it stands that he will be 32 grams in 4 years at adulthood?
