Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Well,after unfortunately and inadvertently getting mixed up in this,I think there will be some resolution to this.Don't want to count the chickens to soon,but there seems to be an amicable solution on the table.Sometimes our emotions blind our logic,and also we make bad decisions.It is the real measure of a person to correct them when faced with the choice of right or wrong.We can all look good when everything is going good,but it's what we do when the you know what hits the fan that counts.Hopefully it will be straightened out this weekend.
 
There are two sides to every story, I would really like to hear what Jason has to say about this.

Given what has already been shown Jason owes you the money.

4) I used the money given as payment for reinvestment in my company, a usual practice in business. you paid over time as well, since my living is based on animal sales, it was a justified use of funds rendered for the products.

Lame excuse and totally on you Jason. Steven deserves to be paid promptly

Actually, I didn't miss anything....
it's pretty simple really, three offers were made
1) money back
2) geckos of equal value ( cb) when they're available
3) The animals that produced the geckos you were purchasing.

It wasn't until all of these offers were refused, that Jason said he had decided not to pay you the rest of the money. He made his offers, you denied them, and said you would be taking further action. If you had waited until he was able to pay you back, there would be no further problem. In fact, I believe in one of those emails you said you expected full payment by february 8th. Is it february 8th yet? Is it March when he said he'd be able to pay you in full?

If all of the offers are denied, and he knows he cannot have the money by the time you are going to start to take further action, then what more is there that he can do? He said he'd give you money, or geckos, but the money would take awhile. Only after you denied him all of his three options, did he say he wouldn't pay you ( but in fact said he'd still supply the geckos when they're available).

Crappy things happen, and I can pretty much 100% guarantee most people would have spent the money even if the geckos had not arrived alive and well yet. Things come about that need to be paid for, and when you've never had an animal arrive to a customer dead, why assume it will happen this time?

As I stated earlier, I can't necessarily say I would have done everything exactly the same, but I would also have hoped that the purchaser would have been a little more willing to work something out, given the circumstances, and given the amount of money that was involved.

Steve, I'm sure in the long run you will get the geckos you were originally looking for ( or possibly money, if that's what you really want, as it seems right now). I just really dislike when things seem to get blown out of proportion before the time is really needed. Jason is not a shady guy, and he is a good guy to work with, I personally think you should have given him a little more time, and try to be a bit more flexible.

I think Jason is at fault, and I would imagine he knows it too which is why he offered a few things to try to finish the sale. Sometimes you just have to realize that s**t happens, and you've got to try to work things out, even if it's not what you really wanted.
I'm trying to stay as neutral as possible, and just point out a few things from my perspective.

Actually three offers were made, all of which had stipulations.

1) Money back: When Jason can scrape it together to send.
2) Geckos of equal value: When Jason can scrape them together to send.
3) Some other geckos that were not what the customer wanted to purchase.

These are all good offers for Jason, but not so good for the customer, who's money Jason already spent and who doesn't have what he paid for due to Jason's screw-up with shipping. Why should he have to wait until Jason has the money to pay him back; he shouldn't have spent it to begin with as it wasn't his to spend.

The fact that you cannot see how wrong this is and continue to defend Jason's actions are a mystery. :shrug01:
 
Steve is also out all the time he would have had to breed animals he now doesn't have which will affect his income. Jason is to blame for this.

There really is no way that jason should have any slack on this deal, he screwed it up royally when he spent money before he had a satisfied customer. Maybe he should sell whatever he bought and whatever else he has to make up the money he owes Steve instead of making Steve wait on vague promises.

I fully understand all points being made. I infact, am probably one of the easiest people to do business with on the face of the planet. I'm understanding, and realize s**t happens. Sometimes you have to go out of your way to make things work. Maybe it is this reason that I understand both circumstances both the buyer and seller are facing.
If I were in Jason's position, I would have offered the exact same offers to Steve.... To me a live animal guarantee does not mean you get your money back if the animals do not arrive alive, it means you get equal replacements. If, and only if there are not equal replacements available, should a refund be given ( which is the case here, or likely 6 months from now animals will be available). A refund was offered in what I consider a timely manner to accumulate the refund, and it was denied.

If I were in Steve's position, I would certainly want the animals I paid for, or a refund. A refund originally was offered, and was denied by Steve ( due to the time it would take to receive). Well what does that leave??? animals that were paid for.

My main point here being that bringing this dispute here will help neither Steve or Jason get what they want any faster. Jason wants to finish the deal by supplying the animals that were sold. Steve wants his money back, which will not be any faster by bringing this thread here( the only thing he will benefit here, is putting out a bad name for Jason, which I don't agree with at this time). Steve was offered his money back, just over time.

