I appreciate your posting and like I said in my email, I really understand your position and I do think you are a very qualified and skilled venomous keeper. I understand how the mamba might look different, but honestly it was the same snake sent. My only guess to this is that maybe the picture did not accurately represent it's size, as sometimes things can look differently from a photo. Anyone who scans the classifieds can attest to that. I have seen snakes look to be great size, but in actuality they are not that big. A photo can only show so much and alot of that depends on how the photo was taken. I am not out to scam anyone, these snakes were not for resell, they were for a private collection. I personally am not fond of mambas, they really aren't my thing. So I really would have no use to scam anyone for one, I personally don't feel comfortable working with them. Over all, I just hope that this situation is taking care of. Once again, I really appreciate Mardi's post, it was well spoken and very unbiased.

Stardust, I was just wondering what you meant by your last post. I dont mean this in a negative way or anything I honestly was just a little confused. Are you saying that you think Ken might have switched out the mamba's after Mardi ( Who also stated Ken has no experience with venomous ) bagged them for him? I am not questioning your statement at all if that is what it was. The only reason I ask is because I have dealt with some venomous and had to help a friend round up a medium sized Mamba this year, and I can say that I believe it to be highly unlikely that someone with no venomous experience would try handling multiple Mamba's in and out of bags. They are wickedly quick and unpredictable snakes. In my limited experience anyway.
I am not saying Ken is a good guy by any means ( I have read of all the other wrongs he has done to many other people ) But it sounds as if Mardi basically reinterated everything Ken had said. Just stateing my observations. Thanks.

P.S. Wouldnt the "No live arrival guarentee" Only apply if they were packaged correctly? I have shipped out several "High Dollar" Hypo Boa's recently and I live in Ohio, it is wicked cold up here. And I can say without a doubt that if packaged correctly the snakes do just fine. I have sent out 4 snakes this week, to a couple people here on fauna, and the low's have been in the 20's, and they all showed up fine.

This has been a learning experience...

I have personally learned alot from this:

1. Threads can grow exponentially while I sleep;

2. Airlines don't treat reptiles with the same consideration they treat other live animals during shipment;

3. The BOI works, but sometimes not as quickly as one would hope. (Kevin, after that first thread on Ken Yates, why oh why did you risk it??)

4. Retirement from all business ventures is the best place for Ken.

There are still a LOT of unanswered questions in my mind, but I don't think they'll ever be answered. I hope that Kevin and Ken *do* talk today, and that the matter is resolved to both parties' satisfaction.

Mostly, I hope we never hear of Ken Yates being involved with reptiles again.

There is a difference between happy and content

but, i am retiring next month and looking foward to it. i believe this bOI is bias and does not look at that facts as a whole.

There is also a difference in retiring and not being able to work due to reputation. Humans are creatures of habit , meaning that if you are comfortable doing something you continue to do so and dont like to change.

i will pay EVERYONE BACK in all my companies that i MAY owe and retire.

One thing in all this mess stands out more for me.
It makes absolutely no difference whatsoever if Kevin did or did not agree to a no live arrival guarantee.
Ken displayed complete negligence with the packing of those snakes. He willfully shipped them in a manner that could not ensure their safety. For this reason the deaths of those snakes are fully his responsibility and he should bear the burden of his actions by refunding the value of the animals that died. Not that I actually think moral responsibility will have any bearing at all on his actions.
Had they been packed properly and for some reason died, then an agreement to that guarantee would have meant something, but not in this case.
I no live arrival guarantee assumes that the shipper will not do anything intentionally to endanger the snakes, and Ken most certainly packed those snakes improperly and in my opinion is the sole cause of their death.

I suppose this stands out with me because one of my biggest annoyances is complete stupidity with shipping. If it can't be done properly don't do it. We are seeing more and more people half ass packing reptiles and there is no excuse for it at all.
1/4" insulation and pocket warmers simply do not cut it, and any person with even the smallest shred of common sense would realize this.

Good point Alan, I had forgotten the crappy job on the shipping when I mentioned that if they had a no live arrival agreement then this was done. kennyboy pretty much assured that there would be death involved with his packaging.

