In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Jason Perillo, Very good guy ( Protean imports)

thanks Gino,

and you know the funny thing is had Jason, after he received the first shipment of flies (and their were 2) had he called, and our # is toll free, and explained his displeasure, or wanted the flies shipped differently, and had he acted llike a gentleman, It would have been nothing for me to accommodate him.

We maintain an inventory of a half a million flies. So to ship Jason some extra cultures to make him happy would not have been a problem.

But when we received his email, and the way it was suggested that we owed him money and that he wanted more flies, really infuriated me, because he never once called and it was not until after he received the 2nd shipment (10 days later)that we were advised that he was dissatsfied. Prior to that I thought we fulfilled our oblligation to him, and that everything was fine.

Even had he indicated that he had DOA's , I would have taken care of it.

The problem was apparent. He used the flies to quickly, ran out and was unable to feed his frogs, became upset, and then demanded more flies from us or a refund !.

Mind you this was not a cash transaction. It was on a barter. We traded fruitflies for 2 lizards. That was it. No cash. Now he is insisting that we owe him money. We shipped him almost 5000 fruitflies, and within 10 days, he was already asking , demanding, more and that we ripped him off. Each shipment was sent express mail for next day delivery. Each shipment of flies were packed the day before to insure freshness, and each shipment contained 24 vials of flies, that I know arrived alive and well.

I know from my own experience that if their is a dispute, their is a right way to handle it. It would have been nothing for me to instruct my people to send out additonal cultures to Jason, and that would have been the end of that.
I have done it in the past, and I am sure I will be doing it in the future. Its all part of conducting business. It can only benefit me!

Jason failed on all accounts. He had simialr troubles with Steven Hoch. Jason is an immature 24 year old who thinks he can bully his way into getting what he wants, or creating his TOS that favors a non refundable (no returns , no exceptions) position even if its (Jasons) own fault. Like sending the box to the wrong state (NY instead of So Carolina.)

Several thousand dollars worth of expensive geckos. Instead of doing the right thing, he flexes his TOS, no refunds , no exceptions, and at first refuses to give Steven a refund. What Jason wanted was to have the shipment then sent from NY to So. Carolina,( and who knows what conditon the geckos woud have arrived in . the weather in the East was cold and as far as Steven was concerned the geckos could have been DOA) and had any of the geckos died, Well no refunds, no exceptions, and DOA's will be replaced if and when they become available!

This would have worked out fine for Jason. Until Steven brought to the BOI, and enough pressure was put upon Jason to give a full refund.

I dont know why I keep on replying. I feel like a broken record. Thanks again Gino, and I really hope this time I can put this to rest.

I meant what I said about hoping Jason works things out in his own head, because I sincerely believe he is his own worst enemy.

I promise no more replys. I need a vacation.

For someone who has inquired about me twice with positive feedback, you certainly are talking a lot about a sale that did not include you. How about sticking to the topics that involve you, such as failure to finalize you own dealings. If anyone really pays attention to the details of this, they should notice in my posted email from you the threat to call the IRS, why would a respectable person such as yourself do such a thing? I see no reason as my finances do not include you, nor do my dealings with steve. Steve is a big boy, he can fight his own battles. Do you feel to be a police officer of the internet as well? Have you inquired with the FBI to become an internet fraud specialist? I would think someone with your stature and maturity would know better than to try to attack my financial status.

I know you will respond, you are mature enough to keep talking. At this point, my goal is to keep you talking until you have ratted yourself out.

Also, jerry this was a good guy topic. you should be posting in the other thread if you have negative to say. keep to the topics at hand sir.

For anyone else:
Jasons animals are healthy and great looking specimens.Ive seen some of them first hand.Hes very knowledge able man.And all about the business.
Ide buy from you any Day Jason.Despite what these people say!
Best of luck,
Jeff

Jerry, you are ignoring my questions, so I will re-phrase and try again.

Did you or did you not tell Jason eggs were dropped into the media to increase initial production?
If so, how do you collect the eggs?
How is that more efficient and cost effective than adding more flies?

