Replying to the email just wastes your time as it goes NOWHERE, and probably pisses off the person you thought you replied to when they think you just ignored them. So instead of complaining to me about your messages not being replied to from this site via email, please READ that email notice that plainly states what you need to do in order to reply to who you are trying to converse with.

    Google Adsense ad revenue for December, 2025 was just $30 over the cost of the lease for the server running this site. So, in effect, the money providing the incentive for me to continue running this site is coming SOLELY from the paid memberships and sponsorships here. Which honestly ain't much....

Tampa is not all bad, it just looks that way. We have the bad guys, I'm not going to name names, you all know who they are, but we have a few good guys too, someday I hope to be in the later.

I ditto the remarks that Bighaze made - I hope to be a "good guy in Tampa" myself in the next year or so!

There are good and bad folks everywhere - all the bad guys don't live in Tampa Bay!!! :raspberry

i missed an email from mitch when i was scanning through my emails (i get a lot of them). he asked for my number. i will take it from here and see what he says.

thanks for your help and listening and reading. hopefully this helped others to make some decisions about where and where not to buy in the future.

Why does he need your number? Is he not capable of answering via email? Or simply giving you the refund that you are owed?
 
no, he won't screw me over in the long run. i will let you know how this plays out.

Mitch, MS Herps made things right...

I wanted to let everybody know that MS Herps made it right today. Mitch ponied up and refunded the money I had originally paid him for the two turtles he didn't have. Mitch is very young and made a mistake that he hopefully learned from by having to take a double hit to his bank account by refunding me the money. I applaud him for that.

I think that is what this site is for, arbitrating wrongs; not forever messing up someone's name over mistakes.

Thanks for everybody who contributed to the thread below.

Andrew - he told you he didn't have them. That can happen for a lot of reasons (maybe he never had them in the first place, maybe somebody just bought his last 2, maybe he looked and didn't think that what he had left was of sellable quality, who knows - HE DIDN'T HAVE THEM). who the heck are you to come out with

If you really want the things, ask when he'll be getting more, and if he'll geive you the same price...if you think you deserve something for sticking with him, ask for a discount. If you don't want to wait, politely ask for your refund and move on.

Now to Mitch...As I'm sure you've seen, many people have different feelings about drop shipped animals. I'm not going to pursue that subject.
What I will suggest is that you not make substitutions in a customers order without their consent. It doesn't matter how good a deal you think you are giving them, if you send something they didn't order - you are wrong. Period. If/when you find yourself in the position of not being able to fill an order - make it known (which you did), immediately offer a refund, or tell them when you will have the animal available again (if it is soon, if not - refund the $ and offer to contact them when you have what they want)

Well, if you want to call someone who basically "strong armed" you by insisting you take something you didn't even order, and then shipping it with no warning, just a "mistake". I'm glad he did make it right though.

He should either hold the persons order for a reasonable amount of time, waiting for the money, or he should make it clear that because he brokers animals he doesn't even have, that he accepts money from whomever is interested and then will see if the item is still available. (course, then who would send the money, which is why most people don't deal with brokers)

again, as this is another common problem with brokers/drop shippers, he should clearly disclose the info that he is a middleman, and/or broker and/or drop ships aniamls he hasn't even seen.

I agree with your comments to this statement. If you don't have something you don't have it. To insist such an action is kind of silly.

That is fine and dandy and all, but if you would take some time and read the rules of this website you would see that you should have posted this in the existing thread. Glad you got your money back, but I still wouldn't deal with Mitch, especially now that I hear he is only 17. Best of luck.

John, as I stated in my prior post, I don't know either party. I do not know if Mitch functions solely as a broker, or if he deals first hand with any of the animals he sells. In my mind, even though the title of the thread referenced it, I don't feel that brokering/drop shipping is the real issue with this transaction. (I also don't think that a major discussion of that topic is appropriate to this thread, so if it is coming from any quarter - please post a thread in the General Business Discussions forum.) The bottom line is that the seller advised the buyer that the animals he purchased were not available. It happens, it doesn't really matter why, and is not really the problem either. What is a problem is that the shipper opted to substitute items, seemingly without the approval of the seller. That makes him wrong in this situation, as I stated. Maybe he felt compelled to send something, due to the customers response (I don't care what you have to do, I want my stuff)...but that does not justify sending the wrong animals. In any event, I'm glad things worked out

The problem lies in that you view this from just your side. You know you wouldn’t wrong a minor or anyone else for that matter. Good for you! But a minor cannot enter a binding contract not only to protect you, but mainly to protect him from his presumed lack of judgment. For any agreement to be binding it has to be performed by two competent parties. Adults are assumed to be competent, and to have the capacity to enter a contract (unless under the influence of any substances or mentally ill). Minors are considered to have limited experience and thus to be more vulnerable than adults. That’s why a minor is the only one of the two parties who can rescind a “binding agreement” without it being considered a “breach of contract”. This is mainly to protect them from being taken advantage off by a more experienced individual. If for example a 6-year old offers you his piebald ball python (his dad’s birthday present) for $500 would you buy it from him? Guess what will legally happen when his dad learns about it?

Amazing, everytime this kid screws up, and it is brought to the attention of the public, he refunds the money and plays the "I'm only 17" card. It's a shame people don't bother looking for info PRIOR to getting screwed by him. I wonder how many others he screws over on a daily basis that don't know about the BOI?
 
this is getting rediculous

1) i started a new thread to make sure that this young man (mitch) got a little credit for doing the right thing. even though i am sure none of you made mistakes at his age. i'm the one who got screwed, you guys helped me by making this a serious thing to mitch, i thanked you. time to move on.

2) i got my slap on the wrist, so back off about it

3) the 6 year old thing was not literal. i spoke in length with mitch's dad who he does it with as a father son project. who cares about the laws about doing business with minors. if you started breeding reptiles when you were 16,17,18...did you do everything right? would you have wanted somebody to forgive you? would you want someone to buy your reptiles in the first place?

4) what, is this all you guys do? just hang out and nit pick and read the reptile gossip? get a life. i have been here for 2 years and have 25 something posts, oh yeah, thats because i post when its necessary not for enjoyment or because i think i know everything about everything.

It seems you are having a bad day. You took what was said as insulting and it was not meant that way. You said …“if a 6 year old had some nice reptiles for sale i would buy them”...You more than likely meant “an under-aged”, and that was understood. Sorry you took it the wrong way, what was posted was not meant to upset you in anyway.