Mike, it would not surprise me if kennyboy took a bag or two of hot snakes and sold them to someone else or just plain lost track of them and did not get them into the boxes. It's very easy for someone, even someone as incompetant as kennyboy, to move a hot snake that is already in a bag.

So kennyboy, you gonna post that contract, oops, I mean have one of your "staff" post it for you so we can see what it is you have referred to several time? It seems to me that you owe Kevin for the snakes that died as well as the ones he paid for and did not get.

You know kennyboy, if you do still have any of those puffs I would really like a picture of you kissing one of those. It would be great for a scrapbook or an obituary. Either way it's all good.

Especially after the last fiasco! However, I have to admit you handled this well. It was also very gracious of you to simply make an offer to settle this. I have to agree that even IF you accepted the terms of "no live arrival guarantee" all efforts should have been made to ensure proper shipping and packing. Ken, it was a sizable deal. Simply refunding for the three green mambas should not be a problem. Plain and simply they were improperly packed. In the last thread Kevin was on I suggested that he bring up solid proof and refrain from name calling. I see that he has followed through with that in this thread. If you followed these same "intelligent" guidelines maybe people would have a little more respect for you. I wish every time someone was rude to me that I could use it as an excuse not to pay them. Work on that mind body thing! As i'm sure you know people (You especially) get emotional about these issues. Use logic in your cases and you will always win. Or... simply say you were wrong, apologize and go on! Even Kevin figured it wasn't worth the argument and said forget the black. Anyway... I don't want to just repeat what everyone else has already covered. Kevin made his case and on the one item that was still in question he backed off. Ok... all of us "evil children" have to go play!!!!

One thing that does stand out in this to me anyway is Mardi said the black mamba he packed was about half the size of the dead one shown. Now if it is in anyway conclusive that Ken switched some of the snakes then that would explain that, but since it is only speculation at this point that leaves open to question everything else Kevin claimed. But nothing can deter the simple fact they were indeed packaged improperly. Wow, what a mess.

I believe that Mardi said he packed the snakes but didn't state how he bagged them. Whether there were more than one snake to a bag or individual bagging on some or all the snakes.
I know ken is in trouble with the window company he has, he started elite reptiles with other people money from his other business. So with that knowledge, I would not put it past him, if the snakes were individually bagged that some may have went to another buyer???
I do not trust this person and would put nothing past him. I believe Mardi gave what he did, and I believe him. He seems upstanding. He did not say, however, how they were bagged. And after they were bagged we don't know.

This thread has served a valuable lesson. If you don't know who you are dealing with never, ever do business on phone calls alone. Everything should be spelled-out in writing via e-mails.

As for Mardi's post, in all honesty, far from clearing things out, it actually left me with more doubts.

What I failed to see anyone mention, possibly overlooked by me,(can happen while ROFL and while extiguishing the fires from the 'Really Really Bad Engrish to English' transator..) is the good possibility that Yates had a 7th or eighth box and shipped them to another buyer or even locally.

Anja, as I stated several times in other threads, appeared to be an intelligent young lady. It was based upon that cursory assessment that I encouraged her to begin updating her resume with a view toward new employment. Hopefully, she heeded that advice . . .

I will say this, if you read all of this information available on the BOI (not what has been accused, mind you, but just the gobblety-gook that has proceeded from the "mind" of Ken Yates), and you STILL do business with this . . .individual, you are going to get exactly what you deserve. In my OPINION, he is either a full-fledged scammer or one of the most idiotic people I have ever had described to me! Regardless of which is actually true, would you really like to do business with either?!?!?

The fact that this mental midget even had ACCESS to those hots is a terrifying prospect, in my estimation! Ken, I cannot tell you how anxiously I await notice of your successful retirement!

I did ask about Anja probably 30 pages ago and Marti did answer to a degree that Kens employees who handled hots had left him. Now then I agree totally, and in reading what has turned into something that makes "War and Peace" look short, I have to say anyone who does business with Ken Y in any manner is crazy. I cant tell if he really believes his BS or is just spouting it trying to make the rest of us believe it.

I have to say that the sooner someone brings charges against him and makes him retire to the little room about 6 x 10 of concrete with three squares a day, and a drug crazed "friend" to take care of him, the better off we all will be. I get the feeling he doesnt look to what his next business will be he looks to see what the next scam oportunity is out there.