Between the threats and what I am viewing as a blatant lie (collecting Drosophila eggs) I find it funny, Jerry, that you can bad mouth Jason's business practices whereas yours are sounding more and more questionable.

Subject: JUST A CLARIFICATION
If you were paying cash, if you were buying with money, then the catalogue prices apply.

. We have nothing to hide. These prices have been in our catalogue for many years. As you can see, if you purchase different amounts of cultures, the prices will be reflected accordingly. We offer these cultures for sale, not for barter. . That is why I sent you the note, hoping that if additional flies were needed, they could be purchased at the $ 3.00 price in 24 lots.

Now Jason, I said purchased! I do not want to argue about the note. It was sent in good faith moreso because I did not hear from you after several emails. I to have all the copies of emails that we sent you before and after the first and 2nd shipment.

So as not to confuse the issue. We shipped you fresh cultures which you seem to have a problem with. You were expecting cultures that already were started.

We have never shipped what we consider old cultures or cultures that have already been started. These cultures or what you may have been looking for are cultures that have to be a least 10 to 15 days old in order to be "started cultures" we dont operate that way. Never have. I cannot speak for other vendors that you may have purchased from, but we dont operate that way.

All the cultures that leave our facility are made the night before and are clean. From mites, mold, bacteria, etc. With an established culture that may be 10 to 15 days old , can present a real problem to existing cultures in the purchasers possession. . I would never send you "established cultures or old cultures" We just don't do it.
You must understand that ! I never made any promise to send flies that way to you. No mention was made as to how you were to receive the cultures. We shipped you the way we would ship anyone. Our packers have no idea who these vials go to. They just create the cultures, and its moved to our shipping dept.

The reason why we decided to ship 24 per carton instead of 25 had nothing to due with attempting to short change you or our agreement. I ordered an overcount on the vials, and the Styrofoam box holds 24 comfortably. Their was nothing sinister about the shipments. You know we packed everything properly, and the first shipment was received on the 12th of March, and it was shipped on the 9th. Monday. You received the same amount of flies just short 1 vial.
We don't short change people on fruitflies. As a matter of fact , we have a substantial inventory, so their is no need for us to resort to that kind of unnecessary business behavior.

I am somewhat sympathetic with your dilemma, but when you received the first batch of flies , I am assuming that you did not set up any cultures for a future use. And maybe that is where the problem lies. You never contacted us until the 22 of March indicating that you felt their was a problem.

This was already after the second shipment. And almost 10 days after receiving the first shipment. Both shipments were tracked because we paid extra for it, so we have the dates when you received them.
I also have all the emails that we sent you indicating that we have not heard from you acknowledging anything from our first shipment ! But we did send you more than one email, and I wanted to make sure that everything arrived satisfactorily .

Had you contacted me if you felt their was a problem, or you wanted to change certain options, I would not have objected at all. But when you sent me the email dated March 22, complaining about your displeasure, I find that a bit self serving after your first email dated before the 9th of March.

To complicate matters, since this was not a cash transaction, I do not have to use our catalogue as a reference point for a trade. I sent you almost 5,000 Melanogasters. At least several thousand in the first shipment. What happened to those flies? Within 10 days you were out of food! Forget about the barter, it does not make sense. We are dealing with a food item. Not something that sits on a shelf. Now you want more, because now you feel we did not live up to our bargain because of our catalogue prices. Jason, our living materials are offered for sale for money. When 2 people barter, the price goes out the window. Just as long as both parties are happy with what they wanted. Thats what bartering is all about.

Had you wanted $ 500.00 for the 2 Elok geckos, as a cash transaction, it would not be worth it.

But to barter, it is , As far as I am concerned I gave you $ 400 worth of flies as a barter for the 2 geckos. Whether you like the deal or seem to be upset because you now need more flies, is unfortunate. But not my doing.