Jason is not a scam artist. If he'd scammed someone, or just straight up denied Steve any form of payment, or replacement animals from the start, this would be a completely different story in my eyes.

I honestly do not know how to make this any clearer. Jason offered to send the money over a 2-month period, I told him I didn’t feel this was an adequate time frame to return my money HOWEVER if this is all he could do I wanted exact dates. It is not unreasonable to want a repayment system established, and one can only do this if exact dates are put down in writing.

“So what you are telling me I(s) you want to send me $1200 today, $1000 February 1st and the remaining $1000 March 1st? - e-mail from myself to Jason on 02/02/07

The very next e-mail from Jason is where he states he has talked to a lawyer and is going to take a risk by not repaying me the money. No…Money…Is…being…. offered…. The only offer at this point is to give hatchlings “when they become available.” If I wait over half a year and Jason decides he doesn’t want to pay up, it is now too late to file claims with the appropriate authorities and I am out the money. A lot can happen in 6 months. The breeders may not lay viable eggs, the breeders may come down with something and die, an incubator could fail, more money problems could come up and the breeders are sold, etc, etc, etc.

A person-selling reptile for a living should be held to the same standards as any business. If I buy an item from Best-Buy and it is broken upon delivery I can exchange it for something else or I receive a refund. It is that simple. I do not have to wait 7 months for the item to be restocked. This goes for every single legitimate business.

It is also not appropriate to spend someone’s money before you deliver a product because until that produce is delivered the money belongs to the seller. Jason gambled with my money and he had no right to do so.

Lastly, read Jason’s last e-mail to me and you will understand why I did not wait until Friday to post this.

Marcus has informed me that Jason plans to make a reasonable offer at some point today. If Jason contacts me and comes through with the offer I will have no problem letting everyone know that he has made good on this deal.

We can agree to disagree on the rest of your post, I'm not interested in trying to change your mind.

That being said; in regards to the quoted sentence, while it may not help Steve or Jason get what they want this thread will serve a higher purpose.

It brings the situation to public light and gives other consumers important information to take into consideration before doing business with Jason and possibly avoiding a similar situation. That, in my opinion, is the best thing that will come out of this thread.

Steve, your points are very clear.

I hope you get what you want out of the deal, and are able to get your diversified group of G. orientalis when they're available.

I guess I hadn't realized that you were willing to accept any type of payment plan ( not clarified in the emails) which was the main thing I was having trouble letting go.

I hope to hear what the final conclusion is later, and that you both get what you want out of the deal.
 
I believe that Jason commited a majorly big error in spending the money before the deal was done and the customer was satisfied, but I also believe that being young and starting a new business, that he will make good on this deal and has learned a huge lesson and it will NEVER happen again. I guess I have faith in young people trying to make a future for themselves in this industry.

There is absolutly NOTHING to dispute here..

Jason shipped animals to the wrong address without heat packs, the animals died in transit and cannot be replaced!!

JASON is 100% WRONG and Steve deserves a FULL REFUND!!

What is left to discuss??

There was no need for Jason to consult a lawyer... And, if this lawyer had any sense at all he would have told jason to return Steve's money.

Like i said earlier.. Jason, you should dig deep into your pockets to get this money back to steve. Do whatever you have to do to make this right, borrow from mom, sis, bro, friend, bank and refund Steve's money TODAY.

Based on a few e-mails and a phone conversation that took place today, Jason has made it apparent he is willing to work with me in order to rectify this deal gone wrong. Jason and I have come to an agreement on a suitable replace for the dead orrientalis. These animals will be shipped on Monday, for Tuesday delivery. I will let everyone know when the animals arrive on Tuesday.

I have stayed out of this long enough to clear it up.

I have been in contact with steve and the other two people involved since the day this went awry, they are quite happy with their purchases. I was the individual who contacted steve to let him know that the package he was to recieve had been mixed up with the package received in NYC. Stepping up to the BOI and other agencies as he had was not a necessary move as I have kept in contact with Steve almost daily since this began. The shipping error was freak and I notified steve of this before he received anything while he was at work the day he was expecting the animals. If I was truly out to make the situation terrible, I would not have done that and kept back. however, I did it.

A lot of what is seen in the emails we passed back and forth after monday were reactionary to each other's statements. My final email to him regarding no refunds, replacements only was based off a phone conversation we had in which I had been threatened with a law suit and a tarnished name while trying to make good on the deal but yet had been told he still would buy the animals from me down the line if it all panned out. Given that we had a pitfall in communication, my reaction was gutteral and harsh but after being reamed rather roughly there, I saw it justified. At this point I had contacted my lawyer to see what option was available. I have never demanded a payment from steve outside of my request for a 50% deposit on this previous deal. I had no issues with taking payments from him as time allowed because our previous transaction in october/novermber was so smooth. What vendor in our community would take payments over time as I had done? In all of our emails prior to this week there was no inclination that I would not have attended to him appropriately.

