Actually Scott sales are better now then they have ever been, not tootin my horn here, just stating the truth. Shipments ae going out nicley except for a troublesome ranco delay thats fixed now.. We are also about half and half between UPS and USPS, like I promised. I am also going to hire a dude to take pics when the process server comes to your door and serves you the papers.. I have taken a second mortgage to see this to the end!

Actually it has nothing to do with this forum and I cannot tell the "complaint". My laywer did indeed tell me to shut up and stay out of it, why do you think I havent defended myself on BP.net????? Sorry Jim and you know how I value your opinion so..lol

This isn't remotely close to price fixing. You cannot price fix if someone else is selling at a lower price - plain and simple. Price fixing can only occur when all suppliers of a product set a price and there is no other competition. Just check out the oil cartel as an example. Time and time again they attempt to fix the price. Only to see it fall apart when one of them breaks ranks.
In any case this seemed to me to be correspondence between two competitors that should have been left as such.

I have no idea what went on with BP.net, your involvement there, or lack of it. I do understand that real legal complaints are best not discussed here. My own legal experience tells me that 99% of what folks posture about here regarding legalities could never meet the true standard, even with some money. To take a second mortgage to finance a lawsuit would indicate not only that the grounds had serious merit, but also that there was blood to be had. Good luck either way, but my skepticism has not abated.

While I do not think Matt need worry about prosectution from any quarter, I do think he created a public relations problem here, and might have best left it all with minimal comment.

You need to be able to defend yourself if someone posts about a bad experience. Not everyone automatically goes to the BOI.

I wasn't speaking of the legal issues. I was talking about how it is impossible for two sellers of like products, out of hundreds, cannot collude to set the price of that product. If you don't think there are hundreds of sellers dealing in Johnson Controls just Google it.
The public relations problem was created by Dennis going public with an email that was sent in private. There is plenty of competition for any hard good sold on this, or any other, reptile site. If Dennis and Matt decided to raise the price someone else would immediately jump in and steal their business. So now we're dumping on a seller for attempting to sell at the highest price the market will bare. Hmmm - seems like capitolism to me.
You guys can play weekend lawyer all you want.

Kevin, I agree. I do not think that there is a legal danger here of price-fixing. I can't possibly envision this being taken up by anyone anywhere under any circumstances. If there were other issues simmering that made this a renewed BOI issue, somene got rubbed wrong, etc., that's for the particulars to bicker over. I was curious about the other threat of legal action which was tossed out there. Most of the time we here of "libel" issues regarding forums, etc., but that is just a hunch on my part. Could be other things of course. As an example of the way libel actually gets any real traction, even if a false accusation is made, is the need to show damages. Kind of "So someone said something false about you. OK, its false. Now, show me where you were damaged by it", which in most cases means monetarily damaged. Matt said business just keeps getting better ! Go figure.