I would have shipped the flies out sooner to you, had you requested them. Maybe if your cultures had been set up earlier, you would have been prepared better. I dont know. But I do know this much, I just felt that we have reached a point in this diatribe to bring this to conclusion. I have no intention of providing anything more that I have already shipped you. It just may be to your advantage as I have stated earlier to just move on. To belabor the issue will resolve nothing. Their is nothing more for me to say on the matter. If you feel its necessary, then consider getting an attorney and sue. This was not a cash transaction, . I did not misrepresent anything when I made the agreement with you. I think you just read into it a bit more than what actually transpired, and your unhappy about it. Its perfectly understandable. Your own stubbornness will be your biggest enemy. JERRY TRESSER

Jerry,

I am glad you have received the eloks in great condition but I have an issue with our deal. I supplied you with $400 in animals. You have supplied me with $144 in fruit flies. When we had spoken you had offered 50 cultures of established flies in trade value. First, you have only supplied 48 cultures not 50 cultures, and second, these cultures are not established which means I have nothing to feed the animals they were purchased for. Seeing how you have not honored the terms of our agreement, I request my animals returned to me immediately or my remaining credit, $256.00, paid in full with established cultures. I have scanned and attached the letter you enclosed in the second container of fruitflies, so the value per culture is shown.

Also, to attend to the statement regarding emails you have sent to me, You are either not emailing to my correct address or you are not emailing me at all. But seeing every time I email you, you have called me back by telephone with in moments of receiving my emails. I have been using this email account for several years and have not had issues with emails in the past, every email I send out has record of being sent as well as being received. To test the theory that I have not been receiving emails, I have made several attempts from my two other accounts today and no email I sent myself has not been delivered. You can try emailing me again at [email protected]. I believe if you click the hyper link, the blue letting, you should be able to email me immediately, that or you can click on reply. Be sure to check your sent files and make sure your emails have been getting sent. In any event, you still have not honored the terms of our agreement and have $256.00 dollars in credit to send me, or return my animals and i will return the fruit flies.

If this email is not answered, I will continue sending it daily until it is.

Regards
Jason P

These are the emails i was supposedly sent but never received. Note pricing structure is changed to fit the situation rather than the pricing that is on his advertised website. Keep in mind, in a court of law it is illegal to change pricing to fit a situation without prior knowledge and agreement from both parties. I never agreed to such a price change.

As misrepresented as it comes, read the letter and see for yourself, it is attached as a file to this email. It does not specify barter or purchase. It still sits in my scanner if you would like me to scan it one more time.

Also, attached is your response to my emails via Geckosunlimited.com/forum. I've also taken liberty to print out copies of each email we exchange, I've got records of it all at this point. And I have printed out the advertisement you agreed to. So again, you agreed to 200.00 per animal.

BTW, I have also forwarded this to your first email account so you see that I am sending them. Sadly, If I am capable of sending emails to you, it should be apparent, you have issues sending emails to me. Also considering, I responded to the email marcus forwarded to me from you. Well, Jerry.... use logic to decipher that one. Intelligence comes in handy when looking a commonalities.

50 established cultures jerry, not 48 fresh cultures. And not a fly has been removed from any of them as stated in previous emails.

Jason P

I can keep going. You are just giving me more ammunition for my case.

> In a bartering situation, you were charged a retail price of $8.00 per culture or $384.00 worth of cultures which were freshly made in each shipment. This was not a cash transaction, so when you charged us $ 200. for each Elok , which was being offered for $ 150.00 in cash on the open market , we felt that it was more than fair on a barter. If cash would have been involved then that would have been a different story. It was for that reason, we offered the vials at $ 3.00/ea which is wholesale price if you were interested in purchasing them in the quantity that was offered in my note to you. .When you add the shipping, we owe you nothing, and met our obligation. I don't have to provide you with wholesale prices on a barter and then have you overcharge me in return.!
>
> Theirs nothing wrong or unethical about that . We both received what we had asked for without payment of cash, and now you are claiming fowl! This was a barter transaction in lieu of cash on a retail deal.
>
> Those cultures were set up so that they would provide additional flies because eggs were dropped in the medium that was included in each vial. When something like this occurs, its usually because you are using the flies faster than they can breed. Basically feeding your stock away. We sent you 24 cultures a week before you even had the frogs, and it was your obligation at that point to set up additional cultures. Apparently you did not! That is not our responsibility. .
>
> Your request has been declined. We fulfilled our obligation of the $ 400 by barter and as you are very well aware, we shipped you those orders as you requested. Sorry we cannot be of any other help in this matter. I hope you receive this email. JERRY
> PS. had we sent the 50 cultures it would have gone over the bartered amount. Secondly that note that we included in the box was an offer for you to purchase not barter for additional cultures at the wholesale price providing that you met the minimum quantity. Please do not misinterpret the note we included. It specifically related to cash sales.

