UPDATE:

I just tracked the bank phone number down with some help. And believe me I am more upset more than ever as it seems this bank does everything backwards.....just like Mark.

After a long wait to get ahold of the bank manager she then goes by what the tellers says and does. The teller says she just filed the wire just minutes ago, it is now 2:12 pm my time it has to be close to that in Kansas. Yet again I get no confirmation numbers or codes not even from the manager. She then states it might take 3 days because it will sit at there corporate office....then follow the route like normal wires. It seems to me they are very secretive about giving me any real information after I state who I am. Its just a real backwards way of things they do down there.

The amount I am suppose to get will be what I quoted Mark days ago even after I told him make sure it is exact to Canadian no matter what the currency value is each day. Mark said he would here and in a chat but will he is a different thing because I believe it will be the old qoute. I want penny for penny what I paid Mark, will I get it - I doubt that.

MARK - you know you own me much more on the refund, you went to far now. People here see it and you owe me interest and percentage of the sale on that boa now as well. Was it all worth screwing your name up this bad Mark, maybe it was......lets see if the authorities think you have a chance in winning now. Run to the bank Mark correct the amount fast and do the rest on another wire while its still sitting there. Do the right thing and pay me the extra you own in interest and more, because even a full refund does not change your a better snake than anything in your collection.

I called my bank 2 more times since last said no money in yet.

That's a bank alright. I did a reverse lookup and got:

It's hard to imagine that a transfer that was arranged on Friday would not have been processed until this afternoon. I guess they do not put a high priority on these things. Unless of course it was actually arranged today (which is what I suspect).

Makes you wonder why this bank even does wire transfers you could send the money express mail and get it there faster! heck the way they seem to do things regular mail would be as quick.

Jim I think your right it wasn't started till today but can't understand the reason for the delay in the bank sending the money. If the money is in Marks account it should be instantly transfered to Tony's bank. Randy

Its Tuesday. The refund as promised has yet to arrive. And the local bank Mark supposedly used JUST started the wire according to Tonys phone call which means it was never sent.

Three words come to mind, but I'll use an acronym.

And btw.... I've lost track of the amount of wire transfers we have done in the past. Within the US, Overseas, Canada....

Most were sent and recieved all within an hour or two. The LONGEST I personally ever had funds in transit was a Wire from signapore which was sent during a US holiday so fuinds were received one business day later.

If Mark had sent it last week, it would have been completed first thing this morning at the latest.

Ok, I've been reading the thread since it started.. I talked to Mark for a while last night in ACC chat, he's a piece of work, I would never deal with him... But I also spoke with Tony in chat, and he seems to have the mentality of a 12yr old.. Mark owes Tony a refund and an apology, simple as that, but Tony, I think you're goin a overboard, demanding interest AND a percentage of the sale from that boa... Who do you think you are?? Everyone is on your side for THIS one, don't act childish and start pounding your chest.. Be glad you're getting a refund and walking away clean.... You've done a great job exposing Mark with this one, but you've exposed yourself as well... I know whenever I hear or see the name Tony Pharosx from Canada, I'll turn and run the other way.

My position as far as Mark owing this money was expressed in the first page of this thread. I still believe he owes Tony every penny he received, plain and simple. But now I’m pretty sure Mark is confused as to how much you pretend.

Right now from my perspective you are sounding a little bit over-demanding. You made a deal in American dollars and you demand it to be adjusted to-the-date to Canadian dollars. Where does it state that if the deal fell through Tony should pay in a different currency. Are you going to change the rules too? Then how different are your procedures from his? You now say he owes you more than the refund, you suggest interests, plus a percentage of a sale on that boa. What exactly are we talking about here? Furthermore you threaten now with legal action. You demand him to run to the bank and make all these adjustments, but you don’t give an approximate amount so there is no way Mark can make it right. Whatever money he sends your way it will not be the right amount. How could it be if now he doesn’t know what you want? You are claiming you are backed by the BOI’ers in all these new demands of yours. Well please exclude me. Yes, I still believe you are owed every penny you sent. But if you now demand substantially more that cannot be easily determined, let the law decide what is just and don’t try to manipulate all this now in your favor. Maybe I’m starting to see some of the things Chris was mentioning earlier in this thread. In all honesty I liked the other Tony better, the one that was rightfully so demanding what he had paid for. This new version of you wants it all. This new version of you is flirting dangerously with greed.

Tony, you know that Markcan only back out of this deal if you agree to the terms right? Until you agree to the terms, and a new contract is made, including the contract not to sell, that snake is still 75% yours.Well you agreed to the terms and accepted the date at which you would accept payment. HE dropped the ball AGAIN, voiding the agreement that you had with him about a refund. If you wanted to, you could simply send his money right back to him and fight for your snake.
He violated his own conditions by which he broke the contract, meaning that until you agree to new terms (by accepting payment at a later date) the first contract is still binding. Talk to your lawyer man, but I think you could just send the money back, and sue for your snake. Just a thought.

I don't want to put words in anybody's mouth, but this is what Tony said yesterday:

WOULD I BUY HER NOW – no and yes, No just because this situation is tarnished and who knows what will happen to the boa, what guarantee I get, since getting my boa at first and now the refund takes forever, where would a guarantee have any meaning at all after this situation. YES if there was a way I can trust things would work out and that boa would arrive without any complications

Anyone here want to make that guarantee? I think not. Not when we know what we do about Mark Miller.

I feel Tony is only owed the same amout that he paid, in U.S. dollars, not inflated to Canadian currency.