I am disappointed that this had occurred. It is unfortunate that no one here has done business with me besides Andrew and Steve but everyone else can comment on how I am a bad business man. Honestly, how many of you have heard of me or know what I keep or sell? Or that I am starting a business? I assume none of you knew that. that is sad, roast someone without even knowing them... what kind of reputable people do that? It is also sad that none of my deals that have been positive have been noted on this. It would be nice to hear about the first pair of orrientalis I sold to steve as they were the first sold in the US.

We have all made mistakes but it takes a man to accept them. I have off this forum where it was necessary to. For everyone that has nailed me, I hope you are all the saints you make yourselves out to be.

This was a matter steve and I could have settled without the BOI and should have been kept that way.

wow i kept quiet this whole time but oh my god dude stop talking. i agree 100% this tread should not have needed to exist, you should have refunded him his money as soon as he requested it. who cares if your buisness went under you made a catastrophic error then made a series of errors.

yes we all make mistakes and hopefully learn from them you didnt because the first time you went on the right track at the start(paying some money back) but then offered him unacceptable terms(animals he did not want,and animals he would have to wait for you to raise to acceptable an age) then when he(rightfully) refused them you made another mistake(3rd) by saying blah-blah fancy lawyer bs i probably tried to look up on google blah-blah i wont pay you back period. after you said that I would of had you in court so fast it would have made both our heads spin and you would of been out a buisness and both our court fees. He instead posted on here hopeing that you would realise this would hurt your "blooming" buisness and it obviously worked, but to my upmost suprise he is trusting you again! trusting you again after 3 failed chances he still trusting you. i respect this guy so much i wish i had a fraction of his trust!

LoL i agree it does take a man do accept his mistake. then why didnt you just refund him his money? ohh you are starting a buisness and that gives you the right to fix your problems at your leisure. you expect leway because YOU let him pay overtime? that is like puting stuff on layaway at a store canceling and them saying we will pay you back when we can because we used your money to buy more stuff to sell.

its called layaway. most sellers will take deposits if you pay half upfront and they will ship when everything is paid.

where-o-where did you learn your buisness ethics? "well its not industry policie" is a bunch of bs i may not run a "big" buisness but if i ship somthing overnight its normal to have live arrival guarantee i do not even type it anymore because its the norm.

no heat pack...cold temperatures...enough said...

i never felt at any point he strong armed you but i did feel like you were trying to manipulate him into accepting an unfair resolution by trying to give him the impression the law would back you up.

it may not matter to you but you could refund his money, give him replacement animals, and reimburse him for all his supplys i will not do buisness with someone who makes so many poor choices on one incident and uses so many poor excuses.

i am glad you came here and posted a response. I'll just say crap happens but in this situation the responsability falls on you. If Steve is/was unhappy with your offers to make things right you cant blame him. Also many people in this industry do accept payments and work with people.

Just glad you two came to an arrangement and i hope everything works out for :)

Jason, I guess your buyers are supposed to be mind readers. Your last correspondence with Steve was that you weren't really going to do anything. Evidently he was supposed to know that you were speaking only "gutteraly" and didn't really mean it.

If I had sent someone $3000 plus, and didn't get what I paid for, only to be told that I couldn't have my money back right now because "I spent it", you better believe the guy would hear a piece of my mind.

One suggestion: If you're going to quote "industry standards" you should at least take some time to learn what they are.

As far as judging you without "really" knowing you, it's easy. You screwed up and don't want to take responsibility for it. Now I know you.

that this whole episode can be construed as a lack of business maturity and just not having the proper guidance when a problem occurs. It obvious that Jason was attempting to build a defence on a house of cards, but at the same time, If he were intent on on ripping Steve off, he never would have sent him the $ 1,200. So as it stands, the object is to get the balance back to Steve as quickly as possible.

If Jason is incapable of making one complete refund, then some schedule has to be forthcoming to show some good faith on Jasons part. I am sure a friendly conclusion can come out of this.

We just have to let calm heads pervade. As much as Steve my object, if Jason is willing to work out a payback method, then so be it. Just as long as its not unreasonable in its amount nor in its time schedule.

Let us not forget that this site is loaded with graveyards of losers who never paid back a cent. I do not consider Jason in that catagory, just slightly misguided and hopefully will realign himself to do the right thing.