I purposely offered to split the shipment so that you could set up your own cultures and gain additional flies from the cultures that we set up for you.

I sent you several prior to that asking when we could ship the flies, and when we finally did, you never even responded to or acknowledged that you received them at all. That is why we added tracking to each package, and that is why I added a note. I was genuinely concerned.

The terms of service that you provided with the ad just provides additional fuel as to you being a very unhappy , confused person. I would not go through all the trouble of attempting to contact you by a variety of different addresses. It really does not matter just as long as you receive this one. I have sent you 2 copies of emails with the dates on them so that you can visually see either you are feigning about not receiving the emails or their may be something drastically wrong with your service provider. But now you have my response, and its over with one exception.

If I find out that you intend on pursuing this I would caution you as an individual who may have more to loose than to gain. Selling materials whether live or not and getting monies through Paypal provides income that may not be reported as an individual. I am sure the IRS would not look at this as an error on your part for not reporting unaccounted income as an individual. But its your call. Secondly, if it becomes necessary, we are a legal business in the state of Fl. and we have attorney's on retainer that can handle these situations if it becomes necessary. We have sued individuals in the past and as much as I would NOT like to cause you any additonal out of pocket expense, .............dont tempt me to follow through, if it becomes necessary.. You can save this email as well. As this will be my final communication. My suggestion to you would be to get on with your chaotic life. Try to improve on your immaturity, and go to Supreme for flies , because the doors are closed here.!!!

And the final email I sent to Jerry. I have had no communication with him since the start of these threads. IF I'm the magical self righteous immature misguided little boy who is angry with the world, why am I not changing my position. Jerry you owe me the flies. I didn't go to the BOI as he stopped emailing me with this email. I had gone to the Pasadena CA police regarding the matter but they informed me it was a civil suit. Rather than take the time and hassle to go after jerry I left it at this since we the geckos came to me as a gift and the monies lost weren't worth the trouble. Now that this has occurred, I am going after what I am owed. Jerry, you put me here and now I'll finish what you started. we will see how my lawyer deals with this and if you don't pay up, I'll go after you with collections. I have every right to as you have the geckos and I have nothing but dead vials of poorly bred flies.

I hope this makes it through clearly...‎

Jerry,

'I think as I mentioned we pay taxes and declare business profits and incomes derived from our sales. We are a legal business in the state of Florida. We have a federal tax ID # , a business bank account and monies are accounted for . I dont believe this is the case with you. I find that reprehensible and I may do something about it if this harrassment continues I dont see the equality in you being able to run a business without declaring income. That really is a thorn in my side with individuals who seem to run basement businesses without have a legal business. Avoiding corp filing, and permits as well as state and federal taxes. That includes unreported income. I have made copies of your items for sale on Kingsnake as well as Geckophile. Lets see if you can squirm your way out of paypal paying you to your personal checking account and lets see if priors sales have been reported from paypal as well as other sources. The IRS makes it a life long ambition to go after smart people like yourself . I have no objections in helping them rid the likes of you with some stiff penalties and allot explanation that will keep you in hot water for years to come. '

Simple and straight forward, I could not import live animals commercially without a business license because it goes against USFWS policies and I can not operate in the state of california as a business without a business license. I have a warehouse at Los Angeles International Airport and a business license through Inglewood, CA 90303 as well as a USFWS Commercial Import/Export license in my personal name, also a federal tax ID number, company bank account, and I hold 3 DBA's as well. Oh and lets not forget my paypal account. NO animal is traded via my warehouse as there have been several reptile collection thefts (Bob Clark, Snakekeeper.com, East Bay Vivarium, Peter Khal, Nicole Riley, etc etc). My personal address is put on each box because if there is a theft they will have to break through several security gates, then into my home which has a burgler alarm, then meet my dog (australian sheppard) and then my boyfriend and me.

