In short, DON'T! Email notices are to ONLY alert you of a reply to your private message or your ad on this site. Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

Yeah, I know. They are a pain in the butt. But they pay the bills to keep my server running. Just a fact of life, I am afraid.

Want to get rid of them? Simple. Just become a Contributor level member or above and they will be gone. -> Please click HERE."

Is that too much for me to ask of you to keep this site running? Well, sorry about that. I too wish I could get everything for free. But alas.....

    =====================

Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

MIKE ZAGROBEL<br>.... HEADS-UP!!

Let me try to explain what I did, rationally....
I had contacted him before I posted this, to tell him just how I felt about THE WAY he did what he did.... not WHAT he did.... but THE WAY he did it??.... I didn't care that he wanted to back out of the deal? It was just because of his, "Oh, well", attitude, that I decided, If he could do this to me, he would probably do it to someone else, too, and I just wanted to give you guys a heads-up on the situation?? After the very first couple of posts, this thread evolved into a discussion of morals and ethics and your WORD?? It had nothing to do with the original post anymore.... I was well over that.... heck, I was over it right after I posted the original thread! I'm sorry if you feel I've been bashing this poor guy on every page?? He did what he did.... I did what I did, and I thought that would be it?? I certainly never expected the turn this thread took, I just went with the flow and gave my opinions, I never said anyone was wrong? I just disagreed with what they said?? But, back to the subject.... If Mike is reading this.... I do apologize to you if you thought this whole thread was about you.... let me assure you, it wasn't....
Jerry, I hope this helps explain it??
....Neil

Well said Neil.  <img src="http://www.faunaclassifieds.com/iB_html/non-cgi/emoticons/wink.gif" border="0" valign="absmiddle" alt=';)'>

In case you are reading this Kevin, this has just been my opinion. Neil did what IMHO was the right thing to do.

Regards  <img src="http://www.faunaclassifieds.com/iB_html/non-cgi/emoticons/smile.gif" border="0" valign="absmiddle" alt=':)'>

On a personal note on the ethical side... I personaly would tend to be a bit irate if someone gave me their word that a sale was final and then backed out of it for the reason given.

On the other hand, I've been a buyer far more often than a seller and I know how it can feel almost painful to have to fufill a deal when I know a better one (for me anyway) is avaliable. However, I would fufill it.

With regards to the validity of this post I just have one question...

Would Gilbert Thompson have been shown as having the habits he is now known to if one person hadn't decided to let others know? The situations are very similar when looking at that first post.

Senseless or meaningless posts that lack justification do nothing but eat bandwidth, true... But there is always that chance that a lot of people might have had a similar interaction that would be best brought out where people can view the potential and make their own choice.

Neil, when dealing with stranger, (iam assuming he is not a friend of yours) expect nothing! If per chance you are fortunate to consummate a transaction, be grateful, and be finished. Once you contacted him and aired your grievences, it should have ended there. To take it one step further, was nothing more than an invitation to a continuous dialogue, and as you pointed out eventually leads to the absurd conclusion , and as you pointed out, your sorry you even started the thread. This is exactly what I had warned you about. Your to smart of a person to get yourself rapped up in petty things.

Neil, based on what you have said I agree that you have a reason to be upset, But you have also backed out on "done deals" with me in the past and yeah it is a pain in the butt, but this is not Thunder dome (madd maxx) where if you break a deal face the wheel. This is a buisness where a busted deal happens. I have a rule "CASH AND CARRY" IF a person comes to my table at a show and says " gee Dave I can not live without the snake or lizard can you hold it for me while I get my wife and money?" the answer is simple "NO, NOT WITHOUT A DEPOSIT". I would like to hear Mike's side of the story to see if he had a good reason to back out, It seems that he was nice enough to call and tell you. I only want to hear both sides of this story. So please be kind enough to give us his e-mail addy or have him post his side.

Dave,

I would suggest you go back an read the initial post by Neil and you will see the details on why the person backed out. You will also see that the customer had Neil call him to begin with, and then only sent an e-mail canceling the deal. He did not have the courtesy to phone and cancel. I can definitely understand the whole thing about Neil getting upset. I do not hold animals any longer without a deposit or full payment. I have made exceptions (I made an exception for Daniel Alvaro on a Ball python and it went smooth, but I have made exceptions before and they have not)

Rob, Phone call or e-mail, the point is that the man let Neil know. I would just like to hear both sides of the story plain and simple. People are being told to keep a heads up for this guy and I think that it is his right to tell the whys and wheres on the story. Granted he may not want to post now due to the fact people are saying that he was wrong. So maybe if someone  (not Neil) e-mails him then we can hear his side of what happened. I think that it would shed light on this, don't you? How many times has it been posted not to judge until you get both sides? I just want to be fair in this and till he speaks we can't judge his actions based only on Neil version of what happened.

In most or all states, the agreement between Neil and his prospective customer was a valid and binding contract.  The only difference between this contract and a written contract is that it is tougher to uphold in a court of law.  But make no mistake, Neil most likely has a cause of action should he choose to pursue it.  And if in court that cause of action is upheld, then the potential customer would be adjudicated as having broken a civil law and would be forced to purchase the animal.

The other difference between a verbal contract and a written contract is that the person holding the written contract does not have to (and usually doesn't) care whether your wife's check doesn't come through or whether you can pay the rent.  By law, he has the right to his payment as scheduled, and nobody seems to question that.  If the other party fails to make payment because he chooses to pay his rent instead (or for any other reason), this creditor has the right, among other legal rights, to report this to the proper organizations, thus damaging the other party's credit rating.  Neil has appropriately reported a failure to pay under contract to the Board of Inquiry, which was established for exactly this purpose.  It is now up to that party to dispute it, and up to anyone who sees Neil's post to determine whether they wish to take a risk on this individual in the future.  I personally would not take that risk, but that is my business; whether others wish to take that risk is their business.