You failed to provide as our terms of the barter. Continue threatening me with the IRS and I will forward all this on to my lawyer by Monday March 26, 2007. I can contact the IRS just as fast as you can and let them know you are attempting to push me in a corner and I can go to the Police just as fast because this is a crime - its called extortion. And honestly, extortion holds worse sentence than tax evation. Note - the tax season isn't over yet for year 2006.

As copied and pasted directly from your website: Dated Jan 07 prices

MELANOGASTER AND OR HYDEI VIALS 2 CULTURE MINIMUM $ 6.00/EA

12 LOT $ 4.00/EA, 24 LOT $ 3.00 EA. MAP ACCOUNTS $ 3.00

Maybe you should take a better look at your pricing before stating your price at 8.00/per culture because no where on the page is 8.00 mentioned anywhere. Based on that information above.... you actually owe me an additional 83 cultures as you do not specify Wholesale or retail in the price shown so the correct assumption is retail pricing. As it reads, 24 lot $3.00 each culture. Now that is not manipulated wording, that is very very very clear as it is taken directly from your website. 50 established cultures seems like a lot less than what you have offered for $400 in credit in quantity based on the numbers I read from above.

Oh, and lastly.... I would have attached my import license and my business license... but I don't trust you to actually do anything good with it, so here's a copy of a seller's permit which you need a business license to get as well as a DBA. Also note, address and CA tax id number is smudged out as you do not need to see that information.

So Jerry, I guess you are wrong again.

Your move Jerry. As stated above, 2006 tax season isn't over yet.

So... flies or police. flies or lawyer. Flies or BBB. Or better yet, flies or this goes to the BOI. Each record I have will indicate the situation clearly as I have not done anything out of my character or asked for anything unreasonable. Add to that, I sent the animals nearly 1.5 months before receiving anything from you outside of the email you forwarded to me about the credit I received. I even put you in contact with another seller of Cyrtodactylus elok from whom you purchased 4 animals from at a discounted rate because of quantity.

All I want is the established cultures you agreed to provide for the 0.2 C.elok I provided you with. Which was at a price of $400 credit to me for providing the animals that you never complained about. Subtracting what you have provided already, I have a $244.00 credit. You can make it 50 Established cultures or 83 fresh cultures. This sir, is fair and honest.

Regards,
Jason P

In these vials, how is one supposed to produce enough flies to feed 750 frogs? In all truthfulness, do you honestly believe there were enough flies to feed 20 frogs? Look at their size. they are tiny. Granted I am going off photos taken when you failed to provide for me, nothing was removed from the cultures because there wasn't enough flies to feed one frog in each vial. Your word is not good enough for any kind of voucher. I had to remind you to send me the flies. I reminded you! Then you actually called 5 minutes after the second email I sent you to discuss the matter. and even then, you did not confirm our phone conversation in email format as I requested. I emailed that to you. Attack me all you want, but your on here now. you opened the can of worms that put this on your name now. so when people look for me, they will find you too. And you can bet I will be opening a thread on here about you next. thanks Jerry I'll get off my soap box now since my claims against you actually are legitimate.

I just thought I should revive this thread to make everyone here aware that I no longer back Jason Perillo or anything he is a part of. I'm not interested in laying out all of the details here, but let's say the warnings of others on this site should be heeded.
I personally feel like I've been screwed over by Jason, and have several friends that I at one point referred to him that got shafted as well.

My public apologies to Jerry and anyone else in this thread that I may have offended or insulted in some way.

Your apologies accepted

The animal business is a tough one. the food end is just as trying. Had Jason acted like a gentleman, it would have been nothing for us to acommodate him rather then see some negative feedback.. Unfortuantely , Jason is a problem. Not related to the herb business, just a very poor businessman where deceitfulness seems to be an easier path... JERRY
